      On 10/15//24 I received a quote by Tony's Tree Landscaping to trim the tree branches from a tree in front of my house that were too close to my house and to remove a tree and stump along the side of my house. On 10/30/24, Tony's Tree Landscaping cut all of the bottom branches of my tree completely off at the trunk, removing 3 bird houses, a swing mount and leaving another swing on a half cut off branch that looks ridiculous. All that was discussed on that tree was trimming branches that were close to my house. They also cut down the tree on the side of my house but did not remove the stump and have still provided no information on when that would occur as of writing this 11/13/24. I paid $1084 on 10/16/24 and $976 on 10/30/24 for a total of $2060 for work that is neither satisfactory nor complete.I contacted the office on 10/31/24 to discuss, provided a picture to the office manager, Trish, of what my tree now looks like and she said that Tony would call me back to discuss. I waited to hear from him until 11/11/24 when I called the office and left a message. It was not returned I called the dispatch number on 11/12/24 and 11/13/24 which have also not been returned. I want a refund for what they did to my tree.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  We made an appointment for today, 12/2/24 at 11am to process my refund 11 days ago. At 10:28 am, 12/2/24, Tony texted my phone stating that he had to cancel the appointment. I took off from work today to get this resolved and he cancelled 32 minutes ahead of time.  I want a refund and I will not schedule another meeting with this company to get it resolved. He can process my refund without me meeting with him, the same way he charged my credit card 3 separate times.   Regards,  ****** *****

      The owner of Tony's Tree and Landscaping was unable to meet with the customer and offered to meet later that day. Unfortunately, the meeting did not take place. I have attached a photo of the trim work that was completed at the referenced property. Our company has trimmed numerous trees on this street for other customers who were completely satisfied. This style of tree trimming is our standard, and we'd be happy to provide the photos from other properties on that street with similar tree trimming orders.       I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  They offered a refund and have continued to fail to provide one. They can issue me a check and send it to my house.  What difference does it make what other trees in the neighborhood look like? I didn’t pay you to make my tree look like other trees. I paid to have the branches near my house trimmed because they were too close to the house and instead you cut off 2/3 of my tree, acknowledged that in November and then have continued to give excuses why I haven’t been refunded my money.       The sales representative assessed the tree and made recommendations to the customer after hearing the customer's concerns. Below are  the recommendations: A - Elevate the lower canopy to allow sunlight into the base of the tree so the grass will not die off due to lack of sunlight. B - Elevate the lower limbs, allowing moisture and nutrients to go further up the tree. C - In elevating the tree, it takes potential dangers away such as getting poked in the eye, hit in the head, creating injury when mowing the lawn, etc. D - Remove limbs off of and away from the roof, house, gutters, so it will not damage roof, soffit and siding, and/or clog gutter and downspouts. E - Improved airflow - removing low branches can enhance air circulation around the tree, reducing the risk of fungal diseases. F - Prevent damage to low branches from lawnmowers or other equipment G - Structural integrity is maintained due to proper cutting by removing weak or crossing branches. H-  Visual appeal - A well-trimmed tree with a raised crown often looks more balanced. The salesperson advised her of all the above. The customer's daughter was swinging from a swing from a lower branch. The sales rep said they could cut the limb off beyond the swing so she could keep her swing intact. Not only did they verbally discuss all the above, they included it in the contract to remove lower limbs (raised crown) and trim the limbs away from the house and remove any split and hanging limbs that were in the tree at the time of the tree-trimming process. We completed the job as we contracted to do. We cut down one tree at the front left corner of her house, hauled the tree away, and ground the stump and roots out. We then trimmed the tree as specified above and in the contract. However, we are willing to, in good faith, to negotiate an agreed-upon refund on the tree-trimming portion of the job. Thank you for your time.

      My husband asked the head contractor if he was concerned about our driveway&if it would crack with machinery.He said no confidently.The contractor took photos of the driveway, so my husband did as well.The machines did crack our driveway.Half of our driveway is crumbling&is now loose stone.We captured this on our camera.The driver drove over the grass where the worst of the cracks are.We also have video of them inspecting the cracks after.We began calling the office immediately when we realized this happened.My husband left several messages for the office, with no return contact.I called & left multiple messages as well, before we finally heard back, about two weeks later.Tony asked me to email over photos and videos of the driveway, which I did immediately.I called his office everyday and emailed every other day, and did not receive any return communication until I said I would pursue further action if I did not hear back.A receptionist called me and said we “had to come into their office Thursday at 1” the following week.We asked if we could do this over the phone or if there were any alternate times we could meet, and they said no.My husband and I rearranged our schedules, taking time off of work to meet him the following week.On that Thursday at 12:10, the secretary said “Tony was running around” and wouldn’t be back until 2:30.I said we unfortunately could not meet at that time as we had already rearranged meetings and taken specific time off for the meeting, for which we were given no options for, at 1pm. The secretary said she would call Tony and call us back.When she did, she said we could only meet at 2:30, which we again said we could not do.She said she would call me back and never did.Days&several emails and phonecalls later, the secretary called again and said she thought we had heard from Tony, that she had been relaying all of our communication and was asking him to call us back and there was nothing else she could do.I’ve still not heard from Tony.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.   The response from the business does not provide any additional information nor step towards resolution. They included photos of the damage driveway after they ruined it.  Those are not “before” photos.  Additionally, the contract we signed waiving property damage is exclusive to only “reasonable damage” as our attorney advised.  Tony’s left our driveway entirely unusable.  This is not reasonable damage by any means.    The contractor ensured us the morning of the tree removal that the driveway would not be damaged.  We also have VIDEO evidence of the truck driving over our grass, in the exact spot where the driveway is most damaged.  We also have video and photo evidence of them inspecting the damage immediately after causing it.  We are requesting the $10,530 before proceeding with legal action through Erie County.   This can only be resolved with either a repaired driveway  or the $10,530.   Regards,  ***** *****

      On 2/26/2024, we signed a contract with Tony's Trees and Landscaping tp remove 5 large trees from our property, haul away the wood and grind the stumps. The total value of the contract was $12,940. We paid a 50% deposit on 2/26. The initial removal of of the trees began a few days later, at which point, we paid another 45% of the total job. At this point in time, everything was according to the contract. Per the contract, the wood removal would begin 10-15 days after the tree crew work is complete, and at this point, we would pay another 2.5%. In our case, this work did not happen until early May, nearly 8 weeks later. We paid the 2.5% on the day this step was completed. Also, per the contract, the stumps would be ground as soon as 811 was done marking. 811 was done marking in March, and the wood was removed in early May, but it is now 6/11/2024 and the stumps are still in our yard, not ground. This is not in alignment with the contract. My husband has called and left multiple messages, but Tony has not returned them. All we want is for the work to be complete, as it is holding up other work that needs to be done in our yard.

         Tony's Landscaping cut down trees on 07/07/2023. The truck backed onto the property and cracked the concrete driveway and sidewalk. Numerous phone calls were made and appointments and calls were not returned and appointments to view damage were not kept. The down payment of $4613.00 was posted on 07/07/2023. the balance was posted on 07/09/2023. The work was never completed. Tony's crew came on 08/07/2023 to stump. I advised them that nothing was being done until Tony came and viewed the damage and changed the balance due to the cc I wanted it placed on.

      The sales representative going over the scope of the job with Mr. ********* of ** ***** ** ********* ** on June 26, 2023 at 2:44PM he advised the customer the process of tree removal would consist of driving our robotic remote control tree cutter truck down the drive way across the lawn around the right side of the garage into the back yard, that was the only way we could remove these trees safely, due to the rotten spots and stress cracks in the trunks of the trees.  This is why we had to remove half a row of brushes, in order to get truck in yard around the right side of the garage.  On the contract it clearly states, do to where the trees where located and unsafe condition of the trees, that we needed to use the specialized truck and equipment, sales representative made it clear verbally and its in writing,  that we would not be responsible for property damage this is stated in his contract in which Mr. ********* signed.  We have signed authorization for each charge which Mr. ********* agreed to the payment arrangements on his contract. The salesmen spoke to Mr. ********* twice regarding the job. Our staff has returned many of Mr. *********'s phone call, August 1, his call was returned and spoke for 47 minutes.  We also returned a call on  10/10/23 at 9:24am where he stated "damage was done to drive way and sidewalk August 7, 2023, but the work performed on July 7 2023, which clear contradicts customers claim of the damage.  Mr. ********* also requested a refund in mid October when 97.5% of the job was completed three months earlier.  When he disputed his credit card in the amount of  $4152.00, the customers credit company after we provided all the facts figures numbers dates and times, they sided with Tony's Tree and Landscaping.   Another staff member returned his call and also had a 45 minutes conversation.  On July 22, 2023 Mr. ********* called requesting a date to have the stumps ground.  His call was returned advised him when the crew would be there to grind the stumps out.  When we sent a crew out to finish grinding the stumps, Mr. ********* told the crew they were not allowed on the property and he refused to allow us to finish the job.  Mr. ********* in way shape or form did he notify us not to come out and grind the stumps out as agreed upon in our contract.  Then our office received a letter stating " This letter will serve as notice that effective this date we expressly forbid Tony's Landscaping Inc any of their employees, relatives, friends or any other company that does tree removal, tree trimming tree stumping or any type of landscaping, permission to trespass on the property located at ** ***** ******* ********** ** ******  In closing, in Good Faith we are willing to refund the customer $1000.00 paid in full for any and all damages, even though we are not responsible according to his contract verbal and in writing to bring this case to a close.

      I contracted and paid in full, Tony's Tree and Landscaping service on June 20,2022. They came the next day and cut down 5 of the six trees in my back yard. on June 21, 2022. I personally have test Tony on his two cell phone numbers to see when they are going to come back and finish the cutting down of the one tree left, all the stump grinding, and trimming on three trees. I have also called the office seeking some kind of action. I have huge logs left sitting in my front yard on top of the sewer drain. Most of the time I am getting ignored or I hear excuses as to why they are not finishing the work. It's been 5 weeks and my back yard is a mess (with orange spray paint on stumps and tree) and the front yard still has these huge logs laying there. I either would like the job finished or I would like reimbursed so I can find another tree service to complete the job. I am a 70 year old widow living on Social Security as my only income. This is not right.

      appointment made with service waited all day, came and looked at job quoted 1800.00 for weed removal and trim bushes i said to high and started to walk away from a much high quote i reluctingly went for 1800.00 because this very fast taker tony said he would give me discounts he's filling out covered contract asks me to sign leaves quickly when i get in house my copy which hardly readable has all kinds of extra charges on it coming to more than 2400.00 and showing all that i wanted him to do, i also requested a start and finish date he said he would include on contract was not written at all, everything i requested if written at all i would have to re-do to my liking, my copies of contract only show a total of more than 700.00 than quoted. i have never met a bigger cheat in my life, thinking contacting police and DOT also because i will bet all his trucks are in dis-repair then to top it all i look on your site and see all the different complaints about his company also everything i wanted done was not mentioned on the contract. I called ********** and froze the account due to his misrepresentation. also mentioned him to my neighbor and i didn't know she once worked for him and she said he is nothing but a crook with everyone, people like him should not have a business license.

      Hello there BBB, the copies that were given to me by tony's tree service are hardly readable and will not copy because he did not press hard enough i had to read them with the help and only with a magnify glass i have tried to copy these before, now on the back of his contract there is a cancel clause of three days in writing i went to the post office after going to his place or office with a letter of termination certified registered mail on saturday the day after i met with him but then there is saturday closed, sunday closed, holiday closed, he should be getting the cancelation today Tuesday the 31st i can't help this fell on a weekend and a holiday weekend, if i put it in the mail box he would say he never received it and it could not be signed for,  just wanted to let you know please give me a phone number to call you.       Dear *******, The initial price quoted on the estimate was price before sales tax and dumping fees that we can not absorb the cost for because we are charged for it. That is the additional cost accrued that is out of our control. There were many overgrown trees, weeds, and shrubs that you wanted removed that were entangled through your fence along the entire property. Due to the degree of difficulty of the specified work it was a very labor intensive job. Tony was very clear on the cost of the job, dumping and trucking fees (because we have to pay for them), and sales tax cost. You asked on the cost and Tony reiterated it and broke it down thoroughly. So, we just wanted to clarify the approximate $700 difference. We never give an exact start date at the time of estimate. The estimator may have an idea of work scheduled in the area, or may be aware of jobs in the area that he can tag your work order on. We never give an exact date because our line of work is all weather permitting, and there are many different variables that come into play when scheduling a work order. Regarding your concerns to our trucks and equipment our fleet manager is a retired department of transportation employee. Our operational vehicles are all NYS DOT certified and inspected.

      Not sure what you want me to say about the three day cancelation.  he canceled within the timeframe so the contract was Null & void. We received his letter in the mail and canceled the contract. No $ was exchanged so There was no need for anything further. At the time of signing no deposit was made so we didn’t have to return any funds.
