Job: driveway replacement

Narrative:
During the concrete driveway installation a crew member walked on the wet concrete and left shoe prints in the newly installed concrete driveway. Without informing me, the contractor foreman attempted to repair the areas (see included photos). Only later after I questioned the areas that were discolored and of a different texture than the rest of the driveway did the foreman admit to what happened. He informed me that the repairs would dry and blend in with the rest of the new driveway. I called the office about this and the gentleman I spoke to (****) said those areas wouldn’t likely blend together. More than a week later the same foreman that did the installation job came back to seal the driveway. I brought up what the office told me and he said he would use a white colored sealant to help cover and blend the repair areas but would need to get some and come back. The next day when he came back I was informed the white colored sealant was not available and after applying the clear sealant now, they would come back in the late spring to seal it with the white colored sealant at no additional cost. When I asked to get this in writing it was agreed but I never received this documentation. I have since called the main office multiple times, left detailed messages about the situation and to call me back to get this resolved and in writing. The business has ignored my calls and messages and instead invoiced me without this agreed stipulation. My desired resolution is to get in writing the plan to seal the driveway in the spring of 2025 with the white colored sealant to address the discolored repair areas and reduce the final invoice by 10% till the spring repairs are completed and to my satisfaction.Business Response

AmeriCoat has contacted this customer and had an operations manager speak with them regarding repairs. An email has been sent to the customer stating the plans for repair in spring of 2025. We also accepted the final invoice less 10% per the customers request until repairs are complete and they are satisfied.Customer Answer

On 8/24/2023 we signed a contract with Americoat to remove and replace our asphalt driveway. The cost of the project is $9034 and we paid a deposit by check on 8/25/2023 in the amount of $3011.
The paving crew removed the old driveway on 11/6/2023 and applied the new asphalt paving on 11/7/2023. When the crew completed the job they left without letting us know that the job was done and there was no opportunity for neither my wife nor I to inspect the job.
After the crew left I noticed the first major defect;
Issue #1: There is a walkway from the front porch to the driveway. The walkway was flush with the old driveway and provided a smooth continouous transition. The new driveway was paved with a 2 inch drop from the walkway to the driveway. This presents a clear tripping issue when walking from the driveway to the walkway. According to the contract the paving crew was to excavate the area and install and grade #304 gravel where necessary. The two surfaces should obviously by at the same level, as they wer before Americoat did their work.
Issue #2: The day after paving was complete it rained overnight. The next day, and for 3 days after, there was an 8ft x 4 ft x 1 1/2 indeep standing pool of water. It never drained, but finally evaporated. This puddle will be a huge sheet of solid ice in the winter and it is in the middle of the driveway where we walk to open our gate. This must be repaired.
We have called the Americoat office daily, asking for someone to come and look at the driveway and figure out how to complete it correctly. Each time we call, Tina in the office says that someone will be out soon. She doesn't know when, just soon. Nobody has come out. I have asked to speak directly to a manager or the company owner, Dan Friedman, and nobody is ever available to talk. They are too busy.
I am requesting assistance from the BBB to get this resolved before I will pay the final check for the job.Business Response

It appears you have been in communication with your Project Manager Matt. AmeriCoat stands behind our work and our warranty. The driveway was installed at the correct thickness. The walkway is higher than the elevation of the driveway. We meet grade from the garage to the street. We do not set grade to walkways. We are however willing to offer removing a small section of your walkway and install an asphalt ramp that brings your driveway up to the walkway. At the same time, we will address the low spot where the gate is on your driveway. Weather permitting this can be scheduled for next week. Americoat installers came to our home today to repair the driveway as they indicated they would. I am not satisfied with the repairs they made. Now instead of a low spot where the water ponded, there is a 7 1/2 foot by 4 foot raised patch where the previous water ponding occured. Where they attempted to remove a small section of walkway and install an asphalt ramp to bring the driveway up to the walkway, this is now another obvious patch. Nothing was done in either of these two repairs to blend the new asphalt in with the old. When the salesman Matt came to our house two weeks ago to come up with a solution to the original paving problems our understanding was that there may be a difference in texture from the slightly older asphalt to the new, and it would NOT look like a patch. I have attached photos to show the glaring difference in the pavement level where the remedies were applied. We contracted for a $9034 NEW driveway. It should look like a NEW driveway, rather than a REPAIRED Driveway. Americoat has not rectified the situation as promised.
I do not accept this as the solution to our complaint.

I accept the business's response to resolve this complaint.
AmeriCoat applied a second layer of asphalt in the area where water was pooling and has agreed to provide Seal Coating to entire driveway in the Spring at no expense to us. This will blend in the patched area with the remainder of the driveway. AmeriCoat has also offered to extend the standard warranty to cover any possible issues with the patched areas.

On Oct.24,2023 around 4:00pm the company made one coating on our driveway. The payment was requested before the work was done. The surface of the driveway was not covered evenly. There are areas that are not covered and clearly can see the old( previously applied )coating. The worker did not have material, the brush was dry. The pointed areas he could not fix.
I personally called the company to try to resolve the problem. They asked to send photos. It was done on Oct 25. Promised to review the photos by the project manager and expected the call from her.
It did not happen. We did not use the driveway for a week because we hoped that they could fix it .
Our second car was in the garage. It was very inconvenient. I called again on Oct 26, 27 , 30. The
The manager did not call back.
The check was cashed on Oct 30, 2023. The business has not tried to resolve the problem and does not have appropriate communication with customers. The project was not done correctly as it was promised or required.Business Response

As part of our standard procedure, we acquire payment information when services are scheduled, and we subsequently process the payment upon the completion of the service. According to our records, your service was finalized on October 25th. Subsequently, Ms. **** contacted us to express her concerns and was requested to share photos for our review and discussion. We received the requested photos on Friday, October 27th, just before the weekend began. We attempted to reach out to you through phone calls and text messages on October 31st to discuss and arrange repairs, but received no response, despite leaving a voicemail.
On November 2nd, you reached out to our office, and our operations manager had a conversation with you. During this conversation, it was conveyed that the cell phone number associated with your account belongs to your husband, who is currently in China. This explained why he did not receive our messages and calls. We have now scheduled repairs and sincerely apologize for any dissatisfaction you may have experienced with the initial service. While we do not believe the issues with the sealcoating are due to any fault on the part of our crew, we are committed to making things right for our valued customers.Customer Answer

They can sell the driveway but when deposit is made is when the trouble starts. Started with base layer gravel 6 in not being done right but was assured it would be should of stopped them then. The excavation was only removing the old blacktop layer and moving around the old base layer and gravel then spreading what ever they could find to fill in the rest. Had to be compacted 3 times still didn't seem enough. Only to mess it up when the paver ran it over. Then told them I wanted driveway symmetrical and straight they said no problem it would be. The excavation was not even straight and symmetrical but was assured again it would be. It was from symmetrical straight or even. Has low spots and you can pour water on it and goes right through the blacktop was told that is a sealing issue. So now I know it’s going to freeze and bust up likely over winter. I have email, called several times. The one guy that sold the driveway just gives excuses why it could not be done the way he said it could when he was selling the job. Very unhappy with the job and wish I never had my elderly parents on a limited budget spend so much and get such a crap job. I went into this job with no budget in mind and didn't spare no expense not cutting corners but feel I was given a job that corners was cut on the black top and on the foundation and feel my parents have been taken advantage of due to lack of knowledge and myself not being at the job.Business Response

The contract that your mother signed stated that AmeriCoat would
remove existing driveway, excavate and add 6” of limestone to the expansion
area, repair the foundation of the existing driveway and install 3” of new
asphalt. AmeriCoat removed the existing
driveway, removed the sod and dirt from the expansion areas, installed an
average thickness of 6” of 304 limestone, regraded the existing driveway and
installed 3” of new 448 type 1 asphalt. AmeriCoat
installed 21.17 tons of 304 and 37.39 tons of asphalt. No corners were cut. We can provide all material tickets. Asphalt is a permeable material. We do recommend sealcoating after 90
days. Due to the time of year, we recommend
that your mother schedules sealcoating early next spring. AmeriCoat does offer a 2-year warranty on our
replacement services. If you have any questions,
