    Rich(owner) collected $300 for fall baseball. 4-6 week later cut my 11 year old child from the program and will not refund monies. What child would want to come back and play fall baseball that just cut them. Head coach of the 11U team even mentioned that Rich will handle it. Attached is the email stating that he would give it black but never did. Small claims court next.

    Attached are the details regarding Mr. ************s refund request. The decision to withdraw was 100% his decision.  The attached document which he electronically signed as well as the invoice (both attached) clearly state our refund policy and reasoning.The service he paid a deposit for was this fall.  It has nothing to do with next summer.The email he is referring to was a statement that I would take care of following up on the issue.  I did follow up and confirmed that Mr. *********** is trying to use next summer to avoid his responsibilities of the expenses incurred because of his deposit for this fall.  Those services are unrelated. Our refund policy is clearly documented and done with good business sense.  His decision to participate has expenses incurred and results in us turning away other paying customers as the total number of participants is fixed. It also has the direct impact on other participating customers as there is a minimum number of participants required for us to meet our obligations to all participating customers.

    Second last paragraph on CODE OF CONDUCT (page 2) electronically signed form: 

    I also understand that should I elect to discontinue my son's participation, that Inferno Baseball Inc has incurred many

    non-refundable costs due to my initial decision to participate and, as a result, I am not entitled to financial restitution due

    to my decision. 

    Last paragraph on the invoice paid:

    By making this payment I acknowledge my commitment to participate in the Elite Travel Baseball program and understand that my
    commitment will result in non-refundable expenses to be incurred by Inferno Baseball and as such my payment is not refundable.
     

    This is not a unique situation.  There is one other customer with the exact same set of circumstances.  He is partaking in the fall opportunity even though he will not be participating next summer.  Those are unrelated opportunities.

     Mr, *********** has already tried filing a complaint with the NYS Department of Consumer Protection, which didn’t get the result he has hoped.  Now he is threatening small claims court.  Unfortunately, he does not understand that we have already incurred more expense than his deposit covered (he never actually fully paid) and is leaving us considering alternatives to retrieve those expenses.
