    In 2012 my band phobic employed the company CD baby to distribute our album called Farewell Future Boy containing all original songs written by either me or my co-writer. During the past few months I've been posting videos for those songs online. When I post videos from that album on any media platform such as ******* or TikTok, I get a copyright infringement claim from CD baby claiming it's their music. When I dispute the claim ******* and TikTok side with CD baby. CD baby has no right to any of this music And yet they are preventing me from uploading it to the internet. This has happened on at least three songs so far. Attempts to contact the company have failed every time. They do not return messages sent through their help center. They do not respond to ******* messages. I've been unable to reach them over the phone. All I want is for them to stop claiming ownership of MY music and to issue me a formal apology in response to their wrongdoing.

    I am not able to find a release titled "Farewell Future Boy" in our system. I am also not able to find an account with the provided information on file.

    What you're seeing is correct per the **************************** that the music is opted in to. You received what is called a content ID claim on your video. The claim notice is informing you that *******s content ID system has identified the music in the video and has placed a claim for monetization because of the music being opted-in for this service through your CD Baby.

    If you believe a claim is invalid, you can dispute the claim from within your ******* account.

    If you are the CD Baby client/artist and wish to dispute the claim, it is very important that you identify yourself as such and include your CD Baby account username in the text of your dispute for it to be released.
    IMPORTANT NOTE: If our claim is released per a dispute resolution, we will not be able to re-claim the video if you change your mind. For additional information, you can take a look at this section of our help center article.

    If you are not a CD Baby client/artist but you're confident you have all the necessary rights to use the claimed content, we strongly suggest providing a shareable link to your license within the reason for your dispute, or a detailed valid reason why the claim should be released.

    Hello, I'm a songwriter and musician. Through ASCAP, (my PRO) I recently formed my own publishing entity, and wanted to move all my songs to that publishing entity. I found out through ASCAP that I couldn't do that because CD Baby and On 3/25/23, I asked CD Baby to cancel/remove all songs from my single "19 Pounds," and my first two CD's entitled "More Than Meets the Eye," and "Wonder" from the PRO Publishing they offer. They responded as follows: (*******) "Thank you for submitting a request for publishing changes. *******.A representative from our Pro Publishing team will process your request as soon as possible. Any changes requested here will have no impact on your digital distribution, or our ability to collect sales revenue on your behalf." I followed up with another contact on 4/7/23, and I received the same response as before (*******) from CD Baby, and haven't heard anything else back since. CD Baby does not allow customers to use normal email or phone to contact them. Rather, they use a list of prefabricated question choices to choose from in support. So there's no email record on the user's end unless they screen grab during the process. I do not have screen grabs from my March 2023 use of their support bot system. I've read CD Baby's term and termination process. Its one year, then automatically renewed quarterly unless the customer notifies them to cancel. They certainly should have done something by now or contacted me as to why they haven't. If there's some hoop I didn't jump through they should let me know. I've read other musician's complaints about CD Baby for similar situations. All I want is to cancel the Pro Publishing Agreement for the single song, and all songs on the two CD's listed above. I am trying to get into sync licensing and cannot move forward until I own my publishing. Thanks very much for your time and assistance with this.

    Thank you for providing that information. I've terminated our publishing agreements.

    Our relinquishment will go into effect at the end of the calendar quarter in which you requested to cancel Pro (June 30, 2023).

    We will notify your PRO and other collection societies of our relinquishment. This will allow the songs to be claimed by another publisher. Your new publisher will then be able to collect any royalties generated after the effective date of our relinquishment.

    Terminating the publishing agreement triggers our one year post-term collection period. This allows publishing royalties generated during the term of our agreement to be paid out to you through your CD Baby account.

    Be advised, your PRO and other collection societies may leave CD Baby listed as your publishing administrator until another publisher claims these works. If a new publisher does not take over our claim at any given collection society, then that society will likely continue to distribute your royalties to CD Baby, and they will continue to be paid out to you through your CD Baby account.

    Please note, submissions you cancel for Pro will still be listed as Pro inside your CD Baby Member account.

    For more information regarding your publishing agreement with CD Baby (term of the agreement, relinquishment, and post term collection, etc.), please refer to the Publishing Addendum which is included at the bottom of the CD Baby Artist Agreement.

    I asked for over a year to speak to a manager at CD Baby. My requests have been ignored numerous times. **************** is extremely bad. Lately all questions have been simply ignored. Mainly, I wanted to get answers on why certain entries in my catalogue have simply disappeared. By chance I checked my catalogue, to my surprised it askes me in red letters that certain entries need to be corrected. This just happened without my doing anything. The funny thing is, when I try to correct /re enter the items in question, the site won't allow me to do so. My question regarding this problem was completely ignored by CD Baby customer support. In this particular case it was the share of publishing rights. It used to say that my publishing shares are 100%. Miraculously it now says they are 0%. This is just one issue I have with CD Baby. I had many issues over the last few years with distribution and their distribution partners. Dealing with fractions of pennies, I feel every musicians should be aware of CD Baby's practices. In the end CD Baby is making money, not so much their clients. I would even go so far in saying CD Baby is ripping off clients for fraction of a *****. I want everybody who considers signing with CD Baby to do their research before doing so.Kindly! ****************************

    In most cases Spotify streams that show $0.00 actually do represent payments of a small fraction of a cent that have been rounded to $0.00. To see the actual amount of the payment past the second decimal place, please click the "Details" link to the right of the payable column.

    If the payable amount for your Spotify streams is truly zero, and shows only zeros in the "Details" page, this means that Spotify has determined that these are Artificial Streams. For more information please read: What happens if I use a service that promises more streams or I play my own music on repeat?

    We can not appeal this determination on your behalf, but this determination by Spotify does not mean you can't earn money for your legitimate streams in the future.

As far as artificial streams goes, neither one of the scenarios applies. I never stream my own and I never hired someone else to stream. So all the explanations by CD Baby make no sense. Who is really checking what really goes on in the world of streaming?

    I release my music through a company called CD Baby, and I pay for their PRO package, which means they "should" register my songs with my royalties collection agency (PRS for Music). They have failed to do this for three of my last four releases (totalling 31 songs) and have stated they will not take any responsibility for any loss of income. PRS for music have advised me CD Baby should really be registering these, and I should avoid doing it myself as it may create duplication.I first emailed CD Baby about this issue in October 2022 but, despite two follow up emails and two live chats, they have failed to take any action, and have also failed to register subsequent releases. I have waited patiently for a reply to my email of 7 months ago, but instead have only been met with further mistakes on their part. Being in ******, I am having great difficulty in sorting out this mess or, indeed, preventing the mess from getting even worse.Please help if you can. Thanks. *************.     Please keep in mind as well that once we've sent your works to your P.R.O., they too take time to ingest and complete the registration of the works - we do not manually complete the registration at the P.R.O.. This timeline at the P.R.O.s may take 6 months or longer due to the large volume of content they receive on a regular basis.

    I am rejecting this response because - I'm only rejecting it cos CD Baby haven't had time to process things yet.  It's not really a rejection, more of a "believe it when I see it" response.  Here's my reply.

    OK, thanks for replying.  I hope you understand that I only contacted BBB since 7 months, 3 tickets, and 2 live chats, all without resolution or reply, had pretty much exhausted all of my options with CD Baby.

    I know the time PRS takes to register songs may vary, but given that previous songs had been registered very quickly (2019-2021) I don't expect any problems.  And once the songs have been submitted to them I can always contact them for an update.

    Please let me know once the tracks have been sent (all 31, across 3 releases) and this case can be closed with BBB, and all my tickets with CD Baby can be closed off as well.

    You were good enough to try and help resolve my issue a couple of months ago, but CD Baby are still failing to do anything. I release my music through them, and they in turn register my songs with my royalties collection agency (PRS for Music, **). I currently have 31 songs across 3 releases, released over the last 18 months that have not been registered. Despite them agreeing to expedite this several weeks ago, the songs remain unregistered. I have tried emailing them back about this but have not received a response, and since it took 8 months for a response before, and only after the intervention of the BBB, I doubt I'll be hearing anything without your help again.     Thanks very much for your reply, but I won't be able to consider this as acceptable.  Here are the reasons...

    -This just seems to be a generic, copy-and-paste reply.  I'll need a direct reply and an outline of what CD Baby intend to do to resolve the issue, rather than telling me what I have to do.  I've done my part by submitting my songs to CD Baby correctly and paying for the Pro-publishing service.  I just want the job I paid for to be completed.
    -I'm not going to manage to go through the process of sorting all of this out myself.  Having suffered a stroke at a very young age, which has left me with a major brain injury, there's no way I'd even manage to do this.
    -I'm really not sure where the "2 weeks" initial response time comes from.  I've been trying to resolve this issue for 9 months now and I'm afraid (understandably) my patience is running out.  The only time I ever get any sort of reply I when I communicate through the BBB.
    -This email contradicts the previous one I received after contacting CD Baby through the BBB a month or so ago.  That response stated that everything would be sorted out for me, where this one is asking me to read articles (a bit difficult when you're partially slighted and severely brain damaged), submit a request (again, a little on the hard side), and will likely ask me to compile a spreadsheet with song names, reference numbers, etc (way beyond my abilities these days, I'm afraid).
    -My question hasn't been answered.  When (what date) were the songs sent to the PRO or, if they haven't been sent yet, why, and when (what date) will they be sent?

    OK, thanks for the generic rubbish you've sent me for the 20th time.  That's helpful.  Although I have no idea why you're copying and pasting the same nonsense that's already been sent to me, I appreciate your time, and understand that writing this rubbish must consume a lot of time and prevent you from resolving these issues appropriately.

    But aside from my appreciation, this is all complete nonsense.  And just to demonstrate how nonsensical it is, here's the evidence...

    I've used your useless "help form" several times over the last few years, and it's rubbish.  Even when you get to the end and raise a ticket, no one replies.  Also, having had a stroke which has resulted in a major and permanent brain injury, I'm not going to be able to do your job for you.  CD Baby will have to fulfil the agreement as paid for at the time of transaction.

    I was previously told on a live-chat, that CD Baby would take no responsibility for lost earnings.  Yet you seem to suggest here, that you will.  Please clarify.

    Once again, I will ask you, when did you send all my missing songs to PRS for Music (date) and if you haven't bothered, when WILL you send them (date)?  It's a straight question, and not ambiguous, that requires a direct answer.  31 song, 3 releases, 18 months.  That's what you're looking for.  And before you ask, no.  In my condition, I won't be able to compile a spreadsheet of the multitude of missing songs, to make up for your failings.  I'm sorry, but on this particular occasion (and any future occasions) I won't be able to stand in for CD Baby and do your jobs for you.

    Is there any chance someone at CD Baby can assume control for this complete nightmare?  I'd do so myself, but am incapable.

    My case remains unresolved and they seem to be trying to dismiss it all together.  The person dealing with my complaint (who previously stated they would "follow through on this thread until you are satisfied") now seems to be suggesting that it's another ***** that deals with this so it's "case closed".

    I've emailed back, explaining that I'd expect him to contact that department, get them to do any investigating they need to then report back to him, so that he can email me with an update.

    The issue is most certainly not resolved and I request that you do not close it until a resolution has been reached.  I understand you probably don't want lots of open cases on your books, and I would much rather that this was simply sorted out tomorrow but I doubt it will be.  I'll let you know when it has.

    I have contacted cdbaby to release my record UPC code ************ from the PRO publishing administration deal. I got no response.I waited for a week then got into the live chat and was told that these requests will take up to 3 months to resolve. This is not acceptable and ****** long, harming their customers who may need to move to a different publishing administrator.

    We're sorry for any inconvenience caused by our store retirement in 2020.

    CD Baby's mission has always been to support and help artists deliver their music to the world. Though it's an end of an era for our music store, we're excited about all the new things we'll have to offer independent artists in the evolving landscape of the music industry. 

    We will still offer global digital distribution, as well as monetization on ******* and social media, and other tools and resources to help artists create and profit. While CD Baby's retail store was revolutionary ************************************************************************************** our store's last year of operation, 97% of our artists' revenue came from our partners.

    I have submitted several support tickets to get my song I keep the distance back on Tik Tok so far it is not up on that site yet.
