      I received a copy of my background check that had information older than 7 years on it. The paper says Statewide Criminal history (7) years in Nebraska. There is information reported on this background check that is as old as 14 years. I called the background check to confirm that there was information being reported on the background check older than 7 years. I asked to see a policy where it says information from more than 7 years can be included. I then asked if they could provide me something in writing to say this. The rep said that it was on the last page of the report saying they can post anything past 7 years. I asked her what specific page, she appeared to be frustrated as demonstrated by her tone of voice when she said I don't know. I then told her that Under the Summary of your Rights section, there was a bulletin point that said consumer reporting agencies in most cases may not report negative information older than 7 years. I asked what is the exception. She said it was because it was a conviction. I asked to have that sent to me in writing. They also did not allow me to dispute. She put another woman on the phone who said it was a conviction and therefore had to be reported. Again, I asked to see something in writing. I then asked for a supervisor, she said the supervisor was out until maybe the 10th they were not sure. I asked for the supervisor's name and she refused. I then told them I have a consumer right to have this information. They said that it is common knowledge that a conviction that is older than 7 years has to be reported. I told them as a consumer I am not privy to this knowledge and would like to read the policy myself saying this. The first lady said it was stated on the summary page, but it is not and they could not tell me where it stated this information. Again, I asked if I could receive something like that in writing stating that specific policy or regulation. She said they do not have one. I told them that was not a fair answer.

      As we talked about, a consumer statement has been added to your report. You also expressed a desire to dispute aspects of your consumer report. We have fully processed the dispute by way of re-investigation to ensure accurate reporting. We have concluded our re-investigation and no changes have been made to the report. I can assure you that One Source has followed all legal requirements, to include but not limited to federal law and state (Nebraska) law, in addition to the client’s specific requirements. Under the FCRA, consumer reporting agencies are permitted to include convictions indefinitely, with the industry standard being providing a minimum seven years of history, where legally applicable.

      I understand the importance of ensuring your report is accurate, and I fully support your decision to consult the FCRA and research your consumer rights. Please know that we take our responsibility under the FCRA very seriously and are committed to processing and validating consumer disputes diligently. We are strong advocates for consumers and their rights under local, state, and federal laws.

      Additionally, I noticed that in your complaint with the Better Business Bureau, you included an attachment of your PDF consumer report. I recommend checking with the BBB to ensure that this attachment is not publicly visible.
