June 27th, 2022, i contracted American Contracting to replace my roof because of hail damage.

the agreement was to replace my roof with the same roofing shingle i had on it. the damaged roof had a 50-year shingle and i was told they would replace it with the same shingle. they did not they replaced it with a 25-year shingle.

i tried to get them to put the correct roof on at the time and the Branch Manager told me he could not because the shingles are not available. i made one phone call and found them at a roofing supply distributer and i told him that. it was the same distributor he used for the 25-year shingle. also, several homes in my area were using the same 50-year shingle at the time he told me he couldn't get them. i left messages for him he never called back.

i have sent pictures of the before and after shingles they acknowledge they used a 25-year shingle. they also acknowledge billing me and my insurance company for the 50-year and installing a 25-year shingle. the 50-year is at a higher in price.

I have tried countless times in the last 3 years to contact him. i have left voice mails and messages in his office with no reply. it is now my understanding he is either no longer with the company or has been relocated.

the last time i tried to get him i spoke to another individual who it appeared was interested in helping me. i also ran into their newly hired Quality Control person at a neighbor replacing shingles they installed from the same storm mine had been damaged in.

last Wednesday May 21st i was contacted by the individual via email that i thought was going to help, she had a meeting with the Operations Manager. in the email she told me she was in the process of contacting the manufacture's rep that sells them the 25-year shingle to contact me and give me the benefits of the shingle and a copy of the warranty. IT IS NOT A 50-YEAR SHINGLE all the information and warranty information in the world is not going to make it a 50-year shingle.

We replaced **** *********** roof on 8/23/2022 using GAF Grand Sequoia shingles. This is a 50 year shingle which is equivalent to the pre-existing shingles that Lititz Mutual Insurance Company approved. We supplied *** ********* with photo evidence, receipts, manufacturer documentation, and details of the grade of shingle that his insurance company allowed for as well as meeting with him on site. After 10 months of failed collection attempts, we ceased efforts which left us unpaid by $14,122.01.
We intend to meet with *** ********* and the representative for GAF shingles on the property to have the third party discuss the 50 year class of shingles.

      Business Response

      Date: 06/27/2025

On 6/23/2025, *** *********, *** (the shingle manufacturer rep) and a representative from our company met at his home.  They reviewed the materials on the roof, compared to the informaiton and photos previously installed and came to the conclusion that the shingles currently installed were the exact ones that were previously installed.  The manufacturere stated they were installed correctly, and that there was no further questions to be posed as to whether the material installed was to the proper caliber because he measured the product installed with his shingle gauge and it was all in line with what the product ordered out and installed specs should be.  The manufacturer also confirmed that the shingle has a lifetime warranty shingle and provided the homeonwer with the shingle manufacturer's warranty information.  The other concern he had for payments being given to us and not reflecting in his payments made to us needs further review time.  The checks issued by the insurance company and Mr.Borgstadt were provided to us in his last response.  Those cancelled check copies indicate that they were received by him, endorsed by him, and we are still looking into the depository information for those checks.  Please allow us a couple more days so we can confirm the accounts deposited to.  *** ********* will be confirming with us early next week his account numbers so we can compare to our bank account numbers and proceed from there.

      Thank you.

      Complaint: ********

I am rejecting this response because:

everything stated excluding that we discussed the warranty did not happen.

the GAS rep viewed the roof from the street and stated that it looks like they are installed correctly

no measurements were taken no calibrations were taken and I have no idea what a shingle gauge is could you explain please as neither the GAF rep or your representative brought anything to the meeting.

photos provided earlier were taken from the top of the roof down as no pictures were taken from bottom up as they would have given a real definition of what the shingles really look like. in addition, the GAF rep stated the Sequia does not look like the Presidential. if any or all of you would like to come to my home and view my roof and my neighbor's roof next door as they have the same roof I had you will see the difference between the two.

i think the biggest issue that we have been missing is we have been looking at a 2025 or a 2026 version of the Sequia not a 2021 or 2022 version that was installed. the sequoia shingle has undergone significant appearance updates and tweaks since 2022 as they continue to try and emulate the Presidential. I can supply documentation if you would like.

not sure why "EXACT" is being used in your last correspondence could someone explain that to me please?

we did discuss the "Limited" Lifetime Warranty, and it is the same warranty that almost every shingle mfg is offering as of 2025. in addition, the shingles that were on my roof before American installed an inferior looking roof and charged for the premium roof have a limited lifetime warranty.

i am getting tired of the continued bickering and discussion on this matter as I don't know how it can be clearer than what i have explained.  Americans Branch Manager at the time, 2022 over 3 years ago took it upon his self with no regard to common decency and the law to substitute an inferior shingle for the premium shingle and charge for the premium shingle price. my agent, the adjuster and the insurance company agree with me. i also am awaiting a return call from the Kansas Insurance Commision.

in addition, it was stated in a previous correspondence that i had been contacted repeatedly by American and then turned over to a collection agency for payment, i never received one call from anyone at American or a collection agency other than ******* or *****. i need the collection agency's name the contacts name your account number with them and the phone number to be sure i am not listed as a collection account. my belief is that you all never knew the status of my account until I sent you the canceled checks because the ******** Branch Manager had hidden the information and my account was not shown up as late pay.

this indeed is a costly error by the Renegade and I understand that.  I think the owner of American and ***** are decent people wanting to do the right thing but are looking at a loss because of the Renegade manager doing what he wanted to do other than what was right. Please understand but it is not my fault if it is could you please explain?

in closing I don't understand why I have to continue to explain my stance. Could you please explain this also?

I believe I have found the reason we are looking for the money once American receives the information from their bank I will explain what I found.

      Sincerely,

      **** *********
