July 8, 2022 roofer did work at *** ******** *****, a rental home owned by Mr. ****. Work was completed the same day. Mr. **** is retired from decades in the home construction and remodeling industry. Early on the morning of July 8th Mr. **** spoke simultaneously with the on-site job supervisor and the owner of the company (via telephone). He specifically stated he wanted the wood under the roof replaced so as the roof would not appear wavy. Both the supervisor and the owner agreed to perform the job per Mr. ****'s specifications. Later that same day an updated invoice was sent via email to Mr. **** indicating the increased cost with the addition of more lumber. That was the third increase to the invoice. Once the job was completed and after the crew left, Mr. **** inspected the work and and realized the job was not performed to his specifications and the roof was indeed very wavy, indicative of not completing the job as requested. Mr. **** is withholding payment until the job is completed properly and the roof is level and straight. On July 14rh Providence Roofing LLC placed a lien upon the property. (Case number *******  Mr. **** can provide video of inside the attic after the roof was replaced where you can clearly see nails not attached to anything and old lumber in place. He has received several estimates from other roofers to fix the roof in question and all state the new roof must now be replaced to repair the sagging lumber underneath. Mr. **** is very hesitant to allow Providence Roofing access to his property to fix the roof because he was led astray the first time and feels duped by the owner. He instructed the owner and supervisor the exact procedure to use and was ignored. Providence Roofing must make the roof right through paying for someone else to do the work since they were unable to do it right the first time.

Since the very beginning of our initial communication which was never by telephone but rather emails I was very hesitate to work with Mr. ****. I never really got any solid answers but rather vagueness about time lines, payments, etc. I never got a good feeling about him. He would never answer any questions directly and never would have a phone conversation with me. Believe it not I don't even know what he looks like.  Even now he refuses to have a phone conversation with me. I've tried repeatedly to call, text, and email to set up a time at his convenience to meet at the house in question to possibly come up with some sort of resolution. He has yet to give me a day/time but rather texts/emails me accusations about my character and workmanship. I have only ever spoken to Mr. **** briefly for a few minutes on the phone the day we did his install. We did have a conversation about the roof decking. The house originally had metal tin with 2 chimneys that we removed for him. Mr. **** wanted shingles so we had to deck over the whole roof with decking boards. The house is very old and very run down. The trusses had settled and had quite a bit of sagging in them.  He did call me the day of install, which was our first and only phone conversation this whole time. It basically consisted of him asking if we could try and do the best we could to mitigate some of the sagging, while this was not in our signed contract "scope of work" I did inform him we could add some bracing underneath the trusses in the attic to help support them from sagging, he said he understood and acknowledge what I said and that was the end of the conversation.  My foreman who heard the conversation can collaborate my side of the story. We have performed all the work as stated on our contract to date with out receiving 1 cent from Mr. ****. I didn't ask him for any payment until after the work was completed. All the materials, fees, and labor to perform his job came straight from me, of which he still refuses to pay.  I choose to ignore my gut feeling about Mr. **** and the situation and do the job anyway, of which I severely regret.  After speaking to several people that know Mr. **** and his reputation in our community I now know that my gut was correct.  Mr. **** has a reputation of being somewhat "shady," someone who "takes advantage, " and not a good person in general. Due to Mr. ****'s lack of concern to meet his debt or unwillingness to meet with me to look at a possible solution to remedy this whole matter I truly believe he has no intention of paying us. He has been posturing and maneuvering with his banter to create some type of diversion in hopes to not pay or to create a stain on my record. I have reached out to him several times with the last 2 times without any response at all. I have only ever spoken to him with respect and kindness when I've addressed him. After nearly half a dozen times of me asking him to please provide a time that we could meet at the house to discuss a solution he has yet to provide even a slight bit of interest in resolving. I truly believe he just doesn't want to pay. I have sought legal council and I do plan on taking things further to a legal matter if he doesn't comply. However, I would  and I am willing to work with him to remedy the situation. Hopefully I'm wrong about Mr. ****

I am rejecting this response because:

      I don't agree

Most of what the owner states is slander and name calling and does not address the issue of the shoddy roof workmanship. Ashley has had numerous conversations with me. Since filing this complaint I have not returned his calls because he is not offering any solutions.  He was told exactly how to run stringers and level the roof and agreed to this process and increased his price to include the needed extra lumber. His crew chose to place decking on a saggy roof which only worsened the load on the roof and led to more sagging. I spent a few hours at the work site the morning of installation to ensure the crew and owner knew what I wanted.  They assured me they understand what I wanted and would complete as I requested. I do not trust Providence Roofing to correct this problem.  Several other roofers have indicated the entire roof must be removed and properly framed using stringers to create a level roof with new framing materials, new decking, underlayment, and shingles and drip edges. To have the job completed correctly will cost more than what Providence Roofing charged me and I am not paying twice for the same job. I believe Providence Roofing should hire an agreed upon third-party roofer who is licensed and insured to rectify their shoddy workmanship at their own expense.  I have been in construction or remodeling my whole adult life and ALWAYS pay my bills.  This name calling and slander is not fixing a shoddy roof and has no place in a work quality dispute.  I did ask Mr. **** via text what he would do to fix the problem and did not receive an answer. I believe an agreed-upon third-party roofer at Providence Roofing's expense is a fair resolution to this dispute and await Mr. ****'s answer. I can supply documentation for all conversations, voice mails, emails and texts. I have videos and pictures of the roof from before, during, and after installation and inside after installation.  I look forward to an amicable solution to this dispute.

So I say he is lying and and he says I'm lying. We can go round and round about this all day. I can show our contract and the scope of work within the contract. There is no mention of all this structure work. The only reasonMr **** is here is to some how negate his financial obligation and get something for nothing. Again he claims we didn't do what he supposes we should have done, which according to him was told to me over a two minute phone conversation we had on day of install of which I have a witness who can collaborate my version of the conversation of which I told him we could do some bracing but that it wouldn't be perfectly flat of which he acknowledged. Also, to state again our contract never stated any structure work as I continue to reiterate. Mr **** claims we have had conversations but a random text from him throwing insults to me is not a conversation. He refuses over and over to speak with me nor to meet me at job site. He claims to be such a professional but to date we have never met in person and have only spoken on the phone 1 time for maybe two minutes. As to date Mr **** has not paid one dime, and now he wants me to pay someone to do something we never agreed to and what he states we didn't do. If he wants to hire someone to perform the work on the structure then we would be willing to remove the shingles and install them again after the structure work is completed. The roofing removal and replacing would be an additional expense to me of course but he would need to pay for the structure remodel. This way he can control that portion of it, maybe he can do it himself since he so knowledgeable. Due to his track record with us he would definitely have to pay us in full for monies owed us before we would agree to this new resolution. My offer requires Mr **** to pay his agreed upon bill, having an on-site face to face conversion and developing a game plan on resolving logistics of the project. Mr **** cannot and should not be allowed to negate his contractional obligations and responsibilities to our contract. I'm out roughly $7-8k to date.
