      I rented an apartment from the ******* **** Apartments in March 2019. I had a one year lease. I went to the office in Feb 2020 and spoke to TJ. I told him I was looking at houses and needed to go MTM. I asked him what that would involve. He told me my rent would increase, that was it. I gave them a 30 day notice of my move out date. I was current in my rent. I moved out of the apartment on June 30, 2020. My security deposit was $500.00. In August 2020 I received an invoice stating I owed the ******* **** $187.76. After reviewing the invoice, there were two charges I did not understand. The $29.88 had no explanation and the $709.21 said it was based off 60 month prorated charge for 43 months.(see attached invoice) I wanted an explanation of these charges. I emailed them Aug 10,2020 to ask for an explanation. I got no response. I emailed them again Sept 3, 2020. They never gave me an explanation. I went to attorney Randy B********** for help to get my money back or an explanation about the charges. He informed me that in ******** *** if a landlord doesn't return your security deposit within a certain amount of time, I would be entitled to double my money. His office sent 2 letters to the ******* **** Apartments and got no response. I need your help in getting my money back from the ******* ****. I want double my security deposit, $500 x 2 = $1000.00 and my attorney fees of $200.00. One side note my lease was under my married name **** *******, I am now divorced and my name is **** ******. I have attached all the paperwork. I did not attach my lease because it's 45 pages. My attorney did read it over and there was no information about any prorated charges. If you need a copy I will send it to you.

      We are sorry to see this BBB complaint come through. It is never our intention to miss communication with our residents. Unfortunately, your communication with our team came at a time when we were making management changes on site and we're quite certain this is how we dropped the ball. 

      We have modified your Final Account Statement and you will be receiving a refund of $521.45. We will mail the check to the address that is included with your complaint. You should be receiving it within the next week.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, reasons for rejection are included below.  Legally, I am entitled to double my security deposit and my legal fees.  I have been dealing with this for 2 years.  The ******* **** has breached the obligations under the Uniform Residential Landlord Tenant Act, K.R.S 383.580.  So, please send me what I am legally owed, my $500 security deposit, damages of $500 and my attorney fees of $200- totaling $1200.  You had two years to make this right and you failed.
