I entered into a contract with Spartan to purchase a 2-ton air conditioner unit for $5,650.00, to be installed on June 13, 2024. Spartan was scheduled to arrive at approximately 8am-9am. I signed and emailed the contract to Spartan on June 11, 2024 at 2:51 pm. Spartan charged a $2,825.00 (50% deposit) to my credit card and emailed to credit card receipt to me at 3:08 pm that same day, June 11, 2024.Spartan called me on June 12, 2024 at 1:32 pm to inform me they did not have the 2-ton air conditioner available. They offered to install a lower ton air conditioner. I declined their offer and requested a full refund of my deposit, credited to my credit card. I sent a follow-up email after our phone call and again this morning. The refund still has not been applied to my credit card. Since Spartan was able to charge my credit card within 15 minutes after receiving the signed contract, I would have expected a refund charged to that same credit card by now.Business Response

I am rejecting this response because:
I filed a dispute with my credit card company on June 13,2024. According to the letter I received from the credit card company on June 13, 2024, the credit card company credited the funds to my account. I am not aware of a refund from Spartan. Additionally, I do not recall Spartan stating the refund would take a week. When I called to inquire about my refund, the call was disconnected by Spartan. After Spartan scheduled two separate appointments and cancelled both of those appointments, I requested a refund.Since my credit card company credited my account when I filed the dispute on June 13, 2024, I consider this matter closed.

- 12.5.23 Spartan quoted me $18,000 to repair sewer line behind my house.- 9.13, work strarted. This after having called Spartan, and at at the direction of *************************, a representative of Spartan plumbing, who came to the house wearing a Spartan uniform and in a Spartan van. An initial payment of $9k (stub attached) paid.- 9.25, *************************, wearing Spartan uniform and working with a Spartan crew (video footage avail) informed that additional $8,500 was required to finish job (in addition to the remaining $9000). This was exclusive of concrete. With a major hole in my back yard, and trusting that ***** was an official representative of the company, I paid him in the way he instructed me to. I maxed out the $8000 maximum via ***** pay and had to pay the rest by check. - After completion of work, ***** also asked for the additional $9,000 for Spartan - After some suspicion I called Spartan to inquire whether ***** acted on behalf of the company - was immediately threatened by *****, the company's own representative and worker. - Spartan asked me for proof of the payment directly to him. when I was hesitant (fear of reprisal), they sent me attached warning letter saying they would not guarantee/warranty their own representative's work, pointing out no proof their representative had asked for or received more money.- As a result, and fearing for my own safety, I took a leap and provided Spartan with the proof of payment to ***** (attached - ***** Pay and check).- Result was insulting. Not only does Spartan not accept responsibility for their representative's work in the first place, nor do they accept to warranty the work that was done by *****. They also cited legal consultation in reference to me; further intimidation.- In follow up conversation with ***** at Spartan, he said ***** was no longer with the company. However, despite the fact that ***** and Spartan separated over issue (Spartan was protecting itself), Spartan won't make it right for me.Business Response

Dear Sir,
We completed a sewer repair job in the rear backyard of your house on Monday the 25th of September for which we were paid a total of $18,000. We did a great job repairing your sewer, even when we had to hurry to beat the tropical storm that was on the way. The sewer was permitted and passed inspection and we even camerad it again to show you that it was flowing and working the way it is supposed to work. Spartan did nothing wrong to you --On the 26th of September we did a free camera inspection of the same sewer going out to the street. We found that the sewer is flowing, all drains are clear. On the same day, you called our office and spoke to my general manager, *************************** and stated that you paid $12,000 dollars by apple pay to one of our employees, ************************* thinking you were paying Spartan to do the job of replacing the corroded part of your sewer inside the house. Spartan had received no such payment from you. It seemed strange to us that you had already paid Spartan two $9000 payments and the process was quite different but you still thought you paid Spartan not *************************. You told us that you were sending us proof of this payment by email to *************************** my manager but we did not receive it and although my manager went to your house and called you repeatedly, we did not hear from you, however, the person who supposedly wronged you, ***** did hear from you and he told us he knew that ***** had gone to his house because you told him so, you were in touch with *****, but not us.
When we wrote you a letter telling you we were not going to warranty or insure the second job as we had not contracted with you for any such job and we had received no such payment from you. We wanted to let you know that we were not responsible for side work done in your house by a person you paid directly and we wanted you to know that just in case you still thought that it was us doing the work because it was not us. We never did a second job for you.
As soon as you received this letter you sent us two very angry emails. Then on Saturday you changed your story and said you wanted to talk to us and that ***** was threatening you. We spoke to you Monday and you completely changed your story. You showed us proof of two payments directly to ************************* and a contract with no company name or signatures for additional work. However you stated that the payment was not for a second job or additional work but for the same work that you had a signed contract for $18000 and we had pulled a permit for. No one would pay an additional $12000 for a signed contract stating the entire cost was for the detailed work was $18,000 and you had already paid this! If the extra work was for this job, the ditch would still have to be open when you paid it. Most side jobs are done inside the house where they do not have to be permitted and are not able to been seen. This story made no sense.
Another thing I do not believe is you then told us ***** pushed you into the house and made you make the payments to him. I said, so he was violent towards you and you said no,he was not violent. This also makes no sense, he laid hands on you and you did not think he was violent to do that but then you said you were worried he would throw a brick in your
window. We believe that you contacted ***** right after you hung up the phone with us because he then called and quit—we did not fire him, we never had a chance. We don't know what is going on but you didn't want to reverse the charges on the ***** pay or stop payment on the check you wrote to ***** to get your money back so I do not believe you were forced to make the payments or you did not know that you were paying someone for side work. You have written two bad reviews trying to damage our reputation and then erased them and rewrote them after I replied completely changing the story perhaps in hopes of getting a warranty on the side work you had done. The only one hurt here is my 59 year old company which has been voted Best Plumber in Best of DC -9 years in a row! . Your decisions to pay someone ***** pay directly and write a check for an individual who gave you a proposal with no company name on it, not reverse the charges, not contact the police or stop payment on the check are very suspicious. Your own behavior suggests that you knew very well you were having side work done by this individual and you are still in contact with him.

I am rejecting this response because:I’ll keep the response really factual to make sure to cut through the noise of the convoluted response and try to make others understand why Spartan really should be steered clear of if you don’t want to leave yourself open to scam. There’s no disputing this fact: Spartan separated with their employee who came to my house - in uniform, hat and van - and charge me an additional $12,000, which I provided them evidence of. What’s interesting is that they separated with the employee, but refused to make it right for me. Not much else to say there.
As for quality of job, it was the very employee that Spartan separated with and that charged me an extra $12K that did the final inspection. Seems odd to me that Spartan would claim it was a “great job” if they reneged on the standard guarantee they gave (because of their own employees actions, with whom they separated).
And it’s very worrying for customers that from my perspective they don’t seem to take physical threats to their safety from your own employees seriously, even when I offered to show them video footage. Would make me worry how they vet the rest of their teams
For those out there, perhaps all you need to know is this: after all this, I was informed that Spartan had engaged their lawyer for this situation and I felt threatened by this. And as final insult they refused to engage me on this situation when I was seeking resolution. Don’t get caught out!Regards,

Spartan Plumbing, Heating and Air Conditioning believes that *************** is not telling the truth. He has changed his story many times but his actions speak louder than his words. Spartan believes he knowly employed this employee to do a side job, but wanted to get the warrenty from a licensed, bonded and insured reputable company like Spartan. He pretended that he was fooled by the employee but in reality he has stayed in contact with him all along and refused to reverse the charges or stop payment on the check for the two payments he paid him directly. He also refused to contact the police. He can't do that because he is lying and might get into trouble. He pretends that Spartan has done something wrong to him but in reality we did nothing wrong --we did a very good job of the one job we pulled the permit for. The repair was completed sucessfully, inspected and tested with a camera. We passed inspection. The side job was not done by Spartan. He knows that. He's just angry that we refuse to do any more work for him because he is a partner in crime with the renegade employee who quit after we found out he was doing sidework. But before he quit and disapeered he let us know that he was in contact with **************** all along and knew more about what he was doing then we did. We cannot warranty a $12,900.00 job we didn't do.Customer Answer

Complaint: ********The following are simple facts. Note that Spartan doesn't deny any of this. 1) I paid Spartan $18,000 for a job - the contract included inspection and then warranty. 2) Spartan did the job, but has not inspected or warrantied the job, as was stated in the contract. 3) They refused to even come out and see the work that their workmen had done.
It's really that simple. The rest speaks for itself; Spartan tying itself into knots to protect themselves from the behavior of their own employees. They separated with their employee as a result of his behavior, but refused to make things right for me. I won't dignify the other lies such as me staying in touch with their employee whose work they refuse to even examine - it's embarrassing for Spartan to be resorting to this. Their assertion of a side deal and staying in touch are manifestly false.
Even a heartfelt apology would seem reasonable at this point. Again, sad.

**************** is lying when he says we did not inspect the $18,000 job and I can prove that because the inspectors passed it --we pulled a permit on it. We even used the camera to test it and it was flowing freely after our repair. But **************** is not talking about this job. He's talking about a $12,900.00 job that he contracted with a former employee and Not my company and for some reason he wants me to warrantee it when it was not done by Spartan.and he knew very well who he was paying to do the job he just knows that that person is not licensed bonded or insured and will never give him a warranty on it. We did not do this job and we never got paid for this job so why should we warrantee it?
