    My wife and I bought into Eagle Crest back in 1986 and were loyal members never missing an annual Maintenace assessment. My wife, 86 and myself 88, are now struggling and living on just our social security income. I have advised Eagle Crest numerous times of our situation. I have tried to sell and even give away our membership without success. Eagle Crest has turned over the account to a collection agency claiming I owe $4,899.00 for which I have no means to pay. Our membership has been for the most part an enjoyable relationship, but it has been terrible how all this has ended. All I can do now is just ignore their attempts to continue to harass my wife and me. Also were attempting to relocate into care center. Perhaps after cremation, I will send them my wife's ashes. She has serious dementia now,

    Thank you for the opportunity to respond to this complaint,we take them very seriously. Please understand that this complaint is being filed against the wrong entity. Eagle Crest Resort has an ******************** (Eagle Crest Management, ECM) that manages several of the Homeowner Associations on the property and also manages the Vacation Resort ****************** (****). *** does not buy, sell, or otherwise own any VROA timeshares. *** is strictly an ********************** and has never sold any real estate, including timeshares.


    In 2021, a letter was received from the ********* stating they could no longer afford their membership, none of their kids want their interval, and they are surrendering their membership and will ignore collection attempts. It is important to note that *** and Mrs. ******** did not purchase a membership or contract in 1986, but rather a deeded piece of real estate. Like any other deeded real estate, it must be sold, transferred, bought, foreclosed, etc. and then retitled in the new owners name.


    While we empathize with the Andersons, as noted above, this is not a contract or membership that can merely be cancelled; this is a deeded piece of property that requires it to be sold and retitled in the new owners name. Eagle Crest Management has provided the ********* the transfer options. The Andersons were added to the Hardship List in 2021.


    We can appreciate things change over time; however, they acquired a piece of real estate and whether they use it doesnt have an impact on the costs linked with maintaining and operating this association. Owner fees are assessed to maintain and refurbish the condominium, sports center, road systems and other association assets; as well as provide check-in services,housekeeping, property taxes, insurance, etc. The above referenced association assets and services provided are subject to increases. The cost to provide these services have increased over the years as well as utility costs, labor and materials like every other business the association is subject to the same increases. While the associations board of directors carefully manages the **** budget and expenses to keep annual maintenance fees down, they are responsible for the financial health of the association.


    We are familiar with the ********** situation. Though it may not have been on their timeline, **** and ***** ******** are one of the fortunate applicants who have been selected for the Deed Takeback Program. We will be contacting them with the appropriate instructions and paperwork to take those next steps. 

    We hope this provides a bit more clarity.
