    The customer had his vehicle towed to our shop on 8/31/2023. When the vehicle arrived the truck bed was full of trash and was missing the passenger side mirror and was noted by the tow truck company. The tow company dropped the vehicle in our rear parking lot. We contacted the customer to let him know his truck arrived and confirm his concern about the vehicle not getting fuel and would not start. At the time our shop had a two to three week wait for diagnostics, the customer was aware of this wait. The vehicle was parked in the back parking lot by the tow company and never moved. The customer contacted us for an update on September 21, 2023. We explained our backlog and that we had not had a chance to look at it, but given his description of issues the amount of repair would not be worth investing given the condition of the truck. The customer was upset with our choice not to work on his truck and our advice and said he would come and pick up his truck. On September 22, 2023 the customer picked up his truck from the same parking spot the tow truck originally parked it in. We attempted to help the customer set up his tow as his sister was helping tow it out when we noticed and advised him his brakes did not work and that he should hire a tow company to tow the vehicle away for safety. The customer became very upset and began screaming at our staff. After the escalated behavior of the customer my staff was directed to leave the vehicle and customer alone while he and his sister towed his vehicle off the property. 

    3-4 months after the customer towed his vehicle off our property, a deputy from the Miami County Sheriff's Department stopped by our location and questioned us about the customers complaint that we stole his rear end and broke his mirror. The situation was explained to the deputy. The deputy said he would be going to the property to check out the complaint and let us know what he found. A few days later the deputy returned and said that the original rear diff was indeed still in place that that the mirror looked as though it had been missing for quite some time. He stated that he explained to the customer that he would not be filing a report and informed him that if he wanted to pursue any further that he would have to follow up with the ***** Police Department on a civil level. No one from the ***** Police Department ever came to our location to inquire. The continued accusations of the customer are fraudulent, and requests are completely absurd.

    As previously stated, the “customer” vehicle was towed to
    our facility using a local tow company not running. He had a fuel concern, and
    the vehicle would not start. When the vehicle came in it did NOT have the
    passenger side mirror and was noted by the tow truck company. The tow company
    parked the vehicle in our rear parking lot for which it stayed parked in the
    exact spot until the “customer” towed it away on a rope with his sister. Our
    staff never had the opportunity to diagnose therefore never touched the vehicle.
    Also previously stated, when the customer came to pick up his vehicle we
    expressed to him given his explanation of vehicle issues our professional
    opinion was to not repair the vehicle as it was not worth the diagnostics
    and/or repair bill. This was when the “customer” became very upset and began
    screaming at our staff. Our staff was directed to leave the vehicle and “customer”
    alone while he and his sister towed it away.  

    Please note that the “customer” first accused the tow company
    of stealing his mirror and now us. As far as the “customer” accusing us of
    stealing his rear end this is a severely false accusation that we take very seriously.
    The false accusation was backed by the ***** Police Detective along with a
    Miami County Sheriff Deputy both stating after inspecting the rear end at the "customer's" property it looked new and had not been touched. Neither agency filed a police
    report.

    No services or repairs were performed on this vehicle during
    this time, making his demand of vehicle replacement preposterous and completely
    unreasonable.

    My main concern is that the rear end and the diesel starter were stolen out of the car and the passenger mirror while at E&K Diesel. I want to be compensated for these pieces and for the assembly of said parts to be put back into the vehicle. I went to ***** Police Department and they did not find any report or statement filed by E&K Diesel. I tried to make a report but the police officer said, “what do you expect me to do” several times. The rear end that is currently on my car is not the new rear end I put on there. I feel that E&K Diesel stole my new rear end and the new starter and replaced it with an old rear end and starter and applies my mirror to another vehicle. And I would like a public apology from E&K Diesel.
