Our boat was not properly winterized by The Moorings service staff. This resulted in a large crack in our exhaust manifold. Rather than replacing the manifold, it was repaired with a silver paint on product. We were told by the owner that service charges would be voided. We have now sold our boat (hVing to lessen sale price by $1500 bc of the manifold), and are being told we owe for service charges previously voided.

      Business Response

      Date: 07/22/2022

      To Whom it May Concern,

We received your letter on July 15, 2022 and would like to respond. While we strive to satisfy all our customers and ensure fairness and quality service, there are times obligations for the consumer to pay and lack of ability to do so interferes with our ability of providing any service to them, that they would consider to be satisfactory.

The consumer making the complaint has unpaid slip rental at our marina as well as unpaid invoices for services on their boat. The boat we serviced is a 1986 vessel and it’s age alone can cause issues not as a result of the service provided by our technician. The manifold had a crack in it caused by heat and not by failing to winterize the vessel properly. Our technician applied JB Weld upon discovering the crack during de-winterization. The crack was not and would not have been observed during winterization because the process of winterizing would not require the technician to observe the manifold at that time. When De-winterizing the vessel, the technician looks for any leaks. The only time a technician would attempt to correct a manifold leak with JB Weld is when the crack was caused by heat as a crack caused by freezing water would be much worse, and also in a different direction making a mend with JB Weld impossible. Therefore the crack that was mended in the manifold was caused by heat during use of the aging vessel. This is not an error of our service.

This consumer has suffered financial losses and physical ailments from a recent car accident and is having difficulty paying their debt to our company. As a courtesy, we have removed any and all late fees for the consumer and also applied a 10% courtesy discount to  her service invoices. If our technician errored in de-winterizing this consumers vessel, we would immediately rectify the situation with the consumer but this is simply not the situation here.

Thank you for your time and please let us know the outcome of this complaint.

      Sincerely,

      ***** ******** *** ******** ***** **** ****** *******
