      Hired them atty ***** ******** refused to take my case. I have asked for it back 3 times. Promised they would refund in 7 to 10 days. Won't even answer my emails.

      On 02/14/23, I paid $325.00 for an hour consultation with Tully Rinckey. I was also asked by John G********** on this date via email to submit documents for the consultation, which I did (10 pages). On 02/17/23, I spoke to Catherine W***** in regards to retaining the firm and paid $2, 500.00 (half of the 5k retainer) to employ them. I have emails in regards to all of this. I did not hear from a lawyer (O*****) until 02/23/23, but I was charged on the date I retained the firm (02/17/23) by R**** for correspondence with him and him reviewing my documents. At this point, I had only submitted the ten pages for the consultation with Heather T***** and he charged me $162.50 for reviewing the ten pages which he said took him 50 min. While employed, I only worked with two lawyers (Gregori O***** and Elizabeth F*****). Both of them worked under Zachary R****. Mr. O***** ended up being let go by the firm and I had to email multiple times to find out this and that I was assigned another attorney (Mrs. F*****). Mr. R**** did not even have the curtesy to email me about Mr. O***** being let go when I emailed him directly for answers. I just heard from my new attorney, Elizabeth F*****, instead. I ended up dropping the complaint after talking with Mrs. F*****, who said this case would drag out and basically wasn't probably financially worth it. On May 4, 2023, I got my first and final bill from Tully Rinkey. I was stunned when I saw that Zachary R**** charged me for discussing case strategy and other things with me that NEVER happened. I was also taken back that he claimed to have reviewed my records to work with me, which he never did (work with me directly). My final bill had $1,365 in charges from Zachary R****. He fabricated correspondence and I believe either fabricated or inflated charges of him reviewing my documents. I only received two emails from him: one was him introducing himself and telling me I would be working with his partner O***** and the other was him telling me he was closing out my case. One was a small paragraph and the other a few sentences shown in 'fraudulent billing' submission). My refund from the firm, that didn't get that far as I let them go early (never filed OSC complaint) was $170, but should have been a lot more than that. I cannot prove Mr. R**** did not review my documents, but I can tell you that he over charged if he did. It has been almost two months since I reported the fraudulent billing and I am getting the run around from the managing partner (Mr. H****) who is supposed to be investigating this. I don't know why it is taking so long. Mr. R**** cannot produce proof of correspondence because it never happened. I am holding the $170 check because I think cashing it will be accepting that is all they owe me. They have nothing but time and money to make me wait. I just want my money back and want Mr. Zachary R****'s billing practices investigated. Thank you!

      To whom it may concern;I categorically disagree with the entirety of the firms
      response, aside from maybe being misinformed on the way their timing is
      expressed in their billing.  Even if
      their billing time was misunderstood, it doesn’t change the fact I NEVER worked
      with ******* ***** or that they fraudulently billed me.  Also, I HIGHLY doubt he reviewed my records
      as much as he claims to have, if at all. 
      Even though the firm claims to use multiple forms of communication, they
      will not be able to produce one document showing a collaborative relationship
      with me and Mr. ***** because I never worked with him.  I can show you collaborative emails from the
      two lawyers I actually worked with (****** and ******).  I challenge Mr. ***** to present any document
      that states “per our conversation” or that is collaborative in nature because I
      never spoke with him on the phone-not even once, and I never corresponded with
      him back and forth through email or fax. 
      I never had any interaction with him, aside from an email introducing
      himself and saying I would be working with Mr. ****** and an email saying he
      was closing out my case in the end.  I
      actually have proof I am telling the truth. 
      I complained to the firm on March 15, 2023, which is well after ALL of
      Mr. ******* fraudulent billing charges (all but one small one-look at the bill),
      stating I “have not
      directly heard from Mr. ***** yet, when I believe I employed your firm on
      February 24th roughly”. 
      Why would I send this email claiming I had not talked to him if he had
      been communicating with me?  I had no
      intentions of any of this at that time.  Even
      after this email, Mr. ***** did not have the common courtesy to respond to me.  He had the new lawyer, ********* ******,
      contact me.    What the firm is basically saying, I guess, is that every
      correspondence with Mr. ***** was via phone, because there is no paper trail
      for this, which is very convenient for them. 
      And, I was never sent an email from the firm without all of the lawyers
      I did work with attached, or multiple people. 
      It would be easy for them to produce an email if there was one.  Any email he would have sent me, would have
      had the lawyers I was actually working with (****** and ******) CC’d on them. I know these are lawyers and people look up to them because
      of their status, but I am a federally employed clinical social worker with a
      masters degree.  I currently work for the
      ********* ******** ********** ****** as a coordinated entry specialist, I am
      over the system that gets Veterans off the street and into housing in New
      Orleans, and I was just vetted for a job in Hawaii with the US Army, which I
      got making $103, 500.00 a year.  I have
      had multiple background checks and am well known for my ethical principles,
      values and work ethic.  I even had a
      security clearance in Hawaii for the Army. 
      Why would I lie about this? 
      Getting the money back that the firm fraudulently took from me is not
      going to make me rich.  I make a good
      living.  This is about the
      principle.  How can you bill someone for
      things that NEVER happened?  I refuse to
      let them get away with it.  It’s wrong,
      criminal and unethical.  It’s professional
      theft.  And, what is worse than dealing
      with a crooked attorney is having a wealthy firm, with nothing but money to
      fight people like me, back him and lie for him. 
      I guarantee you this has happened before.  He billed me for MADE UP stuff so
      effortlessly.  And, Mr. ***** that
      reviewed my complaint, never called me to discuss this nor did he ever reach
      out to me on his own.  He emailed me once
      when I complained and said it was still in review.  I never got a status update.  And, saying they refunded me a significant
      portion of my retainer ($170) when they kept almost a thousand dollars of my
      money for services NEVER rendered is wrong, unethical and disgusting.  ----------------------------------------------------------------------------------------------------------------------Good morning, I just wanted to touch base on where we were in the process
      of getting the paperwork together for the ****** ** ******* ******** as I was
      working with ******* and have
      not directly heard from Mr. ***** yet, when I believe I employed your firm on
      February 24th roughly.  I was going to also suggest that
      if by chance Mr. ***** is too busy, as he did not anticipate directly handling
      my case, that it be reassigned, as this is my career and I need someone that
      has the time to focus on it.  I also wanted to voice concerns about being
      billed twice for the same thing, as Mr. ***** is going to have to go back over
      what Mr. ****** did because he is no longer with the firm, which is not my
      fault.  My job is currently conducting an “investigation of the
      facts” and I believe they are trying to get rid of me in the near future, as an
      announcement was put on *******.gov right after I refused to transfer. 
      The announcement is for a **** social worker, which is what I am, in my
      department when we are fully staffed.  The announcement only ran from
      February 15-March 1, which never happens.  Jobs are typically posted for
      longer durations of time.  Also, my boss notified me last week that
      “coordinated entry specialists”, which is what I am, are being hired for ***** ****** ******* *** ******** which are the three areas I am supposed to be over,
      aside from New Orleans, which **** ** basically has.  Additionally, 
      they are hiring someone in the program to place Veterans in nursing homes,
      which is what I am supposed to do also and the reason this all happened. 
      They don’t want me doing this any longer.  Basically, all of my duties are
      being farmed out and we need to act soon.  I, also, need to talk to
      someone (lawyer) in regards to the financial restitution I am seeking and the
      conditions I am seeking in my suit with the Office of Special Counsel, as I do
      not want to have to sell my house, but I can no longer work under ******* ****** or **** ******, who have participated in favoritism, harassment and
      prohibited personnel practices.  Please get back to me in the near future.

      I was under contract with law firm and was told if my case went to a hearing I need to pay $7,000. I told them there was a phone conference with the judge and who I filed agaist with an EEO complaint. they still wanted to $7,000 even thoughno hearing. I didn't haven't because it wasn't a hearing and they dropped me as a client stating I should have been ready to pay at least another $60,000 for an EEO complaint.

      The agreement was up until a hearing. Tully Rinckey never told me about possible settlements or the option to even ask for a settlement. They just keep taking money. A lot of the charges that I was paying are repeat documents to make it look like they were doing things. When in actually for months they did nothing. The changed my representation multiple times each costs me more money that I had saved to pay for the hearing. They stopped representation before even finishing what was agreed on. My case wasn't going to hearing and they wanted me to pay money as if it was. They completely misrepresented themselves.  Then I was told I should be ready to pay upward of $60,000 as laughing at me when I was upset crying. They delayed this case in hopes of getting more money to take it to a hearing.

      I was never told that all the money I sent multiple different time was a down payment. They kept adding charges randomly. Never called me, never called the VA to try to settle. They are a fraudulent company that took my money and hide from me. They kept changing lawyers through out the whole process many had no clue what was going on. I tired to get information by calling but since the changed the lawyers so many times I never got a response. In the bills they sent there wss repeat billing for the same things. Every time I asked to know what was going on I was billed. Extremely unprofessional and shady. They stole my money and did nothing. They were not up front and are just money hungry.  Take from a sick person who needed help.

      Expensive and awful experience with assigned attorney/biller/firm regarding a motion for attorneys fees to the MSPB. Paid over $6,200. No one contacted me after paying 5k retainer and the attorney billed me $60 for me calling the firm more than a week later to ensure my motion was in progress and would me submitted by the deadline. She also billed me an additional $60 for her calling me to ask for my MSPB log in credentials to submit said motion. She also had no idea I sent an email from opposing counsel stating he would not dispute reasonable attorneys fees to the firm’s documents box as instructed during my consultation. When I called to discuss termination, the biller essentially called me a liar and chuckled when I said my attorney called me for my log in credentials to submit the motion. Learned that I was going to be billed an unknown amount in excess of my 5k retainer only by reading the motion submitted to the MSPB.

      As shown in the attached photo, my attorney submitted the motion for attorneys fees on 3/31/23, and on 4/21/23 the firm emailed me a billing statement for the amount of 1,202.50 that was billed in excess of my 5,000.00 retainer fee. There was no communication to me about this until this bill was received. There was no forewarning that my retainer has been exhausted and clearly a significant amount of additional work needed to be done to complete the motion as the additional surprise bill is more than 20% of the retainer itself. 1,202.50 is not pocket change. I am even more saddened by the firm’s CEO’s response as a simple glance at my file proves his response to my complaint to be factually inaccurate.

      I'm being charged over the amount I was told and I have email proof of payments made and my final payment. I sent that information over and was ignored then sent a bill by mail as well as a second with added interest. My emails clearly state the amount and dates and up to date payments received. Why am I being bullied into paying more plus interest when I clearly have proof of my payments made?

      I was wrongfully terminated my case went to Federal Arbitration. The Arbitrator ruled the case in my favor and awarded me to be paid my lost wages and benefits as if I was never terminated. I retained counsel as I was only offered less than half of the money owed. This law firm has been caught double charging me more than once. The original attorney in this firm handling my cased passed away. Every attorney since the original attorney has no true knowledge in the field of law to handle this case. I was to be credited back all charges from the first attorney and was only given a partial credit. Then this firm charged me more than double the amount of money the original attorney charged to draft the same demand letter. My case now went to Federal court to get a ruling to enforce the Arbitrator’s award. This Firm files a petition against the ******** Trade Association and ***** America leaving out the Union when my case all along has been against all three parties the entire time. The judge dismissed the petition because the Union was not a listed party in the petition. This firm has taken over $12,000 for this case and this kind of mistake in no way is acceptable. I have told this firm numerous time to refile the petition correctly against all the parties. Then the firm tells me to go to the ****. If this was the case why did this firm take $12,0000 from me to pursue the case? I want the Petition filed correctly including the Union for failure to represent my award. This firm has a history of bleeding out their clients for poor representation. The unethical behavior of double charging and over charging and changing attorney rates and then correcting what they want when caught is more than enough to make this report. This firm loves to respectfully disagree but these actions are all documented. I want the representation I paid $12,000 for or a refund and I will find a different competent law firm that is ethical and truly cares about their clients.

This firm only gave me a partial credit for the demand letter that was “misplaced” when the attorney passed away. Then the case was to be handled by Stephanie R********* as outlined in the email received from this firm. Again the case was then given to another attorney that was not outlined in the email nor was it the attorney I paid for to retain. I have numerous emails and bills to show. Then this firm charged me almost double the price of the attorney that passed away to complete the demand letter I already paid for. I can and will supply anything needed to show and prove the truth. I have paid $5000 to wait while they reap the benefits? This is unjust and out right criminal behavior! The basically took my money and run. I was stupid to think that this subpar “law firm” would have any positive results in my EEO case! I would not recommend this company to anyone that is living! I will terminate my agreement with this company and will have to take other more aggressive legal actions to get my money back!

      I retained law firm to represent me in a very time sensitive matter involving my current employer. I consulted with one of their attorneys on Sep 2, 2022 regarding a time sensitive matter with employer. I was charged $150 for one hour consult.

      After reviewing matter, was informed they would be interested in pursing case on my behalf. First thing they would do is immediately submit a demand letter. They required another $2500 as a retainer.

      I paid the $2500 and signed agreement on Sep 7th.

      I was told it was going to be done immediately. By Friday, Sept 9th, I still have not heard anything back.

      I told them if they did not at least send an announcement letter to my employer, I doubted I would be employed much longer. I was told not to worry, if I was terminated before the demand letter was completed, they would ask for damages.

      I was terminated, later that day.

      In my case, it took 3 days to get the firm to take 15 min to draft an introductory letter to my employer to announce your representation.

      In fact, after being prompted multiple times, the firm did nothing until after my employer terminated me - now greatly complicating the matter.

      Even after this, they have now required an additional $25,000 retainer to clean up the mess they have, at least partially, been responsible for. (an outrageous sum I would have never agreed to if they have told me this, upfront!)

      As a result, I demand my full retainer paid ($2500) to be refunded immediately.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 

      Gentlemen, The response from Tully Rinckey PLLC did not address or resolve anything.  I have yet to receive the full refund requested of $2,500. I recently received a belated response from your firm informing me of "I see from the check that our finance department prepared that your refund is for $765.85. That is for the unused portion of the fee advance you paid when you signed your retainer agreement with the firm."  However, even that was sent to the wrong address? To date, I have yet to even receive a billing statement of services, so I have no idea how the other $1700+ was used. In regards to attorney-client privilege, since the client, and not the attorney, holds the privilege, the client holds the ultimate authority to assert it or waive it.I explicitly waive it in the context of the firm's ability to fully respond to this compliant. Additionally, I am asserting what appears to be deceptive trade practices where Tullly Rinckey PLLC initially requests and obtains a $2500 retainer - yet really doesn't perform any meaningful legal services for it.  Before any "real work" is preformed by the firm, they are going to actually require $27,500, paid up-front, to begin.  ($2,500 + $25,000). I dare say that had this been openly divulged at the time of the initial consultation, I (nor many others) would have chosen your firm. As it is now, it appears your business practices are really geared toward obtaining the additional $25,000, rather than perform any meaningful legal service to that point. In my case, I could not even get Tully Rinckey PLLC to initiate a simple "letter of introduction" to the other party, until it was too late to resolve anything outside of requiring formal legal action in court. In regards to the "demand letter" that was finally prepared and delivered on Sept 16, as this was very time sensitive, in response to my inquiries on demand letter status, I was promised the following: * "to be completed immediately" (Sept 2nd); * "promptly" (Sept 7th); * "They will be reaching out shortly" (Sept 9th); ---(at this point, I just requested a letter of introduction be sent to the other party.... which did not happen until it was too late) ---* "I will send you a more detailed email later today, however, if you are terminated prior to the demand letter being submitted, we can add that to the letter in regards to any damages we are seeking." (Sept 9th);* "I would give them until mid-week [Sept 14th] to respond to my email." (Sept 12th) And then, on Sept 29th, when it appeared formal legal action was going to be unavoidable... (sigh), I was told for the 1st time -* "Our typical fee for a case such as this is a $25,000 evergreen retainer."  ??? Really?  Why am I now just being informed of this "typical fee"?  Because had it been divulged up front, I would have never obtained their services in the first place. I earnestly believe this falls in the category of deceptive trade practices and they should know better. ----- Sincerely, **** ** *****

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. Their response implies that I was fully refunded my money and all is good. I was refunded my money as a result of me submitting a complaint to the FTC, which in-turn recommended I should follow up with my credit card company. I did follow up and and submitted the necessary documents to my bank.  After they investigated they reversed the charges. 
      However, I am still getting harassed via email and phone claiming I owe them $1700+ and need to settle.  I was just called and harassed 15 mins ago.

      • Contacted law firm on 6/19/2022 and paid 150.00 for 1 hr consultation.

      • 6/20/2022 attorney contacted me and talked with attorney for 30 minutes. Gave a copy of employment investigation to attorney.

      • Signed contact with law firm in July.

      • My case was thrown out in the Administration courts because of no response and never heard back from law firm.

      • Jul 11 2022, 4500.00 was given to law firm to handle case and nothing has been done and no contact.

      • Did receive 2 emails from attorney to give a call.

      • Called a 2 weeks ago to have attorney call me back and no call back. The law firm was begging for $4000.00 more, I told them they sounded like a charity case not a law firm. Also, they stated the attorney is going on vacation for 2 weeks.

      • 2 weeks came and gone no call back from attorney and no record of any work that the attorney did on my case.

      I contacted Tully Rinckey around the beginning of the year about me having evidence I was illegally ruled out in a promotion with the state of new york. I outlined my information and was told We could draft a letter of demands to send to see what the states response was. I would receive bills each month that was mostly just me paying for one lawyer to talk to another lawyer in the same firm. After 6 or so months my retainer money was gone and I got an email saying they were not going to do anything.

      I did not retain Tully Rinkey to research an issue I had obviously done a fair amount of research myself on. I had Filed a grievance but it was in no way settled and had provided multiple documents proving that I did not accept the states answer to make me whole as was demanded in the grievance. I have attached the contract I had with the Law firm which clearly states on page one I was retaining them to draft a letter of demands. As the business did not draft a letter of demand or answer any of the questions that I had asked I feel they are using dishonorable language in their assertion that they had done what was contratcted.
