I continue to receive harassing mail from freshstartnow.net. I do not appreciate my personal information being sent on the front of this mailer. Personal information being sent on/in the mail is not acceptable and is causing me great stress and anxiety. I want all my information removed from this company's database. If I continue to receive these mailers in the future, I will seek advice from my attorney. This kind of harassment can't be legal. Especially since I have never done business with this company and never plan to. Please do not attempt to call me.Business Response

I've never gave permission to the ** Bankruptcy Court, attorneys, creditors and credit agencies to sell my personal contact information. Time was spent to opt out of any business solicitation. Request to remove ASAP my personal contact information from your mailing lists. If any additional business solicitation is rcvd, complaints will be filed with state and federal regulatory agencies. There are a number of illegal practices going on here. The daily letters name themselves as "The Bankruptcy Information and Re-Establishment Center" and the BBB seal is on their website, however they don't exist here under that name to report. Since the email address provided says freshstartnow.net I was able to determine this is them. Their letters are worded in such a way that they present themselves as natural next part of the bankruptcy process, not a business trying to solicit. They claim that there is some new law now and if I carried my car loan through the bankruptcy I MUST make a purchase or my credit cannot be re-established. Well I reaffirmed my car loan so I wouldn't have to worry about that, but it says there's some new law, so I decided to go ahead and call the number on the paper and explain my exact situation with the carrying through of and reaffirming of my car loan and I asked "are you saying that that's changed and that even though I reaffirmed and carried through my loan that my payments aren't going to be counting towards improving my credit? And they straight up lied to me. I repeated the question in different words three times to make sure that she's really bald-faced lying to me about this and she absolutely was. I asked my lawyer afterward - she was and the letter was. Lying is illegal under consumer protection laws. The woman on the phone swore that there is absolutely no way when you file for bankruptcy that you don't have to buy a new car afterward for car payments to help my credit now whether I reaffirmed or not because this new mystery law. My lawyer suggested I report them. United Finance is definitely involved since their predatory practices are why I had to file - they just sued me for 9k mostly interest on a tiny loan from 7yrs ago for a lemon they repo'd after it died a few months in. They said what I'd paid + car's value satisfied the loan, never sent another bill, sued me 7 years later and only they know I filed. Vultures.Business Response

BRG *** has been helping people obtain auto loans after a bankruptcy for 17 years. For the last 4 years we have been rated at A+ from the better business bureau. We offer placement services for individuals who want to reestablish credit so that they may go through the buying process without hassle. When an individual signs a reaffirmation agreement on a vehicle that was carried through a bankruptcy, it does not automatically continue to report to the credit bureaus that the payments are being made. In fact most people lose the privilege of credit reporting when they file, even if the reaffirmation is signed. Its a case by case basis. That is what we were trying to explain. We clearly state on all of our material that we wish for you to confirm our information with your own legal counsel. We apologize that our representative could not offer a more precise explanation for your situation, corrective action has been taken, the employee has been counseled on how to better explain our process. This business, which alleges it is BBB accredited, sends repeated mailings in envelopes ****ed "OFFICIAL NOTICE" "CONFIDENTIAL INFORMATION" and bearing a "CASE NUMBER" conveniently placed like it would appear in a mailing from a court in an effort to make its mailing look like one from an official government agency or court. The letter itself bears a BBB Accredited Business seal and recites "we recently sent you a letter about changes in the new bankruptcy laws and your credit report ... and we have not heard from you regarding this matter" which makes it sound like something from a collection agent. These sharp business practices and the lack of a return address **** the sender as an organization that is NOT a better business. If ****** is a legitimate, ethical, "better" business, why does it need to give the impression that it is a court or government agency, and why the aggressive collection-style language. This isn't a better business and if it is BBB accredited, that accreditation should be revoked until the Bankruptcy Information and Re-Establishment Center stops hiding behind mailings styled "OFFICIAL NOTICE" containing a "CASE NUMBER" that mislead unsophisticated recipients into opening its ****eting drivel.Business Response
