On 2-24-25 New ** axles were put into my sons' pickup by ****** Auto. On 3-15-25 the truck was put into 4 wheel drive for the first time. The ** axle came out of the differential extension and subsequently the axle extension cracked and lift kit bracket broke. As this happened 200 miles from ****** auto the vehicle was brought to a local dealership in **************. Their third party warranty is covering the ** axle but none of the consequential damages of almost $4,000 dollars. I tried to work with the people at ****** to come to a agreement but they say they will cover nothing saying they feel the ** axe didn't cause the lift bracket to break and subsiquenty the axle extension damage. Following is service writer mechanic assessment of damages.Good afternoon, I am sending some requested information regarding reference number 172996.Customer concern:CUSTOMER STATES THAT THEY HAD A ** AXLE REPLACED ELSEWHERE. Business Response

We observed the photos that were taken at Schweiters in *********** and determined that it was most likely that the bracket attached to the differential had broken first causing the weight of the vehicle to lower causing the cv axle to over extend. In the pictures that Schweiters sent, this bracket has a significant amount of rust near the breaking point. You can see that the CV axle is also still attached to both the end of the wheel and the differential. **** claims that the CV axle caused torque. CV axles by design do not create torque. Torque can be transferred from the differential to the CV axle, but they cannot create torque. The transmission applies the force. If the CV axle were to have been the source of the failure we would expect to see the axle broken and flinging around under the vehicle. The lift bracket is about a half inch thick. Another theory would be that the person driving the vehicle hit a pot hole or a dip in the road causing strain to a rusted part breaking and the CV axle breaking. If he shifted the vehicle on the fly while it was in between gears, it kicked a lot of force through the differential causing it to snap forward, breaking the bracket. If the CV joint inside the CV axle were to bind and snap, the axle would most likely have exploded and separated from the boot with a dangling axle in place. **** contacted Schweiters to ask how the vehicle arrived to them and was informed that the axle was still attached to the differential extension. The vehicle was also driven almost 600 miles before this occurred. At the end of Verns phone call with ****, he could hear his wife in the background screaming, I am going to take up a 40 hour a week job with its sole mission to end Matts Automotive. Our warranty does exclude modified vehicles and this vehicle is modified with a lift kit. Unfortunately, we do not consider liability to fall on our shop with the information we have been provided in the repairs.
