    The builders agent in this case Tammy was unprofessional and giving us misinformation during the time of signing the contract. When we signed the contract there was no estimate given on when the house would be completed. When we sign the contract the rates were still reasonably low and it was possible for us to buy the house and at the time when the Builder came back and gave him as a final closing date the rates were too high and has jumped on mortgage by quite a bit almost 50%. And because of this reason and due to adverse market conditions as a consumer we have the right to back off and I requested the earnest money to be defended to which the homeowner or the home builder had been accommodating. And I request that this review being file as a complaint so that the agent does not give misinformation to someone else that this earnest money is going to be refunded in case anything reasonably is bad later on.

    The written Offer to Purchase document clearly states that the Earnest Money Deposit is non refundable.  Long term rate locks are available but this home buyer opted not to pursue a long term rate lock.

     I am rejecting this response because: The builder and the sellers agent is having a habit of luring the potential buyers saying that the money will be returned if you have a reasonable explanation. This complaint is to highlight the anti-competitive practices that are rampant in the area and especially with Bob. As a consumer this seems like not a level playing field where the buyer is having a choice of selecting his own date for completion that has put us in a spot which is not favorable to obtain the house. The interest rates are no more the same when the contract which was signed. This is the reason, and also we offered to purchase if the price could be lowered both were rejected.
