      La Barge Landscape was contracted to perform several items: revise and improve irrigation system, install new soil and mulch, refresh existing gravel and remove existing flagstone with the intent to reinstall and install *********** ******* wide joint polymeric sand. Most of the work was completed, even though they did not complete the installation of new soil and mulch. The major area of complaint is that they cut up existing large pieces of flagstone without authorization. They then installed smaller pieces which are inexpertly cut. Some pieces are stained or of different color. The polymeric sand was not installed correctly as shown by crumbly areas and soft areas. One area has a rock inserted in the polymeric sand.
      We have submitted several emails, text and photos describing and showing the areas that need improvement. La Barge has refused to complete the flagstone and polymeric sand work to our satisfaction. I can send paper copies of documents. I don't know how to attach documents or pictures to an email. We have paid $10, 950 out of the $14,852 contract price.

      This matter is currently being handled by our attorney.

      On September 4th, *** *********** was given a final and formal notice from our attorney that if payment is not received in full by 4pm today (9/13/24) a lien will be asserted against her property pursuant to NMSA 1978 § 48-2-2, and we will proceed with filing to obtain a judgment against her for the balance owed, interest due, and attorney fees necessitated by her breach of contract.

      Our company returned back to the property several times after the project was completed in an attempt to satisfy *** ***********, but it became clear that she simply does not want to pay what is owed of her. Her complaints change daily, and unfortunately, it has become evident that nothing we do will satisfy her. 

      We have more than upheld our responsibilities as outlined in our contract. There is no justification for her failure to uphold her obligations under the agreement.

      This is the first time in the fifteen years that I have been the owner of La Barge Landscape that I am having to take legal action against a customer. We tried every reasonable thing we could to make this right.

      It has been a very difficult and upsetting situation, and we look forward to having it settled.
