    Dear Mr. ******,

     

    TrueCommerce received an inquiry from the BBB regarding your refusal to pay the agreed fees in your contract. TrueCommerce’s position is unchanged and TrueCommerce will enforce the contract.

     

    For your reference, I have attached your contract with TrueCommerce. Regalo International signed the base contract in 2016. It is a short, simple contract. The fees are set forth in section 2. The termination terms are set forth in section 3. TrueCommerce is not charging you an early termination fee. Your contract is for a fixed term period, whether you use the service or not. In 2022, Regalo signed an amendment that restated how the renewals work – in fact, you signed that amendment.

     

    As a reminder, per section 2, interest will accrue on late payments.

     

    Please comply with your obligations under the contract.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    I provided email documentation stating that our contract was supposed to end on 9/30/2024.  This email is attached.  The company representative stated in this email that this was the contract end date.  Their legal team advised me that they had made a mistake and regardless of the email communication, the contract end date is different.  See the attached email, even the companies sales team advised me that the contract date was 9/30/2024, this was after their review of the contract per the email.

    I have reached out to B2BGateway on numerous occasions requesting that they do not auto renew my account. I cannot get anyone to respond to me with confirmation that they will not auto-renew my account as I have not used their services for over 2 years. They are impossible to get ahold of and their responses are vague and do not confirm whether or not they have disabled auto-renew from my account.

    As of October 11, 2023, Our Customer Care Manager, John Kuvinka, attempted to contact this customer via email & phone and has not received a response.  In reviewing the customer account, they were deactivated at the end of August.
