I went to ********* this evening to run in and grab some things. The parking lot was very busy due to a holiday light show nearby. I accidentally parked in an electric vehicle charging spot. I honestly didn't even realize I did that. My best friend died recently and I've been so distracted and sad that I just didn't realize what I had done. I came back out of the store 10 minutes later and they had my car towed to the back of the parking lot. They said I could pay for it now or if they took it it would be more expensive to get it back. It cost $272 and it totally broke me financially. I dont even think there was a sign saying that cars not charging would be towed. And I was literally gone for 10 minutes. I think it's a wrong and predatory practice to just sit in the parking lot and tow people immediately. I thought there were laws against doing that. And then charging me that much to move it 30 feet?? Retriever towing is predatory and I want my money back. It truly was a mistake and now im in the red because they're using illegal towing tactics. Can you please help me with this? Im just trying to keep my head above water. How can I get the money back? Invoice # is ***** Occurred Sunday dec 17th at 8:15 pmBusiness Response

Hello
I do understand your emotions and wanting a refund but in towing know one has any idea what anyone is going through . As you stated you parked where you should not have . Therefore the tow is valid

I am rejecting this response because:
It doesn't even have a sign where I was towed from saying I would be towed from parking there. Your business engaged in predatory practices and you know it. I will take this to small claims court if I have to.
I was a valid customer of ********* where a ton of people were not on the evening specified. They were all using ********* lot to go to ************ . I can prove I was a valid customer of ********* that night.
Sincerely,

Retriever Towing claims they towed a vehicle we sold 2 years prior from the apartment complex in *********, **, ***** in early 2023. They failed to notify the appropriate parties or the registered owners about the towing. Moreover, they also neglected to inform us of their intent to place a lien, and once again, failed to give notice about the impending sale of the vehicle at their auction. This lack of communication is not only unacceptable but also constitutes a breach of ORS statutes. Then, conveniently after a period of five months, they abruptly requested $1956.00 from us to satisfy an arbitrary claimed amount owed to them. Ethical Concerns: Retriever Towing's conduct raises ethical questions, particularly their failure to notify involved parties before placing liens on vehicles and auctioning them off. It almost seems like they do it to see what they can get away with. Their communication came a full five months after the sale, and even then, it was solely to collect on an amount they claim is owed. Many individuals are sharing their frustrations on social media, forums, and the Better Business Bureau, but it seems they're not finding much hope. They feel trapped without anyone to turn to for help. We feel the same and quickly figured out that trying to discuss things with Retriever or asking for assistance actually seems to make the situation worse. They interpret it as an admission of fault and use our words against us. This company engages in criminal behavior and needs to be put out of business. If you are a property management company, please consider using another towing service for your needs. Fair warming, there is a possibility that some apartment complexes may be brought into upcoming lawsuits.Business Response

My truck was towed saying that I was back in parked when back in parking is not allowed. No where on the property is it posted no back in parking. They said it is in the lease agreement, although upon review of the lease agreement of the person I was visiting its not in there. I was parked in what is supposed to be their spot because they dont have a vehicle and the one guest parking spot that is available for about 15 apartments was full. That cost me ****** for their tow fees and two Uber trips to get to the place to get it back.I retrieved my truck in the evening after being made to stand outside a locked gate in the rain past my appointment time by thirty minutes. They took my truck again the following morning. This time saying my tire was over the line. When I looked in the parking lot after the first tow I found three other vehicles back in parked, with no parking pass, and a couple of them didnt even have registration tags on them. The second time while I was waiting for the third uber ride to get my truck I found two other vehicles in gross violation of the reasons I was given for being towed. One vehicle was very blatantly taking two parking spots, and the other was back in parked, tires over the line, and no registration on their vehicle. When I mentioned this to the tow company they blew me off saying they didnt see them. Even though in order to take the picture of the one taking two spots up, they would have had to stand right next to it. And the second vehicle they had to pass in order to get to my truck and again when they left. The second tow fee they took ******. My accumulated Uber fees were 43.13.They stole a total of ******. Both times I took repossession of *********** passenger door was open. I am also missing two bags of things I purchased one was from **** ***** and one was from target. They were in a tote in my truck. New address is ******************************* in ******** it and **************************************************************** **. ************Customer Answer

They stated that the no back in parking was stated in the lease agreement and property rules. I have the lease agreement and property rules that was supplied by the management and no where on my friends lease agreement or property rules is it stated that you can not back in park. Further, they claim the exhaust is too close to the apartments that way but other vehicles throughout the property routinely back in park next to their doors without being towed.
The second time they towed my truck they claimed it was because my tire was over the line but I have emails and texts of me showing them the other vehicles that were over the line and back in parked that they had to pass right by to get to my truck to tow it.

I want a refund of all my tows if they required signature on all three occasions. 10/02/23 @ 2a.m. towed **** mustang @ ******************** Apts.Feel unsafe and harassedInitial Complaint

Retriever towing preformed an illegal tow as per ****** law 2018 written for and because of retriever. They must have a signed consent form for each vehicle before they tow it, not a blanket 'all vehicles parked here's. I have had my tow license, my own truck, hauled hundreds of cars in for scrap, never touched a stolen one... Made sure I knew the ors. Here's the thing. An "illegal tow" and "predatory towing" are just pillow talk for 'unauthorized use of a motor vehicle' or uumv , as characterized by driving riding in or exercising control over a vehicle in any way shape or form without the owners consent. LET ME REPETE, AN ILLEGAL TOW IS A FELONY CRIME. This is organized crime by exact definition. Oregon DMV has it all over their paperwork $6750 fine per occurrence.. ************ issues their tow license. If DMV says their done, then they are done. They stole my pickup truck from the side of the road I'm going to try to press charges, everyone else who has a problem with them needs to file a police report too, they might dismiss a few of us, but this is a class action criminal case .Business Response

On Friday August 18th we were unlawfully towed from our apartment complex. We got a temporary pass from our manager and placed it on the dashboard in the window as we were told. We were using a work truck and the permit was only for 2 days starting on the 18th. The tow driver said he did not see it and proceeded to lift our car despite showing him proof we had a valid temporary permit. His name is ***** and works at the shop on ************ in ***** ******. I would like a refund because they did not prove we did not have a permit and then was hostile when we asked him to drop it.Business Response

Retriever towing towed my car from my brothers apartment complex. ********************** in ********* ******. Crown court apartments has a contract with retriever towing. My blind and disabled brother just moved into crown court apartments about a month ago. When he moved in they did not have any parking permits. The manager said she would get him one as soon as she could. So to write on a piece of paper and hang from the rear view mirror his name, apartment number. Write do not tow. So on Friday the 4th of August 2023 I took my blind and disabled brother grocery shopping. Iam his caregiver. We got back at about 10 pm. I unloaded the groceries. Stayed about 15 to 20 minutes. Went to leave and my car was gone. Found out it was towed by retriever towing. I called them. They towed it to a lot 4 miles away and were charging me ****** to get my car back. After some research I asked if they had gotten a signed release from the manager to tow my vehicle. They stated they did not need one. I asked for a breakdown of the charges the **** up fee was ****** which ****** law ****** the max **** up fee in clackamas county is ****** they charged me mileage of 4 miles at 8 dollars a mile. And a 60 dollar gate fee. And a 15 dollar service fuel fee. Which is not allowable per ****** towing laws. So not only did they over charged me. They also illegally towed my car. If they had actually tried to get the signed authorization from the manager they would have found out that it was a actual resident of the apartment complex's car they were trying to tow, and I would not have been towed. I want a full refund of my money. I have some research and retriever towing has over 450 complaints against them with the department of justice. They were also sued by them in January of this year for breaking ****** towing laws. What they did to me was considered predatorial towing. I have also filed a complaint with the ****** department of justice and the department of consumer and business affairs.Business Response
