I bought a new home on July 5, 2024 and contracted with BMR Contracting (***** *****) because he was available and could start right away. I hired them to remove a tub/shower and replace with a standup shower and replace the floor under the shower due to rot and fix the drain plumbing in the basement from the sink, shower and toilet. Also I wanted manufactured flooring so Roger showed me samples of flooring and I chose one, but they installed something totally different; the cheapest flooring available, 1/4 inch vinyl plank flooring and didn't even install the color I picked. The flooring is warping and buckling.
I also contracted for a galvanized chain link fence, replace a small beam above my fireplace, a little drywall finishing repairs and a couple minor things.
I felt rushed and taken advantage of plus would not get invoices for some of this because they "needed to get stuff" on the day they would ask me. I have asked several times to get receipts and still haven't received them months later. I ended up giving BMR Contracting over $100,00 for a job that should not have been over $25-$30K Max. This price was given to me by several contractors. Also a friend who is a contractor about had a heart attack and got really mad to see someone take advantage of me like that!
I feel a fair resolution would be to get back half ($50,000) of the $100,000 dollars that I paid to BMR and I will never deal with them again.

    Business Response

Dear Better Business Bureau, We are reaching out in response to ********* *****'s review. We value the chance to clarify our interactions and address her concerns. Notably, we have worked with this client before. In May 2020, she contacted us for plumbing repairs and expressed her complete satisfaction with our services. In June 2024, ********* reached out again for urgent repairs needed due to her recent home purchase, indicating a pressing timeline. Aware of her situation, we prioritized her project and commenced work without delay. During our visit, we tackled her worries regarding rotted drains in the basement, shower, and toilet. We disclosed the project's cost beforehand, and the client provided a deposit as per our company policy.  The fence installation cost a substantial amount, with payments made by check and the client marking "fence, flooring, etc" in the memo line.  Upon completion, ********* ***** signed off on the work, confirming her satisfaction. Around 7-8 months later, we received a negative review from her, alleging "shotty work." Importantly, prior to this review, we had no communication from the client regarding these alleged issues. She also referenced a contractor friend, raising questions about why this person wasn’t involved initially. The client criticized the shower as being "cheap." However, this was a special order item unavailable locally, and she had expressed satisfaction with its appearance during installation. Ms. ***** did not want a new vanity put in as suggested, she wanted the existing, in which, we removed and put back in. She also brought up buckling flooring, in which, we did not pick out the flooring, the client did before installation.  We showed samples, and Ms. ***** picked out the one she wanted. As per her subfloor, any issues with the sub flooring, we advised of any issues with the sub flooring. We advised we could not do certain things with the sub flooring without replacing the sub flooring, but she advised not too. Ms. *****, in her review, was stating that we were asking for more money as we went along. Here at BMR Contracting, we are not financing peoples projects. She was well aware of the costs and as we went along portions of the project had to be paid. When working on older houses, extra costs arise and at no time did we force or pressure the client to pay. We were always under the thoughts of getting her into the new home on time before closing. After seeing the review on ******, our General Manager, Patrick, immediately reached out to Ms. ***** to express our concern. Initially, she requested no further contact, but later called Patrick back. He offered to redo the flooring and shower at no charge to show our dedication to customer satisfaction, but she declined, stating, "I do not want anyone from BMR to come to my house!" Patrick emphasized the need to evaluate the claimed issues to provide suitable solutions, but the client remained uncooperative, insisting on a substantial refund. Patrick explained that a refund could not be processed without evidence of the alleged "shotty work." After several days, the client consented to let an employee take photographs of the concerns. We’ve arranged an appointment for next week to collect these images, aiming to find a mutually satisfactory resolution. We are dedicated to resolving this issue professionally and fairly. Our reputation is important to us, and we continually strive for customer satisfaction. We look forward to working with Ms. ***** to address her concerns and achieve a constructive outcome. Sincerely, BMR Contracting

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  I believe that asking for $50,000 of the $100,000 paid to BMR is fair and would settle the dispute.  I don't feel I am being unreasonable as the work and materials used have been shown to me by a reputable construction expert.

    Regards,

In Response to Ms. ********* *****’s Complaint: **Images Labeled archive (6).zip - Provided by Ms. *****
to the BBB**  1. Image 00000 displays Check #**** for $38,800, issued
by Ms. ***** to BMR Contracting, marking it as her final payment. The memo
confirms that Ms. ***** is aware of the transaction's purpose, affirming it as
her final payment.  2. Image 000001 shows Ms. ***** issuing a check to BMR
for $22,300, with the memo indicating "********* *****"—providing
further proof that she understood the purpose of the payment.  3. Image 000002 shows Ms. ***** issuing check #**** in
July 2024 for a fence deposit, as indicated in the memo, once again
demonstrating her understanding of the payment's purpose.  4. Image 000003, provided by Ms. *****, shows a payment
via Check #**** dated 06/27/24 for $16,500, with the memo stating
"Bathroom Plumbing payment," indicating her awareness of this
expense.  5. Image 000004 shows the carbon copy of the bathroom
plumbing invoice with Ms. *****’s signature on the receipt, confirming her
awareness of the payment and her satisfaction with the ongoing service.  6. Image 000005 features Check #**** written by the
client on 06/29/24, with a memo mentioning "flooring and walls."  7. Image 000006 presents an invoice along with a written
description of the work performed by BMR for Check #****, with Ms. *****'s
signature indicating her satisfaction with the work and payment.  **Images Provided by Ms. ***** to the BBB**  1. In Image BMR 3.jpg, it is evident that the purported
"professional" contractor, "****," lifted the trim after
its installation and stripped away its protective coating. Despite being
offered a solution, the customer repeatedly refused, insisting, "I do not
want anyone from BMR Contracting there; I want $50,000." When asked
regarding the refund and her ****** Review, she asserted that she would
continue posting reviews until BMR issued her a refund.  2. The issues with the walls mentioned by the customer
stemmed from a refusal to allow us to repair them, which led her to wallpaper
over the paint we had applied in a different color.  3. The flooring,  as the customer requested, was her own choice.
While the laborers laid it down, the customer expressed how pleased she was and
stated it looked beautiful. Similarly, when we offered to fix matters, she
declined. The flooring was necessary due to the poor condition of the client's
subfloor, which she did not want to replace.  Ultimately, Ms. ***** was provided an offer by Patrick,
    the General Manager of BMR Contracting, to address the issues at no charge;
however, she is primarily seeking a financial refund. Her request for half back
is not substantiated by the provided photos, receipts, and etc. We have
attempted to resolve these issues, to no avail, as Ms. ***** refuses to have
the owner of BMR Contracting at her home or communicate with him. Therefore,
BMR Contracting will not be issuing any refunds, as we have demonstrated the
quality and completeness of the work done for Ms. *****. We are making a final
request for Ms. ***** to allow us the opportunity to rectify the stated issues.
Mr. Bannister also acknowledges his error, and Milton clarified that the shower
was not made of plastic. BMR aims to reach a resolution to conclude this
dispute positively. Thank you. Note that Ms. ***** was fully aware of all aspects of the
job as she clearly labeled documents from BMR and was fully aware of all costs
of the job. As stated this job was done in August of 2024 and no contact nor
complaints until almost 8 months later. She also called the owner a criminal,
which is false allegations and wrong. The owner has had several background
checks with all sorts of Banks and Clients that perform checks on the owner and
company and has always passed with flying colors. Roger *. D****, **-Owner BMR Contracting

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.

BMR Contracting has never offered to fix the problems nor would I allow them to fix them.  They have done inferior quality work and use inferior materials and then charge exhorbitant prices for labor.  I would just like a reasonable refund from them.
