    I signed a contract with **** at Probate Advance. They would give me $5000 and then they would get an assignment of $10000.00 out of my inheritance. ****** ***** filed for the assignment and I did not get paid! They are trying to take the money.

    The company did not honor their agreement. Instead the representative sent a message to me the following day saying "I know you do not like us very much but do you still want this money." I find it very distasteful that a company who is supposedly trying to help someone during a difficult time in their life with the passing of a father would taunt someone. I future would like the company to uphold their end of the deal as I stated to the **********. If the company representative wants to behave like a child then he in return needs to at least accept the consequence of playing in the adult section of life.

    Probate Advance stands by its prior response.  Probate Advance has not been in contact with *** ******* since before his initial complaint.  We strive to provide needed funds to probate heirs waiting on the resolution of their probate estate, but unfortunately we cannot provide funding for every request.  In this case, while Probate Advance anticipated being able to provide an inheritance advance to *** *******, it ultimately determined it could not do so and rescinded its assignment agreement with *** ******************* Probate Advance is unable to provide *** ******* his requested relief, we consider this matter closed.

    Probate advance gave me a advance offer of ******. They sent me paperwork to sign and credit card. But they only advanced me ****** of the ****** agreed on. Then they stated they needed to make sure I was 50% heir to the estate in which I sent them prior court proceedings proving I was. Now I can't get anyone to answer my phone calls..emails or texts?? And they still have my ****** dollars which I am responsible for paying back. And I'm on a timeframe to pay it all back or I have to pay more. This is not fair and I need help to resolve this matter asap so I can handle the issues in front of me! Thank u

    Probate Advance appreciates the opportunity to respond to *** ****** complaint. *** ***** complains that he was promised an inheritance advance of $40,000 but that he has only received $20,000 of that amount, and that he is responsible for repaying his funding based on the $40,000 amount. ******** is mistaken as to how his assignment amount will be calculated and the terms of his inheritance advance.

    *** ***** is correct that the total maximum of his advance under his assignment agreement is $40,000, but that is only a maximum. Under the terms of his agreement, he would be advanced $20,000, and Probate Advance would provide him with an additional $20,000 if the following conditions were met: (1) there is a determination of heirship confirming *** ***** as a 50%heir of the estate, and (2) Probate Advance has confirmed that there are sufficient estate assets to fully satisfy all of Probate Advances assignment agreements with ********************************* has been determined to be a 50% heir of the estate, the second condition has not been met as the real property associated with and constituting a majority of the estates assets is currently occupied by *** ****** uncle, which he was aware of at the time of executing his assignment agreement, but neglected to disclose.  Given that the occupant has rights to a life estate and might reside in the property for years until it is sold, it is not possible to determine the likelihood that there will be sufficient assets to satisfy Probate Advances assignment. Once Probate Advance determines that sufficient assets are available to ensure its assignment will be honored, the remainder of the inheritance advance will be disbursed.

    If the conditions are not met, *** ****** assigned amount will reflect a prorated amount based on the amount of the inheritance advance provided under his assignment agreement. *** ***** may also seek a cancellation of his assignment agreement at any time within the next 2 weeks (until 4/23/2025), if he is willing to return the $20,000 he has been disbursed by contacting **** ********* at ***********************************************************.

     The main reason I filed a complaint is that Probate Advance informed me just like in their rebuttal, they stated as soon as they establish my 50% heirship..they would honor our agreement  and send me the other 20k promptly. I understand that you guys want your compensation  and that's fine. But that's the deal we signed therefor u just admitted you have established that im 50% heir so I need you to promptly forward my compensation. If not..there are grouds for breach of contract here and our contract is in black and white. Thank u for your service. Just honor our contract and collect the 40k profit that u made off my inheritance. Just sad because future customers might realize the predatory actions and non- promptness that Probate Adance has demonstrated in my interaction with them! If u didn't think the property wasn't  worth that amount, then why did we make a deal? Why didn't u do your due diligence and investigate the matter. Like as me and **** from Probate Advance,discussed I wasn't aware of step-uncle was still residing there. And the reason **** said that they can't honor my contract was because if the uncle was still alive and living in the home, he doesn't know if home would be worth the  the same amount or more on the contract?? SO ANSWER ME 2 THINGS..IF IT WASNT A PROPER INVESTMENT IN YOUR TERMS LIKE U ALREADY STATED..THEN WHY HAVE YOU ALREADY PLACED A LEIN ON PROPERTY THE FIRST DAY I SIGNED THE CONTRACT?? KINDA FUNNY DONT IT SEEM?     As stated in Probate Advances prior responses, under the terms of his agreement, *** ***** would be advanced $20,000, and Probate Advance would provide him with an additional $20,000 if the following conditions were met: (1) there is a determination of heirship confirming ******** as a 50% heir of the estate, and (2) Probate Advance has confirmed that there are sufficient estate assets to fully satisfy all of Probate Advances assignment agreements with *** *************** apologize for our prior mistake, but after further review of the probate matter docket, we have learned that the first condition has not been met. While a motion has been filed, no determination has been made as to heirship. If such an order has been entered, *** ***** should share that immediately.

    Thus, for the above reason, and the reasons previously stated, neither condition has been met, and Probate Advance will not disburse the remainder of the inheritance advance until those conditions have been met.

    Both of my parents died in the last 5 years and these ghouls won't stop sending me letters about getting money through their garbage company "NOW" while I wait for my inheritance. First off, my parents left this world without anything to inherit and, second, this company is obviously a scam. My Dad has been dead for 5 years now and my Mom for 3. I would like to not get these annoying scam letters for the rest of my life.(P.S. My four siblings also get these letters.)

    I receive constant mailings from this company. The most recent mailing imitated the look and feel of official tax paperwork. This isnt a coincidence, given the time of year Im sure. That was the last straw for me. Im tired of their predatory marketing strategy. I have received dozens of mailings. I shouldnt need to call to unsubscribe. Maybe just dont harass people? I finally unsubscribed officially and I better not receive any more mailings. They also harass my family at other addresses.

    They did not acknowledge the PREDATORY MARKETING of masquerading their materials as legal/tax documents, per the original attachment that I sent. The sole reason I reached out was because that individual piece of mail looked so urgent I put it aside and paid special attention to it. Then when opening it, I was furious because I had been receiving WEEKLY mailings from them and they continued to disguise them in unique PREDATORY ways to avoid getting them thrown out in the trash where they belong. They did remove me from their list and I haven't received more mailings, but I am not satisfied unless they cease using this inappropriate and unethical marketing style.

    I have been constantly been getting solicited by this company as a Heir for an estate. I am not an Heir. I am the Admin and creditor. Also My mother now gets the mail.. To my mailing address. She doesn't live there. I have called 4 times. Last phone call no one picked up. Other 3 they said they would stop the mail. This is the 5th letter. I have received 3 to me and 2 to my mother. I'm guessing they are sending this to the other heir in a different State. I never gave them my info and they just take it from Court records and ****** me. I would like this to stop and some compensation for this. Now they have my info. I never gave that to them and it will probably get sold or stolen along with my mother's. They are not very helpful and all they want to do is make money off your loved ones loose. This is upsetting to me. The person whom the Estate was was close to me and this just makes the whole difficult situation worse. I would like this to stop. Instead of telling to me and saying no more letters they send more a week later! How would you like to be reminded and pestered about someone you cared about bringing it up all the time and I have to deal with the whole estate and should be lest alone by ambulance chasers. Its very upsetting . Sorry for my frustration, but this is not right.

We do regret the inconvenience in paperwork accidentally being sent to *** *****************    Prior to receiving this complaint, Probate Advance received an email sent by *** *** on October 25, 2024, where he requested that he be removed from any and all contact. At that time, consistent with our practice of promptly removing any consumer from our mailing lists upon request, ***** *** was removed from any future mailing distribution lists. Unfortunately, in error, *** **** information was not completely removed from our distribution lists and further correspondence was sent in error.     I find their solicitation for advancing money on my mother's estate offensive. I contacted the company and emailed the owner personally, asking him not to send me mail to my address anymore. I received letters from this company again this week. I am extremely upset. I would think that when the owner of a company is contacted, he would do something about it. I am absolutely beside myself.     Probate Advance has contacted me by mail twice after acknowledging my unsubscribe email. I find their business offering very disturbing and hoped that my unsubscribe emails would suffice in discontinuing their outreach.I will note below the code included on the letters they send me for identifying my unsubscribe requests, which I included in both emails I sent them.I have made no contact with this business aside from requesting an unsubscribe.

    My father's home was in probate and I (his daughter) needed money to clean the place up. Contacted Probate Advance for an advance from the home. I got 3 advances. At first I was going to sell the home but have since decided to keep it. I informed Probate Advance of my decision. Myself, my *********** Attorney and my *********** Agent have all been trying to reach my Agent at Probate Advance (***********************) since May 07, 2024. We keep leaving voice mails with no return calls. Then call customer service and they say they'll take a message and will have the appropriate people give us a call back. No one ever calls back to solve the payoff issue. We are afraid that they are ignoring our calls so that they can keep adding on charges and then eventually take my home. I feel they are predators and they prey on the elderly, which I am elderly. I am also contacting ********************* and reporting them. They did not inform me that I would have to pay the amount I borrowed, plus there fee which keeps increasing. This is all affecting mine and my husband's health which we are both disabled in one way or another.

         Probate Advances services are beneficial to those customers that prefer to receive a portion of their inheritance now rather than wait for the lengthy legal proceedings to conclude.The fundings are provided to customers via an assignment of a portion of their probate estate interest to Probate Advance; this product is a sale/assignment and not an advance. 

         On October 27, 2023, the complainant reached out to Probate Advance, as the sole heir of her fathers estate, to request an inheritance funding. The complainant executed three assignment agreements on October 31, 2023; November 22, 2023; and January 11, 2024, for a total purchase amount of $70,000 in exchange for assigning $176,000.00 of her interest in the probate estate. These assignments were provided on the basis that the probate estate consisted principally of the residence referred to by ****************. Accordingly, **************** promised under those assignment agreements that the property would be sold so that Probate Advance would be paid its interest in the probate estate.

         On May 7th, **************** contacted Probate Advance to state her desire to stay in the residence. Probate Advance stated that if that was the case, it was willing to accept a buy-out of the assignment.While we waited for her response, Probate Advance tried to reach **************** on May 9th, 24th and 31st, June 7th and 25th without success. On June 21, 2024, Probate learned from the personal representative of the estates counsel that **************** has decided to sell the home.

         **************** states that she has not received any response from customer service at ********************** since May 07, 2024. It is untrue that **************** has attempted to contact Probate since then and, in fact, Probate Advance has been awaiting a response on whether **************** would buy out the funding or sell the home as provided in her agreements with Probate Advance.

         Probate Advance is not requiring that **************** sell the home she is free to buy out the funding. However, if **************** is unwilling to comply with her obligations under her assignment agreements, Probate Advance will take such action as is necessary to protect its interest in the probate estate, for which **************** received $70,000 in return.

    I find it completely despicable that these companies prey on grieving survivors. I have been contacted four times to remind me that my daughter passed away. Three times after I followed their directions and also called them. (This excludes the 3 letters mailed to my wife that I did not document.). This probate was completed months ago and all proceeds were distributed. This is purely harassment. I do not doubt these letters have gone out to all four other people named in the will. The Probate records should not be public for this type of use of advertising.

         ********************** complains about receiving marketing materials from Probate Advance. Probate Advance markets its services to potential consumers, in this case potential probate beneficiaries, based on publicly available records.  We regret any inconvenience to **********************, but Probate Advances services are beneficial to those customers that prefer to receive a portion of their inheritance now rather than wait for the lengthy legal proceedings to conclude.  Probate Advances services are not predatory in nature and its customers are never under any duress to do business with Probate Advance.  Consumers must apply for inheritance funding and nothing supports the idea that they are doing so under duress. 
         Prior to the receipt of this complaint, Probate Advance received a phone call from ********************** on May 31, 2024, as well as an email with an unsubscribe code requesting he be unsubscribed from the mailing list on June 3, 2024. Consistent with our practice of promptly removing any consumer from our mailing lists upon request, we have removed them from any future mailing distribution lists.  We regret that any correspondence received by ********************** after their requests were already in process at the time and could not be intercepted.  We have also removed the other beneficiaries of this estate from our marketing list, including ************************ spouse.

    I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

    As you can see I  / we received multiple letters from Probate Advanced after requesting to stop! I understand marketing but, one letter is sufficient. The multiple letters mailed out to the same address at approximately 2 week intervals, is harassment. No further response is necessary. The letter s have finally stopped.
