I was involved in a car accident in 2023 with multiple other cars and I was NOT at fault. The Bend EMS came to the scene and transported someone else involved, but I was NOT transported or given any medical treatment. They simply asked me a few questions and left. There was an accident report filed with Deschutes county in ******. The accident report had my current address and my driver's license information. The Bend EMS attempted to bill me $150 for their services and sent the bill to an address that I have never been associated with. The account they created for me ends in 5296. That is the only information they will give me. I have always lived at my current address and have never moved. It is my father's address. I was going to school out of state and my dad collected my mail, when I came home on break, I discovered that the Professional Credit Service was trying to collect on the debt from ********. I knew it was wrong. I attempted to dispute the charges with *** but they refused. If there were any bills associated with the car accident, they should have been covered by the insurance of the at fault driver. Bend EMS should have been given the accident report and billed accordingly, but they did not. They could have checked with DMV for my proper address, but they did not. I do not owe this money and I would like it removed from my name. I have filed a claim with my own insurance so that they can help me navigate this misunderstanding. I can provide the accident report information or the new claim with my insurance to correct this. I have attempted to contact Professional Credit Service several times and they just are not helpful. They are now saying I owe them $181.82. Please respond.Business Response

medical provider St. ******* never billed me, and they sent the bill to a collection agency. original amount for one bill was $375.92 for date of service 3/12/2019 and another was for $2459.28 for date of service 2/19/2019. which was a total of $2835.20. the garnishment was sent for $3633.75 why? and or where they came up with this crazy amount? I have made a total payment of $4158.96 towards this bill/ credit is very sketchy they are not willing to give me information when I call to ask over the phone and yet they say that they can send me it and they haven't done so it has been more than 4 weeks and nothing. now I received a new bill from professional credit service saying that I still owe them $1286.63 how the heck is this even allowed it for the same bill from 2/19/2019. As I was speaking to my HR person from work, she stated that her first documentation that she received for this garnishment was original $4089.29. all this is very frustrating. to see that they can even do this. also keep in mind I am a single mother of 4 kids, ages 13,7,3,3 weeks. My child aged 3 was diagnosed with autism and have a lot of therapy appointments. along with a lot of other newborn appointments and other kid appointments as well. this has really been a problem because I was at the verge of losing my housing due to not being able to make rental payment because of the amount of garnishment... also paying childcare. and other bills was very difficult. I need help for an attorney even if it just to give me advice on this whole legal thing. I am asking that the bill of $1286.63 be taken off and al a refund of money owe back to me. as well as not getting any more bills regarding this since it's been paid off. also I will try to fight to see if they can be held accountable for My legal fees, I have to pay to hire an attorney to settle this matter.Business Response

I am rejecting this response because: The original bill from ****************** was $******* that they never billed me for. I walked into ********************************* they stated that they had indeed sent bills to ********************* but without a unit number. why they did not contact me directly I do not know. it was unnecessary for both St. ******* and the professional credit company to put my family in the financial struggles during a high-risk pregnancy and the diagnostic process for autism of my 3-year-old. I demand a refund from credit company of what was over paid. I will continue to fight this matter and if I need to, I will hire a lawyer since there were some unlawful actions in this matter. you stated the you did not understand what kind of documentation I am asking for this is not true I called and spoke to a gal who said that they were going to send a detail statement of all the payment records that you guys have on your end if she didn't understand what I wanted then why didn't she state that she needed me to explain to her what I wanted. she stated she would send the statement with all the details in the mail but never received anything still waiting. I demand a refund of the money owed to me that I have overpaid the ******* I will deal with St. ******* so the amount I request that you refund me back is $1390.20 why the overall amount that has been paid has been $4225.96, so $4225.96- $******* is $1390.20. I have also attached a bill that professional credit service printed January 9th, 2025, of ******* but when I called you stated that there was an interested added so the amount due was $1286.63, when asking what this bill was for, they stated it was for a St. ******* **** back from February 2019 the same bill included in the garnishment. that had been paid already so I stated that I would not be paying you guys any more money and that I demand a refund.Sincerely,

I am contacting you because I have asked the professional credit service to mail me a detailed statement with all the payments and also details for fees and they are saying that they can not provide me with this information. This is my right to have these for my records.also they have violated the Federal Debt Collection Practices Act by: attempting to collect debts you dont owe.sending written notifications that have insufficient information about the debt.debt being paid off. never received information regarding their legal right to dispute the debt. notice they received was vague and didnt include enough information for the consumer to verify the debt. there are all some violations.

Thank you again for taking the time to share your concerns. We have mailed you a detailed account statement to the address listed in your complaint. Please note that the detailed account statement was created on February 12, 2025, so it shows the remaining judgment balance that was due as of that date. However, as we indicated in our prior response, that remaining balance has been waived and a satisfaction of judgment has been filed with the Court (in other words, you no longer owe that amount). If you have any questions after receiving the account statement, please let us know.

I am rejecting this response because: it's my right to get my refund for the overpayments. I will continue to fight until you guys refund me my money. and also, I am requesting that you send the judgement over to the credit, so it comes off my credit since it should have never been on there any way. I will have my attorney contact you if this request doesn't go through.

This communication is from a debt collector.
Professional Credit Service would like to apologize if our prior responses did not adequately address your concerns. However, our understanding is that there were not any overpayments related to the judgment debt. We attempted to clarify through our prior responses that our records show that we applied $3,033.60 toward the judgment balance. If you have information from your payroll records that shows you paid more than $3,033.60, then we would be happy to review that information and issue a refund for the amount of any overpayment.
In our prior responses, we tried to provide clarification regarding the payment history associated with the judgment. As part of that process, we acknowledged that there may be some confusion resulting from the garnishment checks that were sent by your employer, but which then had to be sent to the court because of the challenge to garnishment. It appeared from your complaint that you may have essentially counted those amounts as being received twice once when each of the three checks was received by Professional Credit Service and again when Professional Credit Service received the funds back from the court (after the challenge to garnishment was resolved).
To further clarify, the amounts received from the three garnishment checks on 10/14/2024, 10/28/2024,and 11/12/2024 totaled a combined $1,125.36. However, because you filed a challenge to garnishment, Professional Credit Service was required to send those funds to the court while the challenge to garnishment was pending. After the court denied the challenge, it sent those funds back to Professional Credit Service, and the amount of $1,125.36 was applied to the judgment debt on 12/13/2024.
Again, Professional Credit Service would be happy to voluntarily return any overpayments to you. However, our understanding is that we only received garnishment payments totaling $3,033.60. Please note that the original judgment balance entered on June 24, 2021, was $3,181.96. The terms of the judgment specified that post-judgment interest would accrue on that amount at 9% per year. With the post-judgment interest and the garnishment related fees and costs authorized by ORS ******,the judgment balance at the time of the first successful garnishment in 2024 was slightly more than $4,000. As such, Professional Credit Service does not have any information that would suggest there was an overpayment on the judgment debt.
Lastly, we would again like to reiterate that the remaining judgment balance was waived, and a satisfaction of judgment was filed with the court. A copy of the satisfaction of judgment was mailed to you, but your most recent response indicated that you may not have received it. We are attaching a copy of the satisfaction to this response for your records. Thank you again and we hope that this response adequately clarifies any confusion that you may have experienced in this matter.
Sincerely,

This company is trying to collect on debt that is not owed by the homeowner's association and the debt needs to be placed directly on the previous homeowner and out of the homeowner's association's name. They have admitted that the debt is owed by a single family residence and that the debit is not owed by the *** and that the original creditor will not respond to their company on the amount of debit. I asked to speak to a supervisor so the account can be removed and closed as the association does not owe the debt and the individual who owes the debit needs to be charged and the representative stated that he would talk to the supervisor and placed me on hold, when he came back on the line he stated that there is nothing going to be done with this account and that it will just be left open but no collection will happen. When I asked why can the account not be closed completely he said that they will not try to collect so what does it matter if it is closed permanently or not and I told him I can not have an open credit account hanging over the association's head so to speak for debt they do not owe and I asked to speak to the supervisor and he said his supervisor was not available and I asked how if he just spoke to him and he said I could leave a voicemail on the supervisors voicemail and the supervisor can try to get back to me and transferred the call. I do not understand why the account and debit can not be closed as this representative agreed the debit is not owed and I feel it was very rude and unprofessional that the representative can not get the account in proper standing and to tell me what does it matter to get the account closed. This needs to be taken care of as they have tried to collect on this debt for almost a year knowing this is not our debt to pay.Customer Answer

********* health sold the balance I owed to Professional Credit Services which is now charging interest on the balance I owed. I tried calling to settle this balance which we couldn't afford in the first place and they told me they couldn't lower the amount at all and that payments could be made but only with interest being added onto the amount we owe which I believe is predatory. If I couldn't pay the full balance to begin, why would I be able to afford the amount + interest and fees? The *** said she would not be debating with me and I told her I cannot afford to pay the amount owed and she ended the call.Business Response

Thank you for notifying Professional Credit Service (Professional) of your concerns. Please note that EvergreenHealth did not sell a debt to Professional. Instead,Professional is a third-party collection agency that works on behalf of creditors like EvergreenHealth to provide collection services. Due to the fact that Professional works on behalf of EvergreenHealth, Professional does not have authority to unilaterally make deductions to the amounts referred to its office by the creditor. Additionally, the fees and interest referred to in your complaint are authorized by WA law (RCW 19.16.500 and RCW 19.52.010).
Professional would be happy to work with you on a payment arrangement, if you would like to contact our office at ************.

The laws mentioned by the creditor apply to penalties of a crime, loans, forbearance of money or goods.
This balance is for a medical need/procedure and when I attempted to create a payment plan multiple times Evergreen Health was unable to assist me in gaining access to my account online to make payments on my balance. And now Im expected to pay the balance + interest? This is ridiculous. Neither agencies have been helpful and the collections agency makes it less attainable to pay off the balance

Thank you for providing an additional opportunity to address your concerns. We are sorry to see that our previous response did not adequately address your concerns. Our understanding is that *** 19.16.500 authorizes public bodies to retain private collection agencies and to add a reasonable fee when the account is placed with that collection agency. Here, EvergreenHealth is the name used by *************************************************************** No. 2, which is a public body in **. Here is a link to the EvergreenHealth website, where they share some additional information related to their status as a public hospital district: (*********************************************************************************************.
Our understanding is that RCW 19.52.010(1) generally provides that interest will accrue on debts where there is no agreed upon rate between the parties. The default rate under that statute is 12% per year, but a later subsection of the statute then modifies the interest rate to clarify that the rate is reduced to 9% per year for medical debt. If entering into payment arrangements on the balance in our office might result in a financial hardship, then you may wish to contact EvergreenHealth to see if you qualify for financial assistance. You can find additional information about the financial assistance policy here: **********************************************************************************************************

Thank you for notifying Professional Credit Service of your concerns. According to our records, we contacted you by phone at the number listed in your complaint on 10/25/2024. We attempted to verify that we had the correct person, so we could discuss the account, but you ended the call before we were able to reach a resolution. As a result, we issued a writ of garnishment to your financial institution shortly thereafter. Our records also suggest that we spoke with you in February 2023 and you indicated that you would call us back later that week to make payment arrangements. However, we did not hear back from you in 2023.
Our records further suggest that you were recently able to reach payment arrangements to resolve the remaining accounts in our office. We appreciate you taking the time to make those arrangements and we hope you will contact us directly if you need anything else.

I am rejecting this response because:
The business is refusing to let me hear this supposed calls where they stated they spoke to me directly! They say all calls are recorded, but when requested to hear the calls they say they cant do that! Also, since when do they go straight for a persons saving account and not garnish wages first like they use to before!! That big chunk of money was needed for bills and they took it for a debt from 2006! They then forced me to make a payment arrangement or they would come for my bank accounts again!! How is that even fair?? I dont agree with their response and Im not ok with how they went about things! Notify people dont just take it!!My own bank stated if they did a release of garnishment that the money that was still on hold at that time then I could get my money back and see about a payment arrangement, but of course Professional Credit Services denied this and stated they wouldnt do it and to consider the debt paid!!
