I signed a solar contract with Breiter Planet on 9/6/2022. No word about when the project could be scheduled. After 6 months of practically pleading to either get the solar installed or let us out of our contract the owner, ******, finally put the panels up in either February or March of 2023. He was adamant about signing the Project Completion document with us being under the assumption that the solar panels were being turned on. It was only after a few days when I looked to see how much solar we were producing that I noticed the system was not on. ****** said he was waiting for approvals from Eversource to move forward with the local town's inspector to come out and make sure we can turn the system on. We called Eversource who let us know they have nothing on file for us and that they don't give approvals for solar installations. Our contract is unreasonable since we have been paying since 4/22/2023 for a system that is not turned on and not ETAs provided. We also feel Breiter Planet is working as a fraudulent company that has been lying to us without the intent of completing the project they were hired for.

I have not heard from the business in response to my complaint. We have also texted the owner, ******, to take down the video he made of our roof that was posted on social media. We did not give consent to do that. No response has been received.

    Business Response

Hello, my name is ****** Breiter-Wu, and I am the President of Breiter Planet Properties. Our goal is to address the customer complaint and allegations and get this complaint resolved with the Better Business Bureau.

We wholeheartedly deny and object to the allegation that Breiter Planet is a fraudulent company. This claim is defamatory, and we will defend our reputation vigorously. We have followed all terms of the Solar Home Improvement Agreement and the solar loan agreement with Dividend Finance, which the customer fully read and agreed to via DocuSign.

    Contract Details:
The Solar Home Improvement Agreement between ************************* and Breiter Planet Properties was signed on 9/6/2022 via DocuSign. The project was sold by an independent contractor, not an employee of Breiter Planet. The customer also qualified for a loan with Dividend Finance to finance 100% of the project cost.

The agreement stipulates a 12-month timeline for the installation of the solar panels. Here is a quote from section 3 of the agreement: Breiter Planet will install the System within a reasonable amount of time after we sign this Agreement but no later than twelve (12) months from the date of this Agreement Construction was started and finished in February 2023, well within this 12-month timeline.

    Payment Schedule:
Breiter Planet only receives payment after construction is completed. We front all costs for design, engineering, permitting, project management, and materials, totaling around $30,000. After construction, Dividend Finance requires the customer to sign a certificate of completion indicating that construction is completed so that funds can be disbursed to Breiter Planet to cover these costs. The certificate of completion has no language about the system being operational or turned on, its purely based on construction being completed.

    Approval Process:
Following installation, we must complete additional paperwork to obtain permission to operate from the utility company. There were delays in this process due to external factors, including issues with disgruntled sales representatives affecting our operations.
Dividend Finance may start collecting loan payments from the customer before permission to operate is issued, as per the loan agreement signed by the customer.

    Communication Records:
We have extensive communication records with the customer, explaining the process and timelines. At no point did we indicate that signing the certificate of completion meant the solar system was operational. As mentioned in the complaint, the customer assumed it meant the system was operational. The process of obtaining permission to operate was explained during the sale, after construction, and via text messages.

    Current Status:
On November 22, 2023, the customer sold the property at ******************************************, where the solar project was installed. The solar system is fully operational and connected to the utility company. Another contractor has since modified the wiring, which violates our warranty terms and the current owner is aware of this.

Given that the project is operational and the property has been sold, we believe no further action is needed and request that this complaint be marked as resolved.

    Sincerely,
    ****** Breiter-Wu
    President
    Breiter Planet Properties

We hired Breiter Planet Properties to install a solar system on our roof, the entire install was sold as One Day we made this purchase in January of 2022 it is now Nov1 and we are still not operational. This company has consistently broken promises, didnt pull permits with the town for the work that has been done, falsified the job status to the loan company to get paid in full and here we are still not producing electricity. We want compensation in the form of 6months utility bills and we want the job finished.

We purchased a solar panel system, new roof installation with 3 trees to be removed for a cost of $67248.32 on February 23 2022 with Evergreen Solar/Breiter Planet Properties financed thru Mosaic. We signed the agreement with Breiter planet on March 1st with the approximate completion date 30 to 120 days from the date of agreement. The new roof shingles were installed and solar system installed by end of May. We signed off that it had been done so it could be moved to the next phase of inspection from the building inspector and the electric meter changed from the electric company and tree removal. After weeks of waiting for the inspector we contacted the city building inspector to get a date for the inspection only to be told no permit was ever applied for the job. After contacting ****** Breiter he stated he would get us the permit number in which he never got back to us with the permit number. After numerous phone calls, emails and text messages to *********************************** of Breiter Planet they have yet to respond to any of our correspondence with them. We then contacted the sales person from Evergreen Solar and was told that Breiter Planet Properties has over 10 other customers with the same issues and were told to cease and desist with talking to the customers with the issue. We are now making monthly payments to Mosiac for a system that is not functioning also still need 3 trees to be removed. We are just wondering what is the best course of action for us to do and who to contact to get the issue resolved?

On 14 March 2022, we entered into an agreement with Breiter Planet Properties to replace our roof and install solar panels at our home located at ******************************** in *******, **. Since that time, Breiter Planet Properties and / or its representatives have mis-represented the status of the project and failed to properly manage preparation, permitting and planning to successfully execute the project. In mid-August, after multiple conversations with Breiter Planet (****** Breiter-Wu; President and Investment Manager), the *************************** and Eversource we learned that permits had not been filed and would require 5-6 weeks for final approvals (this is despite previous communications over the summer that all permits were submitted and approved) Based on these conversations, we sent a letter on 18 August 2022 to terminate the project and requested a refund of the $55,258.50 paid to Breiter Planet Properties. ************************************** agreed to terminate the project / contract and return the monies we paid. Despite repeated and ongoing contact with **************************************, the promised refund has not yet been provided.

Our solar roof install was completed by Breiter Planet on 5/3/2022. On 5/3/22, ***********************************-** wrote an email stating: "An email from dividend your solar loan provider should be in your inbox. Please sign your certificate of completion to confirm modules are on your roof. This allows us to move your project to then next stage on on our end. Next we will submit for utility approval and get your inspection scheduled with the town within the month and take it from there. We will be in touch." We signed our loan agreement with Dividend for the solar on 5/10/22.I'm about to make my third payment for my solar loan and it still has not been activated. Mr. ************************* wrote an email after several inquiries on 7/15/22 saying that he is putting together an email with a full update and estimated timeline of permission to operate. He has not responded to further requests since then. My wife contacted my town city hall on 9/22/22 and they said no paperwork has been submitted in regards to my address and solar being installed.

We signed a contract to have Breiter Planet Properties install solar on our home on November 18th, 2021. The contract stated an estimated completion time of ****** days for the project. It's now July 27th, 2022 and they have still not finished our project. We have been facing ongoing disruptions to our life due to their equipment being on our property, power outages / loud noise / equipment and vehicles blocking our driveway when they are working, inconsistent scheduling and complete lack of communication about what is going on. I have been given 5 promises from their president that the job would be completed by various dates starting in April. Most recently I threatened a BBB complaint and they promised to finish by July 15th. But that date has come and passed and they still aren't done so I am going forward with my complaint.
