I am writing this addressing a concerning issue regarding my construction contract with this local construction builder to build our primary residence.I closed on our new home on November 2023, and confirmed that there were no outstanding dues at that time. However, on April 2024, and August 2024 respectively, I received notice of a Pre-lien mechanical and materialman's lien placed on my property by a material supplier. It has come to my attention that the contractor may not have fulfilled their payment obligations to this supplier. This situation is distressing, also raises concerns about the contractor's financial practices. We have a one year warranty with Ruhl Construction/***** Homes. We bought a new construction home from this company and closed in October 2023. We have paid out of pocket on some warranty items because we needed them fixed. They did not finish a warranty request that we have been waiting for months to be finished. We turned in a request last year about an awful noise from the heater and no resolution. I also left numerous messages at the office and I have not received any call backs regarding our warranty work that needs to be completed. I have updated the app we were told to use. We have requested all of our warranty work to be finished and we have received zero communication from the number I left voicemails on. This number was given to us by an employee at the time. **** did not fully pay their material supplier for supplies used for the build of the home we purchased from them. This has resulted in a lien amounting to over $10,000 of Ruhls unpaid bills being placed onto our property because the lien was filed after closing. **** has been extremely difficult to reach with all phone calls going to voicemail. Purchase a home from Ruhl Construction in February, we closed on 2-29-24 and there were remaining opened items they had to address prior to closing but were not finished, they promised to send someone out to fix them, but they did not do so. They also failed to provide information on how to file a warranty claim and we haven't been able to reach anyone with the company including ********************* the owner. The number on their website goes to a voice mail and have left a couple of messages and no call backs. I called ****** but his voice mail always says that he is on vacation this week and to contact the office. I contacted the *** of Tulsa and they informed me that they were kicked out of the association due to one to many complains and issues. after almost 60 days of trying to get in touch with them we have hit a wall, and we are seeking help to hold **** accountable for their warranty and to complete the items listed in the blue tape / walk thru list we completed with our realtor and some findings from the home inspection performed prior to closing which they received a copy and worked on some items but not all.Some of the items we are wanting resolution include issues with shingles, exterior doors, holes on the exterior brick, wall texture issues, stains on marvel counter tops and floor tile in kitchen and trim on exterior windows, chandelier in dining room, black paint over spray on exterior brick, garage door, and mismatch paint on cabinets in kitchen, and bathrooms.We believe we have attempted everything to try to work with ****, but they haven't been responding to our inquires or provided information about the warranty process. in addition, they are providing wrong affiliation information, they are no longer part of the *** in *****, but they provided a booklet from *** at closing with missing warranty contact information and misleading warranty coverage details.RUHL construction is taking advantage of buyers and missed representing their brand.Business Response

Its unfortunate that such company and owner ship are so dishonest. When my complain was first submitted to the BBB and the **** construction was made aware of the complain they co reacted me with in day. I was provided with information on how to submit my claims, which a was told than that they were unaware of the issues. We have the same story here away, they are claiming they were not aware. the CO-construction app communication where you can clearly see they reach out to me and I provided the list of items that need attention. I also try to call back the number that call me after they received notification from the BBB about my claim but the lady who called has not answer my calls or return any of my messages. This company is not serious about addressing their quality and warranty issues. They have a history of doing this to many buyers, they were kicked out of the ******************************* due to the numerous complaints about their lack of response to the warranty claims.

We were forced to close on an unfinished home 3/31/23. At that time an addendum was signed by Ruhl Construction that promised to finish all items in a timely manner. After a year later there are still unfinished items from the addendum, many of which we completed ourselves. We have serious warranty issues that Ruhl construction has refused to address such as: water damage caused by leaking doors and windows, mold growing on the garage ceiling, stucco that is bubbling and peeling off of our retaining wall, etc.We have contacted Ruhl Construction countless times through their messaging app, filed complaints with the ************************* of ****** Tulsa and sent a demand letter through an attorney. Around February of ********************************************************************************************************************************** ********. They said they could sell me the plans but cannot build out there after reviewing and going over plans we spent around $12,000, and purchased the plans plus met with interior decorator. I gave the plans to my builder and the county and come to find out the plans we had were non-buildable The plans were to the 2015 standards when the current standards is 2018, no trust or wall loads on it etc. repeatedly called the company numerous times with either no answer and voice messages left then when i did get someone was told by the secretary somebody will be in touch with me. Never got a response back. Have sent text messages and emails back to the sales agent with no response so I called the architect company and talk to them, who in return advise me I should never have been sold those plans or even have them because theyre not allowed to sell anything architectural wise outside the state of ******** explain to them that when I was talking to the sales **** they knew I was in ******** and wanted the plans for out here and she said they never have sold me any plans due to legal and insurance reasons outside state.I am asking for my $9000 back since they have frauded me with unbuildable plans that should have never been sold to me.Initial Complaint

We closed on a home from Ruhl Construction 12/30/2022. We have been trying since then to get our punch list completed along with warranty issues completed. They will not answer the phone. You can't go to office to speak with anyone they have doors locked and a sign saying call for appt. Again nobody answers phone. The few times that we get a response it doesn't seem to matter they just tell you lies. There were a few times they came out to complete some of the items and just made things worse or left it still uncompleted. We have been very patient with this company to try and get our home completed. We had 3 or 4 supers during building process and the quality of work and products is horrible. Cabinets have been hand painted not sprayed they are warped don't shut all the way. Installed a damaged oven. You can see wood slats holding up oven. The hearth on outside fireplace is cracking. Its not level. Per our plans we were not even supposed to have hearh. Per plans we were to haveca farmhouse sink. That didnt happen. We paid extra for a dog wash to be installed. That didnt happen. There was a large cabinet placed in garage with no counter top ever placed. This cabinet was not even supposed to be there. We were also to have a shoe cubby and coat rack in garage. Never happened. Supposed to have crown molding in master, livingroom and kitchen. Also didnt happen. Front porch is separating from house because ground is not level. This has also not been addressed. They installed broken wood around door. There fix was to spackle it and never even come back and paint. The cabinets in hall and extra bathroom are ***** as is they were never sanded. We are at a loss on what to do to get them to come out and complete these things. This company needs to have some sort of consequence for the way they do business and treat there customers. I would urge anyone looking to build a home to definitely bypass this company. This have been a traumatic year for us dealing with them.Business Response

This above statement from Ruhl Construction is not true. There are still multiple things that have been placed in there app over this past year. Many of the things are things we placed on punch list that still haven't been completed. All pictures of items have been placed on app. We have now been informed that they no longer have the warranty team anymore to fix items. We have been informed per app that new oven was ordered but can't seem to get any other information from them on that. Per there prior warranty team they stated he was told it was just cosmetic and **** would not be paying for this. Per our contract and plans we were to have a shoe/coat cubby in garage that has never been placed nor have we been refunded fir this. Per contract we were to have crown molding in x3 rooms. This also has not been done. We have been told ************************* and ** the warranty team member that our cabinets would be taken down and caulked and sprayed the appropriate way. This is being avoided also. I have pictures of all items placed in coconstruct that were to be fixed per punch list. Our front porch is separating from house and this also was placed in warranty issues. Our front door trim was never even painted. Our stain on front door and beams is faded and inconsistent. This was also promised ******** and ********************* to be addressed. ************ just lies and should be ashamed of the work in this house. Why are they just ignoring the pictures placed in app and lying about what was promised. They can't even complete things that was in a contract. There are thousands of dollars of work that needs to be done and looks like they are trying to just place this burden on us. This is a brand new home and should not have the issues it does because they couldn't keep a superintendent throughout the home building process. We had four in the building of our home. Now they are lying about warranty issues that need to be fixed! Not just a bandaid! This is the worst company I have ever had to deal with! They take your money and then they are done. I wish we had never continued with the building of this home earlier on. We are stuck with a new home that if they don't do what they should to fix we are going to have to pay thousands to get done correctly. The punch list items on this house was never completed. There are more than 2 things that still need to be done at this house. Everything has been placed in ***********. All pictures! There is supposed to be a new oven ordered but I'm getting conflicting information on this. The front porch is separating from house! This is not true. Our warranty team is still very much so intact. We just had people out at your house two weeks ago working on some of the items on your list of things that need to be completed. We may not be moving at the pace that you like due to staffing changes amongst other things, but for you to say we don't have a team is false. Below I have listed the items that were completed.

As far as a stove being given, I will have to do further research on that because this is the first that I have heard of it.

I was to by ** their warranty guy that he will no longer be in this position and that there was no replacement for him. The front porch never had a crack. The front porch is separating from the house! Which has not been addressed. There is still trim in house that has need puddied due to a piece of cracked wood being installed in house. There is multiple areas in house that need attention. The outside of house has never been adequately caulked. It needs touch up paint where the air holes were drilled. We have been promised by ********************* that our cabinets would be take down sprayed and caulked the correct way. The painter will no longer respond. Your company will not answer the phone. The office is locked. So we cannot ever speak to anyone. We have asked the owner previously to come out and actually view the poor workmanship. That did not happen! Cannot get Ruhl construction to finish punchlist items or warranty issues. As others have stated, **** will not answer the phone. They will not answer responses on their Coconstruct app. Office number goes straight to voicemail. Owner's number goes straight to voicemail. I just want our house finished and the things fixed that have been requested. We have paid extra for engineering report that states framing above garage is inadequate. Front porch is sinking. Drainage issues. Our contract stated we are supposed to have crown molding in 3 rooms and this was never done. The cabinets in kitchen are horrible. There is still unpainted brick exteriorly. Among many other things. I am asking **** once again to please do the right thing and complete the job you have been contacted to do. Purchase of home

Purchased home under an early occupancy purchase contract originally signed 9/23/21. Terms were 6 months as rental and then either purchase or move and lose deposit with no further obligations.
Upon occupancy on rental terms - eight (8) days after the roof leaked - and has continued to leak since.
Ruhl has made numerous attempts to repair and are still attempting to repair.
Through their foreman trying to repair the roof I have been told "no more money will be spent on this home for any repair". The water damage includes sheathing, floors, walls, ceilings along with unseen damage inside the walls.
It has been over one (1) year and I can't use all of my home.
Additionally, there is another item Ruhl Construction has refused to have repaired. The kitchen range has not worked properly since I moved in. I originally submitted a repair request 9-10 months ago. I have also placed other phone and email requests in addition to ask their foreman many times when they have been at my house trying to repair the leaks.Business Response

I have an issue with my homebuilder and need help.
Ruhl Construction built my home in 20-21 and we moved into it in May 2021. We have still not gotten the original punch list work completed.
In addition, this May 2022, the one-year warranty work was identified, and work was started on those items
Timeline:
4/27/22 - sent list, via Co-Construct app, of the items that needed to be done
5/22 - a few items were done but remaining items would need specific trades come out to do them.
Followed up on when outstanding items would be done 6/22, 6/27, 8/12, 9/13, 9/18, 9/23, 9/26, 10/4 - NO RESPONSE
The work is unfinished, and I am unable to get a response from anyone at Ruhl. The last contact I had was on Sept 19 advising that if I had not heard from one of the trades (concrete) to call him. I had to reach out to the trade, and he said he no longer worked for Ruhl. I had relayed that information to Ruhl on Sept 26 and to date, still have no response.
Not only that, but I also have paint and stain work that is yet to be completed. The painter has come to the house to see what was needed but has not returned nor has Ruhl given me any response as to when he will come out to complete the work.
The remaining item is our windows. The warranty contractor advised (back in May) that the window rep (Pella) would need to come check on the windows. Again, no response from anyone as to when/if that will happen.
They have not responded to my repeated requests, even after I advised I would be filing a complaint with the HBA and BBB. I paid a lot for my custom home and while I realize there are issues with building homes, this builder and the experience has been horrible.
I do not know what else to do. Is there anything that you can advise?

The painting that is necessary and will be done by you guys is the painting to cover the drywall repair that was done per the warranty work.
The mantle was weeping pine sap and was sanded during the warranty work.
The drywall patches and mantle will need to be done by you.
This is not touch up painting.
The windows have never been fixed as they are difficult to close and lock. Bo said the window manuf rep needs to come out.
The concrete work has never been addressed either.
These are all things that were submitted prior to the warranty expiring.

The home owner was given the OK HBA Warranty handbook at closing.
In this handbook, it lists standards and procedures of how the home builder is to fix the issue if within warranty guidelines.
If the issue falls within the warrantied guidelines, we will resolve the issue.

Everything is within the warranty.
There has been little to zero response from the builder or the warranty team.
The windows and concrete have been problems since we closed on the house. The Warranty contractor, Bo, has already said the Pella rep has to come out and fix the windows. The concrete work has never been addressed and the concrete trade that they said would come out to fix everything, told me that he no longer works for Ruhl. The paint and stain work is within the warranty as well, it just needs to be done.
The builder is very adept at not responding. It's disingenuous for him to even imply this may not fall within the warranty.

They completed most of the issues. Honestly I just gave up on them correcting the concrete and paid for someone to fix it. The builder never had any intention of fixing their faulty work on it.
The windows have never been addressed but again they kept giving me the same response. I'll send someone out to look at them. The person would come out and advise that the window manufacturer rep would have to come out. Then they would never contact the window company. When I'd ask again they'd tell me someone would need to come out....

I have tried multiple times contacting and working with **** Construciton but they refuse to repair/replace the door and say it is fixed - which photos and eyes can cleary see it does not match.
The front door was never repaired/completed, as it was damaged prior to move in. (This was on our inspection report 2/2/21) The door by the lock looked 'kicked in' and was damaged - notch of the door was kicked out on the interior by the lock. As agreed to with builder (GTAR signed), this item was to be repaired or replaced if it couldn't be repaired (inspection report item). A year later, March of 2022, Warranty sent painters out to stain it. The stain did not match the 'damaged notch' in the door after complete. The warranty company and Daniel **** claim that it is reparied - though it clearly does not match, just like from the beginning. The putty used to repair the notch cannot be stained to match the rest of the door - as told to us by the painters. Since they cannot match it, the door needs to be replaced as we agreed, before we purchased the house. We have all documention and photos and inspection report, and our realtor also claerly remembers this issue and agrees.Business Response

The Ruhl Warranty team has been out to this home several times to fix this door. There is nothing else that we can do for the home owners front door.
I have uploaded a picture of the front door from the last time we went and worked on the front door.

The photos that Ruhl attached: The first one of the door, was when it was wet after the painters stained it - painters took the photo. The notch in the door was evident again, and became more and more evident as the stain dried. The painters, who tried their best, apologized to us, and said whatever was used to try and repair that notch in the door, couldn't be matched with the stain. Again - Ruhl warranty never came out to re-inspect, they just used the freshly stained picture, taken by their painters, to go by. My agreement with Ruhl, clearly states that if the door cannot be repaired, it must be replaced. We agreed to this before we moved into the house, as our realtor made sure we had them agree to it, to ensure it would indeed be rapired/replaced. Therefore, if it can't be repaired - they need to repair my door as agreed to.
The second picture is in regards to the trim and glass on the side of the door, that was another separate item to be repaired - which is was last week. The glass was too thick, and thus the trip around the glass was damaged and wouldn't lay flush. This shows the lack of attention to detail, as this was a separate warranty issue. Why this would be included with this issue, only underscores the issues we have been dealing with with lack of attention to details, and not a full understanding of our warranty items - even though we clearly attach photos, desciptions and are always available for any quesitons.
Again for recent photo of the door damage, one can eiither look at the picture we attached, or even come look at the door itself and can clearly see the damage is still there.I am re-attaching our agreement that we made with this builder before we moved into the house. This door needs to be replaced.

The door has been repaired, multiple times by different members of our team. There was not an agreement to "replace" the door. It clearly states on the uploaded document "Damaged observed on exterior door. Recommend be repaired or replaced as needed."

The door has not been repaired as it is clear in the photots - or in-person if anyone took the time to look. Again it is still damaged. Trying to repair something is not repairing something. My door still looks damaged and needs to be repaired so that it does not, or replaced. Our agreement was to protect me, the buyer, to ensure that if you could not repair it, then it would be replaced. This was not your option - this was my option to protect me - the buyer. We called it out in the inspection report, and the builder agreed to repair or replace in order for us to purchase the house. This was a requirement. Since it is not repaired, and Ruhls own painters agreed it could not be - then it needs to be replaced as stated in our legally binding contract. Aagin the arguement that it has been repaired is a lie. It is 100% clear that it looks damaged - all you need are eyes. It is not repaired - thus legally must be replaced. My realtor has viewed all of the documents, remembers the original issue, and agrees that it is still damaged and thus - as stated in the contract, must be replaced.
