    Date of transaction: Jan 26 2023 The amount of money paid to the business: $774, Invoice ******* What the business committed to provide: Conduct home inspection to identify problems with the house I was buying Nature of the dispute: Home inspection failed to identify serious issue with the leak from the 2nd floor bathroom/ shower to the garage ceiling. Leak and damage (stain) was clearly visible on garage light fixture. The inspector failed to mention that damage (stain). Poor quality home inspection led to expensive repair: 1) Remove drywall - $185 2) Regrout the shower - $1062.64 3) repair/ reinstall ceiling drywall - $780. Total cost: $2027.64 Whether or not tried to resolve: Yes, tried to resolve for several months. The business owner came to the house. The business owner admitted their fault. The business owner promised to repair or /and to compensate for repair. The business owner dispatched two handyman to repair. Handyman started the repair process. When they realized that the damage is more than what they expected, the owner of the business backed off and informed that he is not going to repair or compensate anything as it is more than he was thinking about, although admitting his fault initially.Desired resolution: compensate for 1) Remove drywall - $185 2) Regrout the shower - $1062.64 3) repair/ reinstall ceiling drywall - $780. Total Refund: $2027.64

    Dear BBB

    I sent in a response about two weeks ago when I received the first email here are the attached documents that back up the unwarranted and false claims by the complaint client.

    Mr. Machavariani has absolutely NO documented proof to support any of his claim other than some photos of torn out drywall. However, we have photographic evidence of the issues surrounding his master shower issues with the cracked grout in the home inspections report. Also, I sent an eyewitness contractor to investigate further and backup and support everything. He has no right to come out of the gate and threaten my company with such aggression (small claims/ BBB) before ever affording me the opportunity to come and see for myself. Furthermore Mr. ************ has no ground to stand on and if he peruses any of this nonsense there will be a counter suite claim by me and my attorney (which is already aware and preparing) for defamation and make false claims. No refund of any kind will be awarded. 

    Please review all documents carefully so you can clearly see for yourself.

    I am rejecting this response because the statement from the owner of the business are not true. Business owner had a chance to see the issue himself and AFTER looking at it promised to repair/ to compensate. The business owner dispatched two contractors to fix the problem. The contractors started the repair but they failed to complete it. I mentioned to the business owner that poor quality of his service could lead to negative reviews. The business owner in his email response said that he knows how to bury poor reviews of his unhappy customers on search engines. I have a copy of this email from the business owner. Low ethical standards of the business owner and low quality of their service that led to expensive repairs for me resulted in this attempt to seek protection and compensation.

    I am rejecting the complainants last response because he will not admit nor be truthful that the real source of the leaks from a defect in the master shower that was IN THE REPORT. The report files / photos etc. have been submitted as proof to (BBB). He bought the home taking a monetary credit ILO asking the seller to do repairs or have having a qualified contractor investigate further (AS WAS RECOMMENDED & FACTUALLY STATED IN OUR REPORT TO THE CLIENT). The client did nothing after receiving the inspection and had no intention of doing any repairs prior to closing. He used our report for a monetary credit and this is what happens when you don't follow our recommendations or read the report. This process is also agreed upon (signed) by the client in writing (see per inspection agreement file) So, after clients (FIRST CONTACT) and threatening to take me to small claims court before I even went there and looked at it. Client says I verbally said I would take care of it well does he have that on paper and signed (NO). Yes, I took care of it I sent one of my contractors there as an eyewitness and to verify our initial report findings. That why we will not refund or compensate the complainants. The paragraph below is on every report, and this is agreed upon by the client when signing the pre inspection agreement.

     FSHI will assume NO liability or consider any future claims for errors within this report in regard to any and all sellers made repairs / mishandling of the recommendations or repairs performed by unqualified contractors. 

     Unethical! hum how about twisting the real truth around when we did the job right (and have the proof / eyewitness to back it up) and he did nothing.  This concludes my responses over this matter. Best Regards, ******************* - Five Star Home Inspections.
