Pattern of Complaints
On
Nov. 25 and Dec. 4, 2024, BBB contacted NYC PHONE BUYER LLC regarding a high
volume and pattern of serious complaints. BBB received complaints in the past
36 months alleging:
consumers
sending products after receiving an offer, but the offer changes after you
receive the product. Others state the checks you send for payment are returned
by their banks for insufficient funds. Finally, there are some that send their
phones or devices in, and then do not hear from the business.
BBB
notified NYC PHONE BUYER LLC about the pattern of complaints and asked the
business to voluntarily cooperate in eliminating the pattern by providing a
written response outlining the specific steps it would implement to avoid
similar complaints in the future.
The
business responded to the pattern of complaints with the following statement:
This
is very common in our industry and is said about all of our competitors. The
reason for this is because customers lie about the condition of their devices
and they get angry when they are advised the condition is different.
Additionally,
one of the sites we were a trade in partner on was advertising prices that were
3 months old. Customers could see the accurate pricing on our website, but this
drove us an unusual amount of traffic. About 10x what we would normally get. It
may also be part of the reason people have been complaining about the prices.
We informed the partner site about the issue, but they never made any changes
to assist us. We are no longer partnered with them as a result.
Regarding
the insufficient funds, this was not intentional. Our bank account was
restricted for several weeks. I went to the branch to speak with the bankers to
resolve the issue and was informed that there was nothing they could do. They
would not let me access my funds, deposits or withdrawals were restricted. This
crippled our business as this is the time of year we make the most money. The
new iPhone launched and we were unable to capitalize on the launch due to our
bank account being restricted.
We
have temporarily halted operations for the most part while we sort through all
of the customer issues and complaints.
