I hired Dale Randall Contracting to build a flat roof in early June. The roof was not properly built. When it rained, the roof became a pond that stored a large amount of water (see picture). On June 12, water started to leak into the bedroom underneath the roof, and caused furniture damage (see pictures).

I contacted the company and requested a repair. After numerous phone calls and several delays, they showed up on June 27. They agreed to build another roof on top of the old one. In order to create a pitch, they took down wall sidings and lifted an exterior door. However, throughout the day, they denied that roof was built improperly, and instead claimed that the cause of the leak was an exterior wall on the leak-free side of the roof. Without my permission, they tore up part of the wall, and offered to repair it for $2400. When rejected repeatedly, the owner ordered the crew to stop working and leave the property. The wall was left open without sidings (see pictures). The other wall was left open with insulation materials exposed (see pictures). The exterior door was not sealed. A lot of garbage was also left on the property.

I request that this company compensate me for the furniture damage and monetary cost of repairing the open walls. Moreover, BBB should investigate the behavior of this company, and impose penalties according to appropriate code of conduct and laws.

Response taken by phone:  The consumer wanted us to replace his flat roof.  We advised the consumer against this as there was no pitch to the roof but he wanted it done anyways, so we did it.  When he complained about leakage, I agreed to rip up the spot that he thought was leaking and discovered there was no wet spot or proof of leakage.  We put a pitch on the roof and redid the roof for free.  We determined the water is coming  in from behind the J channel, on the window, under the siding.  This has nothing to do with the roof we installed and we will not fix it for free. He told us to leave the siding off and my workers can attest to this.  I have pictures and proof of everything.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  Here are my responses.

First of all, the contractor showed very poor judgement. The roof was improperly built, so much so that a large volume of water would accumulate when it rained. When the water reached a certain level, a fast leak with a gush of water would occur. This had never happened before they built the new roof. Despite my repeated account of how the leak occurred, the contractor refused to listen and was fixated on the J-channel of the window. In fact, no such leaks ever happened since they rebuilt the roof. Their own repair worked! This proved that the contractor either made poor judgement, or purposely pivoted to the J-channel to shirk responsibility.

Second, the contractor spent the whole day trying to extort more money from me. When I refused, he got into a rage and pulled his crew out of my property. To repair the roof, they uninstalled all the sidings on one side of the wall. They also took sidings and plywood off a second wall. They purposely left both walls untreated. Uninstalled sidings and plywood were scattered around my backyard. Studs and insulation materials of the walls were exposed to the weather. This behavior is a violation of basic business ethnics, and should be investigated by BBB.

      Regards,

We took off the siding because we had to show him that water was running down the wall behind the window and had nothing to do with our repair.  Consumer told us to leaving the siding off because siding was not good and expected us to buy new siding and replace it or free.  We replaced the roof for free and stopped the leak, but we will not pay for siding.  If the consumer buys new siding, we can assist with replacement for the cost of labor.

Signed a contract on August 22 2022 to tear off all existing cedar shake and to completely replace with wrap insulation a siding , also to replace sophets and gutters and repair holes in roof for a total of $30000 with half down and half upon completion . After a couple of days he asked for 6000 more for insulation. As time progressed there were several days no one showed up and the garbage was not all cleaned up as that was also stated in the contract. Dale never provided receipts or itemized listings of what he spent the 21000 we gave him on. Then he said more problems were determined and we needed a new roof. He gave us the total wrong square footage and wanted to jack the price up $35000 more with nothing in writing. Argued over text messages with my husband and basically walked off the job leaving a lot of trash behind. He was very rude and argumentative when all we were asking was where our money had gone and was going.

Okay first of all I had worker's there daily and I will have them tell that as well. Second, when we started with the tear off I could see that the rafters were rotted and I explained to them what work was going to have to be done to do the job the right way I'm sorry I don't have ex-ray vision and I can't these problems till wwe start tearing off exsisting roofing or siding whatever the case may be that is why I always make it very clear on the contract that if any rotted wood or other damage that needs to be fixed an additional fee will be discussed along with it being part of the contract also I also have $8,000.00 out of my own pocket invested in this job and as far as the $21,000.00 I had 7 guys on that job for almost 3 weeks that had to get paid and material costs and I also did several repairs without charging them as well. they gave me the run around for over a week and threatened me with a law suite when they wanted the work stopped and refused to pay me what they owed me. I have contacted my attorney on this matter and I can't just do the work needed there for nothing that's a very large home and needs lots of work done I was very fair with these guys they were texting me and being very rude to me just about everyday and this went on for over a week they kept saying they were going to get another contractor to do the job so I finally told them to go ahead I have other jobs to do I keep playing this game with you and until I am paid what they owe me I will not do another thing there I'm not the one in the wrong and that's why they are upset and writing this stuff about me but I do have my attorney and he's waiting to see what they do I'm sorry but I was doing everything I could to help them out but I got the feeling they wanted me to do all that at no charge

Upon completion of my roofing job, the left over materials such as shingles that I paid for were removed from my property. When Dale came to collect his payment I asked what happened to these materials. He told me his partner (Uncle) Dan is known for taking them from the customer. He explained that I paid for these and rightfully belong to me. Dale said he would return them. It's been several weeks and several phone calls and no materials returned to my property yet.

Business called and this was relayed: Please be advised that I did not take the leftover materials, a person on my crew took them.  However, any left over material belongs to the consumer.  I have replaced those materials and they have been given to the consumer.

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.  However.... Dale responded that a member of his crew took the left over materials when it was in fact his business partner. The materials are used on other jobs, unless a customer speaks up and is aware this practice is not ethical. Regards, ******* ********
