      While I was out of town, on 3/18/2023 my mentally disabled brother went to the dealership and purchased a car for $54,695, not inlcuding taxes, fees, or other additional items. When I found out and went over the paperwork with him he did not know what he had paid for the car, what his payments were, or the length of the loan. His payments were calculated at $677 a month, not inlcuding the payment for the funds that he borrowed from his 401k to make a downpayment. In total he would be paying $800 a month for this car plus insurance. He only makes between $1,600 and $2,000 a month. It was immediately clear to me and should have been to them that he did not understand what he was signing. When I went to the dealership on 3/20 with him to cancel the deal they stated that they could not do that and they offered to buy the car back for $46,000. I do not believe their statements that they could not roll back the deal. We would like the deal cancelled. He drove it back home from the dealership and has not driven it since.

      I am rejecting this response because:

      First, ********************** keeps stating in his letter we.During my brief time at the dealership, we did not speak to ***********************Second, I believe that everything that they have said it their response to our complaint is negated by the fact that he lied. He stated that there was a week between the purchase and our request to cancel the deal. Please refer to the purchase documents which have the date of March 18, 2023 and a copy of my Maps report showing my phone went to Ron Tonkin Kia on March 20, 2023, two days later. Less than 48 hours! Most importantly please refer to the offer to purchase the car back signed by ****************, the Sales Manager, dated March 20,2023. Again, two days after the purchase.
      I would have been in on the same day as the purchase to try to reverse it, but unfortunately, I was out of town and did not find out until Monday morning what ******* had done. They seem to be attempting to state that I am complaining due to some inheritance issue. There is no inheritance issue.Our parents died in 2012 and 2018. Any inheritance would have been solved long ago. As it is, there was a trust set up for ******* which was used to buy a condo for him to live in. The trust currently has approximately $47 and is no way impacted by any purchase that ********************* make as it cannot be held liable for any contract my brother enters into. Trust documents can be provided.
      I am not, and did not, say that I am a financial advisor. My brother made a joking comment that I was his financial advisor as I handle the trust, usually help him with major purchases such as phone contracts, and prepare his taxes. There was no digging on the dealerships part to find anything out.
      As for the trade in of the Vibe, I was upset that they only gave him a $100 credit. I have never seen such a low trade in before. I did say that at the very least I could have purchased it t back from ******* at blue book value (as I was paid blue book value at the time I sold it to them) and given it to one of the grandkids.
      They say that they did not see any issues and that my brother was very astute, despite the fact that it was clear on March 20, 2023 that he did not understand the contract terms when we met with them and that he stated that everything would have been fine if he had been able to talk them down to $38,000 for the car. I cannot testify as to what went on during the negotiations as I was not there, but I certainly can imagine. For example,they did not correct his assumption that he would get a tax credit for buying the **** and still mention a tax credit in their response, despite the fact that the credit is only for cars that have undergone their final assembly in North America. A VIN that starts with K means that the vehicle was manufactured in ***********. *** has entered into an agreement with the *** to become a qualified manufacturer but has not submitted their list of vehicles that are eligible. Further, according to the *** they would have to have done the following:
      The sale qualifies only if:
      You buy the vehicle new
      The seller reports required information to you at the time of sale and to the ***.
      Sellers are required to report your name and taxpayer identification number to the *** for you to be eligible to claim the credit.

      No paperwork regarding a tax credit was provided at the time of the sale. (see attached *** and ** ********** of ****** documents)


      We returned the car on March 31, which had not been driven other than to park it in the garage while debating the best way forward through this. I do not know the law regarding a car sale in ****** but, I believe that the financing was not finalized at 10:30 on the Monday morning after the sale and that they could have, if they had chosen to, rolled the deal back. They chose not to.
      We still feel that the dealership took advantage of my brothers condition and have continued to show their lack of good faith by not being honest in their response to this complaint.
