    Business reached out to us in Fall 2021 asking for $399 for advertisement placement for 2022 for takeout menus. We provided prompt payment and ad materials. In March 2022, a representative reached out from the company to let us know that 2 of the 3 businesses that the advertisements/menus should be running through had decided against putting them out and told them they are a scam, and sent us a copy of their breach of contract notice. We could not get a single person to give us an update after, despite trying for months, until December 2022. Business' story has changed and now denying that there was any issue despite having sent documents stating otherwise. Business is denying refund request but continues to make solicitation calls asking us to sign up for more advertising after being asked to stop calling. Terrible, borderline fraudulent or theft-of-service style business practices coupled with refusal to communicate or respond to inquiries makes for horrible transactions.

    I have attached our contract with the client as well as the electronic agreement and delivery notices. The clients contract states, The duration of the sponsorship begins when the menus are delivered to the host, which TOT estimates to be approximately 120 days from the date of approved ad. Our contract also states *THIS CONTRACT SHALL NOT BE CHANGED, MODIFIED OR CANCELED. All sales are final. With that being said, we printed and delivered these on 11/11/21. As they didn't approve the ad until 11/5/21, we were well within the timeline we asked for. As well, we have reached out to the restaurants that all verified they were using the menus. We made multiple deliveries to all of the restaurants throughout the year. As well 2 of the three restaurants signed for a 4th year of the product. The client requested refund multiple times and was declined on the grounds that every time we reached out to the restaurants they would verify use and request more. There was an issue originally with ************** but after explaining to ******* that he would be responsible for all refunds and damages incurred the issue was resolved. This was at the beginning of the process. As we have mentioned to the client we would be willing to give a free year to help offset any issues she had with the service but we can not refund a product that was delivered and used for the entire process.

    *********** told us there was an issue and that we would be compensated accordingly.  *********** then ducked our outreach for NINE months, then reached back saying everything had run.  When I sent them a response verifying what was told to us, they then advised they'd send a refund.  No refund has been sent.

    We are writing in response to the complaint filed by *************************** regarding the production and delivery of the product they purchased from our company.
    We have thoroughly investigated the matter and would like to provide the following information:


    1) *************************** entered into a contract with our company to purchase advertising with local restaurants.
    2) Our records indicate that the product was produced and delivered as agreed upon in the contract, which we have shown proof of.
    3) We have provided *************************** with proof of production and delivery, including tracking numbers and delivery notices.
    4) The contract signed by *************************** explicitly states that we do not offer cancellations or refunds, particularly for products that have been produced and delivered.

    We understand that *************************** is not satisfied with the outcome; however, we have fulfilled our contractual obligations by producing and delivering the product as agreed upon. Our company is committed to providing excellent service to all our clients, and we believe that we have met this standard in this case.
