The above Claim is being described by the caregiver of the proposed client. Ready power was contacted to provide a quote for a home generator and sent a sales manager to pitch their generator to my mother. The information that was provided to my mother of 68 years old with dementia and just recently lost her husband. My husband and I wrote them a letter explaining that she is not capable of making a decision as large as that. Ready Power then proceeded to harass my mother to electricity sign the quote but unbeknownst to her she was signing a contract that obligated her to start the work order to begin ordering her until. Once we reloaded what happens and decided to cancel due to an unclear contract that my husband and I reviewed, we asked then to cancel the co tract that she did not even know she was signing for, Ready Power stated that there was a three day period that she amhad to cancel. Now the company is stating that she is liable for almost $1500 for fees on a product she did not received and was not able to make. In fact, the sales person was supposed to return the next day to go over the the quote but did not show up. Again I am her decision maker due to her condition and explained to them that she cannot pay for something she does not have. Is Ready a power in the business of taking advantage of elderly women. I really hope not. We asking for a full refund of the $500 payment and to drop collection activity on this matter at once.

The appointment for an Estimate for *************** was created on 7/24/23 after she contacted us interested in a home standby generator.  This appointment was confirmed via text on 7/28/23 and 8/1/23.  *************** responded on 7/28 to confirm the appointment.  On 8/2/23, *************************, an employee of Ready Power, visited *************** at her house and provided her a generator quote.  On 8/2/23, the same day as the estimate, *************** agreed to have Ready Power install a 24 kW generator for $14,980.  In addition to a detailed signed contract, attached, she also signed a detailed payment agreement form that clearly included a 10% cancellation fee.  This fee represents the real effort and expense that Ready Power incurred after this contract was signed.  She applied for and was approved for financing through our partner *******.   On 8/22/23, almost three weeks after the contract was signed, Ready Power proceeded with internal Project creation and permit issuance.  At no point had *************** nor any relatives reached out to Ready Power with any concerns.  On 8/25/23, Ready Power completed a Welcome Call with *************** to explain the process of the generator installation.  On 8/29/23, Ready Power sent *************** a text letting her know that her building permit was applied for and she confirmed via text.  On 8/31/23 Ready Power text her that her Gas and Electric permits have been issued.  She replied via text confirming this.  She also responded via text on 8/31/23 asking "Will you all be contact me before they come"?  The same day, Ready Power replied via text confirming that the installation will be scheduled with her.  *************** confirmed.

On 9/18/23, *************** called the office to request to cancel her generator project.  She also text Ready Power the same request.  ************************* contacted her and honored the request to cancel the project but informed her that the cancelation fee would apply as per her contract.  At that point a cancellation invoice was created on 9/18/23 for $1,498 and sent to her via email.  On 11/2/23, *************** spoke with ******** at Ready Power and told her that her daughter and son-in-law would be paying the invoice for the cancellation.  On 11/15/23, we received a $500 payment via check to pay part of the cancellation invoice.

On 1/16/24 and 1/30/24, Ready Power sent emails with the past due invoices.  It wasn't until 2/6/24 that Ready Power heard from anyone other than ***************.  This was also the first time anyone had questioned the agreed upon contract and related cancellation fee.

Ready Power affirms that the cancellation fee is fair, contractually agreed upon and should be paid in full.  We are expecting expedient payment for this balance due.

On 03/09/2022 I paid $395 for a "Semi-Annual Maintenance" agreement. During the year a service tech checked the Generac generator. Changed the oil and filter once - noting each visit the unit frequently tripped and had to be reset. On the 2nd visit he recommended I get a "service tech" check it out. On 12/23/2022 I called the *********** office and requested a service tech - I was told the cost would be an additional $175 in spite of having a maintenance agreement. The service tech came out changed the battery on the unit and left. The unit continued to trip offline. On 01/25/2023 I again contacted the *********** office and was told another $175 would be needed to have the service tech come out. He changed the starter on the unit. The problem was fixed. Ready Power knew that Generac had installed defective starters on their units - this problem had caused them to replace "hundreds" of starters. I should not have to pay to have a known defect to the unit I purchased in August of 2020 fixed!

I paid a deposit of $5,196.75 on 01/26/2022. This deposit was to hold a 24 kW Air-Cooled single-phase Generac generator to be installed no later than 6/23/2022. Ready Power *** continues to give me excuses and has since ignored my requests for a refund. We do not have a contract that states if I cancel, they will access a 10% fee of the total amount, yet they are now trying to say they will take a 10% fee, which was never disclosed or agreed to. I WANT A FULL REFUND. Ready Power assured me they would be able to deliver and install again no later than 6/23/2022, and yet we are THREE MONTHS past that date, and they are refusing to give me a refund.

This was resolved amicably with the client receiving a full refund.
