    JMC Auto Equipment defrauded our company CQ **************** and breached the contract. They took our money and did not provide what they promised.CQ ****************. hired JMC to install an RGI open face paint spray booth for our company to do cabinet finishing and painting at our business in *******, *******. The contract included the spray booth equipment, installation by JMC including obtaining electrical and mechanical permits from the City , duct work, fire suppression equipment, and other items.The contract with JMC was signed 2/2022 and the job was supposed to be completed less than 1 year, but now nearly 2.5 years later and JMC has still not completed the contract. Since JMC delivered the spray booth, we have been unable to use the spray booth because JMC failed to obtain permits in order for the spray booth to be installed and operational. As a consequence, the spray booth remains inoperable and is still in its original packaging at our business location. JMC finally submitted the permit application to the city during October 2023. However, because JMC failed to provide the city with additional documentation, the permit application expired and the permits were not obtained. We cannot operate the spray booth without city permits.We financed $30,000 of the $41,470 contract price through CIT Bank. Even though JMC breached the contract, we are obligated to make monthly finance payments for 60 months. Balance owing is $22,720.We have attempted numerous times to communicate with JMC with no response, no assistance and no resolution. JMC has completely ignored us. The finance company already paid JMC leaving us indebted to the finance company despite the fact that JMC breached. We are left with an inoperable spray booth and a mountain of debt.The JMC employees we dealt with are: *********************, ***********************, *****************************.We no longer want the spray booth or any of the services we contracted for and want a refund plus reimbursement of the finance charges.

    To whom it may concern:

    The customer reached out to us in late 2021 in search of an Open face spray booth.Multiple emails, calls, and zoom calls were made to initiate the sale and service of the equipment. Customer used CIT Finance for $30,000 of an order for a total order amount of $41,470.00 leaving a pending balance of $11,470. The customers order was placed on Feb *********. Customer agreed to payment plan below

    Equipment went into production as and delivered fully to CQ Woodworking on May 2022. JMC requested missing docs from customer on Mar 2, 2022, and were sent over to RGI/PERMIT AGENT to initiate permitting process.
    From that time until the delivery of the equipment to the customer on May 27, 2022, We were in communication with the customer in regards to multiple areas of the installation/permit process including a staircase that had to be removed as a precaution to the permit acceptance process. Between that date and Sep 22, 2023 RGI/PERMIT OFFICES continued to move forward on the permits until rejected a first time. This time frame came under multiple delays due to application delays from the city, and on July of 2023 the City of sunrise relocated their offices to a new address (***************************************************).All these delays and situations were not only told to the customer through multiple phone calls and emails but through the permit company that handed the docs over to CQ Woodworking directly.

    The permit Rejection and the permit application was still incomplete because the city required a copy of the written approval from the property owner or manager for the exterior work proposed by this building permit application. This was the main reason the permits were not approved.  
    On Dec 13, 2023,the customer finally responded with the following email.
    email response from *****, the owner of CQ Woodworking - I had been insisting about the applications to my landlord the last weeks.Nevertheless, he stopped picking up my phone calls and replying my emails. My dad and I got disappointed to this project because there have been many mistakes or delays from all of us. We suspect that the landlord does not want to sign the applications because he probably will sell the building (we saw him with an electrician checking all the warehouses). So, if he sells the building,I dont know if that will delay more the process. However, it doesnt even matter yet since the landlord hasnt signed the applications yet, anyway. We got tired to insist of something that wont work anymore (this industry is going down).  In conclusion, we are starting a process to cancel this project. However, if we decide to continue, I will get in touch with you.  Thank you so much for everything

    In conclusion, the permitting process is long and tedious even when all the parties are in agreement. The owner always has the final determination on the authorization for the work to be approved. We accept and recognize that there have been delays but again the final delay was due to the customer not providing the final requirements. Our only next communication to the  customer was when we were contacted by: LAW OFFICES **************************** * ****** ***. as per their complain even after the owner of JMC called and left VM's, no return call was given. The customer also uploaded multiple unfair reviews to ****** and BBB which we have been able to show in this letter that the information is just not true. We have always had in mind multiple scenarios to resolve but customer never gave the opportunity to discuss as stated below.

    RESOLUTION JMC/RGI: July 18, 2024
    1.            We are willing to move forward on the Install / Permit Process as long as the customer is able to provide any and all permissions & documents that are missing to complete the process. *This offer only applies to the same address/company the permits were originally made to fit.
    2.            RGI/JMC is willing to receive the equipment back (-50%) to resolve the issue. This would not include any shipping costs & is subject to inspection once received back at RGI Spray Booths. Customer would be responsible for logistical coordination and Permit costs are nonrefundable with this offer

    3.            JMC is willing to refund any funds not completed on this project based on total amount received and processed

    -Request from PERMIT COMPANY
    1) The tenant has an illegal staircase leading to a mezzanine level - located on the top of the existing office
    space.
    2) The staircase may generate a request for legalization, violation, or delay to obtaining the permit.
    3) We must show exactly what is on the premises, and would like to bring this to your attention prior to plans
    completion.
    4) Should the client/tenant choose to remove the staircase, it will not be shown on the plans.

    CQ Woodworking removed the staircase in question.

    Engineered drawings are complete. The permitting company has dropped off sealed drawings and documents to ***** at CQ, however the permit application is still incomplete.

    Previous concerns (RGI responsibilities) were addressed on permit rejection. JMC/RGI reminded CQ Woodworking Inc.:
    a letter from the owner of the building, granting installation of the booth and stating that there will be a short exhaust duct penetrating the roof.  The letter also needs to state that he authorizes the tenant to have a the rooftop duct outside of the building, as permitted. This letter needs to be included with the plans for submittal.

    Better Business Bureau:

    I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

    JMC was already paid $30,000 by the finance company.  CQ Woodworking is responsible for paying back the finance company $30,000 plus interest and equipment insurance even though our company did not receive any benefit from the contract with JMC.
     
    JMC first breached the contract by failing to deliver all the items it agreed to ship to us.  Therefore, our company was not obligated to remit the sum of $7,323.00 to JMC.
     
    Furthermore, JMC alleges that we caused delays in the permitting process which then caused delays in the installation of the open-face spray booth and other items. However, this is not true. They failed to submit the permits correctly. According to JMC, the permit process was initiated on March 2, 2022.  JMC took 5 months to request the staircase removal on July 20, 2022. Our company took less than a month to remove the staircase. Consequently, JMC took 4 months after the staircase was removed to submit the permits on December 19, 2022, which they did incorrectly (the permits were incomplete and JMC forgot a very important thing on the permit application which was our landlords authorization).
     
    JMC is claiming that the main reason for permit rejection was the missing approval document of the landlord/property owner, however, our company provided JMC the approval (the electrical and mechanical work authorization) signed by the landlord/property owner in a timely manner.  
     
    JMC did not comply with the time frame that they had agree to, i.e., that the entire project would be completed in less than 1 year.
     
    ********, JMC lost interest in communicating with us during the project permit process thereby making it impossible to advance the project toward completion. During 2022, our company called JMC repeatedly without any solutions or return calls.
     
    Despite the above, CQ Woodworking is willing to resolve the dispute as follows:
     
    1. JMC agrees to take back the delivered items and the parties will agree to split the shipping costs 50%/50%.
    2. JMC agrees to refund the sum of $20,000 to CQ Woodworking.  This is more than fair because our company is still obligated to continue paying the finance company the total amount of $30,000 plus interest and equipment insurance.  In effect, our company will be losing $10,000 (plus half of the shipping costs) without having received any benefit from this transaction.  In addition, JMC would gain the benefit of re-selling the returned equipment and erase any losses from this transaction.
