I contacted Posigen in October of 2022 to start the process of getting a new roof for my home. I already have solar panels with posigen so I assumed it would be a simple process since I've been a customer for a few years. I was told it would take 4-8 weeks. It is now January 2023. I explained several times since October ************************************************************************************************* to remain insured with them. The Contract listed a projected start date of November 17, 2022 and a completion date of December 17, 2022. I have made several attempts to speak to someone about the concern of the November start date and the December end date passing but I have only been able to speak with one individual who has informed the proper individuals of this issue. No one has emailed me back with a possible solution. I have explained that I can/will loose my home if I am unable to maintain homeowners insurance on my property and if I don't' have insurance then I wont be in compliance with my mortgage company. I am now in a full panic because I was given a date to have the roof repaired and that is February 2023 (next month). This will be a tragic loss for me and I will have no home to put a new roof on. I have provided the letter from my insurance company with a needed completion date of 2/15/2023.

In July of 2021 Posigen solar inspected my roof certified it and installed solar panels.Subsequently stains appeared in the ceiling of the two upstairs bedrooms. The roof had been destroyed when installing the panels and needed to be replaced.I contacted Posigen for resolution to the situation that the had caused. They looked at the roof and said it was not them and refused to do anything to resolve the situation.I got them to remove the panels but only after they forced me to pay $1800. I payed $12500 to replace the roof the wqeek of November 5 2022 and alerted them that I was ready for the reinstall of the solar panels. I was given an 11/28/2022 reinstall date which came and went with no communication from Posigen.I have called and emailed and receive no response from this company. When I get someone on the phone they tell me the same canned speech that scheduling is working on it. I am currently paying $120 per month for solar panels that I do not have as well as paying for electricity that I should be generating.

After Hurricane ***, I had to replace my roof so I contacted Posigen and paid the required $500 to remove and replace panels after roof replacement. Posigen estimated that the panels would be replaced 6 weeks after notification of the roof replacement, they took 13 weeks. This was during the hottest part of the summer. When they finally put them back, they weren't even working for another several weeks!! The only reason that they found out was because I saw on the Entergy bill 0 contribution from the panels. They said it was because the panels were not communicating with the electrical box!!! How much incompetence are people supposed to take?!!! Not only did I miss out on all the summer heat and savings, but this company has the **** to expect monthly payments on all months that they robbed me of competent service!! This has to be the worse company in the business and I am beyond frustrated at their incompetence and ****!! I sent all the bills proving my case and NOTHING has been done about it.

I reviewed your account and it looks like there was an issue with your reinstall. We attempted to reach you several times but we may have a bad contact number. If you would like to update your contact information please give us a call at ************ option 1. Since there was an issue with your system reinstall, we provided 9 months of payment deferments this year.  I am happy to say, we were able to resolve all your issues in November therefore payments should resume.

Its our goal to provide homes with savings and the reinstallation issue impacted your savings. For that reason I will be sending you something in the mail. We are sincerely sorry for the inconvenience and hope we can get back to providing your home with clean energy and savings.

I purchased my home in February of 2017. On or around October of 2017 PosiGen installed solar panels on my roof. In November of 2022 I discovered massive leaks on several areas of my roof. I hired three independent roofing professionals and each company confirmed that the leaks were a direct result of the improper installation of PosiGens solar panel. The companies concluded that PosiGen Solar incorrectly and improperly installed the solar panels causing extensive damage to my roof in my home. The damage is extensive and only occurs were the solar panel brackets were installed on my roof. Prior to me purchasing my home in 2017 a home inspection was completed my roof at the time of purchase was only five years old. PosiGen also conducted their own mandatory inspection prior to installing the panels and their report is void of any mention of damage to my roof they deemed my roof in excellent condition. . I have contacted PosiGen twice a day since. I have also provided PosiGen SolaR with the independent reports I received as well as photos taken by the roof inspector.I begged them to work with me to please resolve this issue. As my home is the only thing I have left. my sister who has stage four lung cancer resides in the home, I cannot, under any circumstances afford to lose it. I have begged them to please simply correct their error and I have been met with this red tape.To add injury to insult I had to pay PosiGen $**** for them to temporarily remove their solar panels that caused the damage they caused. given the urgency I had no choice. To date the panels still remain on my roof after over 20 phone calls and several emails my roof remains in the same damaged condition it was prior to me informing PosiGen. Even after paying PosiGen **** the panels still hasnt removed the panels. mold has begun to form and my rafters that support my roof are weakening Day by day please help

      ************,

Thank you for brining this to our attention.  As I understand this installation happened October 2017.  This installation is now five years old.  This is much longer than our workmanship covers.  As you can image roofs continue to age and roof damages are often caused by certain weather conditions. Typically if a leak is from an installation it would have identified itself prior to the passing of five years.

This being said I have arrange for a PosiGen employee along with a roofer to come to your home later this week to look at your issue.

I will confirm the date with you once I know for sure the time and day.

      Thank you,

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

My roof was ONLY five years old when the panels were installed by PosiGen. The damage to my roof has occurred in multiple places but occurs ONLY where the panels were installed. In addition THERE ARE CURRENTLY DRILL HOLES IN THE PLYWOOD where the installer missed the roof rafters while mounting the panels. Small trays of light are shining into my roof. Im not a roofer and have no expertise in roofing but Im certain these round drill holes are not a result of weather conditions.

as you are aware PosiGen conducts their own independent assessment of roofs prior to installation in order to assess the structural integrity of the roof as well as to identify any leaks or damages to the roof. My roof was in excellent condition free of defects and leaks as it was only five years old. We are presented with three independent reports attesting to the age and condition of my roof prior to installation of the panels, as well as reports identifying the only source of the leaks and now we have visual evidence that can not be disputed showing at minimum the installer erred on multiple occasions by completely missing the rafters and drilling directly into the plywood of the roof.

Im asking PosiGen to do the right thing. Please review the independent roofing report, the inspection report and multiple photographs Ive  submitted to posigen, send out the Roofer and PosiGen agent to my home lets review the current condition of the roof, and reports concerning my roof and work out an amicable resolution. I am open and willing to assist PosiGen any way I can. Im simply looking to have my ************* to the condition it was prior to the installation of the panels nothing more nothing less.

please I am asking posigen to fix this. My sister has stage 4 lung cancer and she lives in this home.

      Ms. ******,

We must look at the damage prior to agreeing to anything, much like an insurance adjuster would do prior to settling a claim.  This visit, which we accommodated the date and time per your request, had already been scheduled for Thursday.  We are not sure why you are rejecting our response before we have a change to evaluate the situation.  Our commitment is always to do the right thing but we need to figure out what that is once we evaluate the situation.

Thanks you and I will be meeting with the team once this report has been assessed by PosiGen.

We value your business and appreciate you reaching out.  As you are aware we are working towards getting this resolved for you.

      Thanks,

This company did not do anything that they said they would do. We are now paying for something that offers us no benefit because it was never fully set up. Not only did they damage my roof they are charging me for something that I cant use. I would like my roof fixed the panels removed and my money back from this company.

I got solar in June. After several months of smaller bills from Entergy my bill came back much higher as it used to be before solar installation. I called Posigen the rep told me that they had flagged it as not working a month ago. They never called to tell me or came to fix it. The rep said a manager would call me but they never did. I called 6 times waiting until discounted Their call back suggestion is false they never call back. I finally got through to a customer care manager who put me on hold for 16 minutes. She returned to say she can't answer anything yet, they don't know what's wrong and will call me back. . I demanded to know when they will fix it and have no answer. I am 73, in poor health, on low income and I cannot absorb these high unexpected bills. Posigen gets more and more customers and does not take care of their current ones. I want the system fixed and guaranteed to work, and I want them to pay the difference to Entergy between what I paid when it worked and now. This is stressful and the worst service ever. I think Posigen should not be allowed to get more customers until they can properly service the ones they have.

I am concerned for the future that this does not happen again. I still think Posigen has to ensure that they have sufficient technicians and customer reps instead of just adding more and more customers without the ability to fulfill responsibility.  Of course things break, but Posigen should commit to informing customers, set appointments for repair, and stop saying you will call people back when you never do.

I'm currently leasing panels from Posigen. The panels were under performing, so I contacted Posigen. By contract, Posigen is required to maintain the equipment. It took 2 months to get a technician to come to my house to confirm the equipment is in fact not working properly. The tech said half the panels are out because of 1 panel. 2 months and multiple calls and still nothing. Thanks

We have called for repair. The contract says hey would see the problem and come fix it Now they att disconnected their product and they cannot see problems. Well I called for about 6 months or more to get the problem fixed and they refuse to fixed problems. They know Entergy is charging way more then they should with the Panels. They decided not to response and fix the panelsref. Its been broken for about a 6 to 12 months and we have contacted them to fix the problem. Saving will help Entergy to gain more money. We loss and that one panel was a help to us. The contract has a clause that when our bill has no saving we would not owe the monthly note for the panels. They refuse to discount it or fix it. That hurts us but not them so please have them fix my panels and refund my monthly bill since we are getting large energy bills. Thank you, ***********************. No response from ****** bbb

      **************,

Thank you for reaching out. As mentioned by your Account Manager,  cellular providers have upgraded the cell tower from 3G to 5G.  This does not mean your system is not working, it means the system is not communicating to the monitoring platform.  This does not affect your production and does not mean the system is down or broken.  The reason we know this is because you provided PosiGen with a utility bill and on this bill we see sellback to the utility for unused production.  If the system was broken we would see no sellback so please note that this is proof the system is operational.

The 3G meters have been on national backorder and we just received our first batch last week.  I have scheduled a tech to come and upgrade your meter this week.

I signed a contract with Posigen on May 15th 2022 to perform a roof replacement and solar panel installation. The signed contract included costs to perform the roof replacement and installation of solar panels and a loan was secured from ****************** by Posigen to fund the project. the first week of September 2022 they notified me the solar panels were ready to be installed and I asked about the roof. They responded saying they would need to figure that out and get back to me. About a week later they said they would not perform the contracted roof work with their only reason was they were unable to place a dumpster in-front of the house. I offered to handle waste removal and after another week, they came back with a quote to do the roof for $40,000 in the middle of September 4 months after signing the contract to do the roof and solar panels in May. the original contract amount provided by Posigen was $21,176, so they were holding the solar installation hostage unless they received another $40,000. I recently received a quote from another roofing contractor and they are quoting $18,500 to do the same roof, but this quote is 5 months later with obvious material and labor increases since the contract with Posigen was signed back in May.

      *****,

Thank you for reaching out.  It appears your roofing project was deemed non feasible because your roof has multiple layers of roofing which was concealed when our sales person originally looked at your roof.  In our contracts we do state the price of the roof is only an estimate and would need to be evaluated by a licensed roofer. The licensed roofer said he found several pre-existing layers of roof which was hidden.  Apparently your roof has a layer of cedar shake, two layers of asphalt shingles, two layers of torch down rubber roofing.  In addition it would have required all new gutters and a full re-deck of plywood as well as customer flashing.  The scope of work was much more than expected which is why the increase in  price.

I do see that PosiGen sent a non-feasible assessment letter to you as a follow and a cancellation notice.  We are more than happy to honor the Solar installation but only after you bring your roof to code.  We apologize for any inconvenience we have caused you.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[Provide details of why you are not satisfied with this resolution.]

      Hi,

I was told multiple times that the roof was being surveyed by Posigen prior to the estimate was created. Several of your employees looked in the attic which showed the underside of the roof assembly, the furring and cedar shakes, pictures that were received by multiple Posigen employees prior to the estimate being created and the contract being signed. After 4 months of Posigen having records of what the roof was, I was notified that it wasn't feasible which has caused numerous increases in material and financing costs caused by Posigen's blatant breach of contract and blatant disregard for known information provided to your employees. Posigen had information on what the roof was prior to the contract being signed but choose to ignore the information it seems to try and keep me locked in for solar panels only to pull the roof out at the last second by quoting a $40,000 increase in project cost. The only concern I received from Posigen after the September roof review was there were concerns about where the dumpster could be placed, nothing was mentioned about the existing construction of the roof or any significant cost implications, it was only after another week and a half that the $40,000 quote for the roof came out of no-where. At this point I would prefer not pursue legal methods but due to this highly illegal breach of contract causing ~$4,000 cost increase in materials and another ~$1,000 in additional interest due to higher interest rates due to being lead on by Posigen, I would be willing to settle this case entirely and drop any legal charges for $2,500, which is half of what Posigen has caused in financial damages due to numerous professional errors and omissions.

      Mr. *****,

We provide language in our contract that states we make assumptions that you have a solid surface for receiving an installation of a new roof. You had hidden defects that did not allow capture of this information until further investigation by our team found the multiple layers.  This is why we cancelled the contract.  We did notify of this cancellation.  We are happy to honor the installation of the solar systems however, your roof must be to code to allow us to proceed.

Please see below the to areas in your contracts that we make reference to this:

"Any alteration or deviation from above specifications involving extra costs will be executed
only upon written orders, and will become an extra charge over and above the estimate (at
$100/hour per man for roofing, $65.00 per man per hour for carpentry). All agreements are
contingent upon strikes, accidents, or delays beyond our control"

"All prices indicated are based on the assumption that you have a solid surface for receiving the
installation of a new roof. If upon commencement of work, it is found that roofing boards,
cornices, or other surfaces are in such condition that they will not hold nailing, or otherwise
found unsatisfactory to perform the work, the expense for labor and material incurred for
putting the roof in a condition to receive the new roof will be charged to your account as an
additional charge on a time and material basis. Whenever possible, PosiGen Solar will notify
you in advance of this matter. Ordinary repairs under the above conditions will be undertaken
by PosiGen or acting subcontractors and charged to your account at the actual cost to us.
Should any leaks occur within the period of guarantee due to defective materials or poor
workmanship furnished by us, we hereby agree to repair same without charge, upon receipt of
proper notice in writing, providing we have been promptly paid in full"

      Thank you,

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      ****,

Per the language you are referencing, please provide a breakdown of expected costs that the additional work and materials would amount to so I can review. To date that has not been provided for approval or review. I would also note that the language you are quoting is in the roof replacement of the contract, and is not related in any regards to the solar panels. Posigen had multiple chances to provide concerns about the roof starting when I first engaged with Posigen back in April of 2022 and I repeat that Posigen was provided images of the roof, rafters, and underside of the roof in early May before the contract was signed. I was told 3 times prior to May 16th that Posigen was sending someone out to inspect the roof and I was not notified by Posigen that the roof had not been surveyed prior to the signing the contract. I received another notification that someone had surveyed the roof in July. If none of the statements regarding surveying the roof are true, then Posigen has been lying to keep the contract alive for 5 months and I was led on with a signed contract by Posigen for 5 months. Once again, I offer that Posigen help recoup some of the financial harm I have suffered due to 5 months of delay, breach of contract, and misleading statement and actions by Posigen which have caused significant material costs and interest rate increases. I am willing to drop all legal matters regarding this breach of contract for $2,500, otherwise I will be forced to recoup all costs incurred by the breach of contract and intentional misleading practices by Posigen as well as additional costs required to pursue this issue in court.

      Regards,

As mentioned ***** we can proceed with the solar once roof has been brought to code which is why I did not mention the other contract.

No worries in the roofing upgrades, I will have head of roofing contact you to understand the scope better.  His name is *******************************.

Thank you and we do hope we can do business on the solar and EE side of things.

It appears as Posigen cancelled the original loan for the project, and financial harm still appears to have been caused by higher interest rates. To date, I have not been provided with a path for Posigen to provide only the solar portion of the contract as the original load included roofing work and Posigen cancelled the load twice.

I spoke with ***** today and Posigen still has not provided any info on providing a financing option that matched what was cancelled unilaterally by Posigen back in September. This issue still has not been resolved. The fact it took Posigen over 4 months to determine the roof was beyond their abilities is still completely unacceptable and still has caused significant financial harm.

I spoke with ***** last Friday and he said someone else from Posigen would reach out to confirm the old financing and pricing for the panels alone, which excludes the cost of the roof work that Posigen refused to honor the contract. To date, no one from Posigen has reached out which is why this issue is still not resolved. I would prefer not to have to pursue legal action, but I am again being strung along and mislead by Posigen.

      *****,

I am not sure why your are rejecting our response.  As I stated, we cannot replace your roof because of the multi layer issue the roof has.  We reserve the right upon inspection to decline the work if our inspection shows work is needed outside our usual scope of work and expertise.

You also spoke to *******, head of our roofing department again on Friday October 28th.  During this call you told ******* you were getting your roof replaced the week of October 31st.  You agreed to send pictures of the completed roof.  As ******* mentioned, these pictures will be necessary prior to our sales team visit. We will proceed with the solar system once our feasibility team reviews and deems the roof feasible to install on.

Please let me know if you have further questions.

Posigen still has not shown any documentation stating identical financing for the panels only is an option. Without documentation, the problem still remains open that I was misled for 4 months by Posigen and as of today's date, I still do not see any progress on this issue.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

The document you are referencing was provided more than 4 months after Posigen reviewed the property and roof. This was 4 months of misleading information and being led on that Posigen could do the job. Now that I have a signed contract for the roof to be done after a 4 month delay which has resulted in material and labor costs increases from prices in May 2022 along with interest rate increases, I have suffered financial damage from Posigen's neglegence. I have not received any confirmation that Posigen can provide the original interest rate of ****% with the cost of roof removed from the original contract. I don't understand how I can accept what you are proposing, ie Posigen's letter 4 months late stating they couldn't proceed with work that both parties had signed to in contract which has caused major financial harm to me as well as being further led on by Posigen, as I have not received any paperwork regarding removing the roof work from the original come or the loan stating the terms noted above. In your response, please provide new paperwork covering the correct loan terms as well as the corrected project scope, otherwise I will be forced to continue rejecting your responses as they do not address the problem at hand.

      BBB,

Please close this claim.  We have communicated to the customer that next step is for him to provide PosiGen with pictures of his completed roof work.  We agreed we would honor the Solar installation but I cannot provide that documentations until he replaces his roof.  Interest rates are changing daily so we have to wait to make sure we capture the correct interest rate.  Interest rates have a guaranteed expiration date.
