We thank you for the opportunity to respond to Complaint ******** submitted by your office on behalf of ***************************. We hope the following information is found sufficient in addressing the issues and concerns set forth in the complaint.
Commonwealth Financial Systems, Inc. is a third-party collection agency and as such, we do not have contracts directly with consumers. We service accounts on behalf of our clients with whom we share a contract and who has purchased the account from the original creditor. The original creditor has a right to sell/charge-off accounts after they become seriously past due. While the consumer did not create the debt with the collection agency, the original creditor has sold/charged off the original debt to our client who then assigned it to our office for collection. This is what gives the collection agency the ability to collect for an outstanding debt.
An application process is not applicable. In regard to medical debt arising from services of this nature, a waiver is signed by the patient, or responsible party, upon acceptance for medical services. A copy of this waiver can be obtained from the facility from which services were sought.
Please be advised this account had been closed with our office on 06/13/2022. A deletion request was submitted to the three(3) major credit bureaus to remove the tradelines from credit reporting.

This complain is due to the negative marks made by your company on my credit file. I would be willing to accept this debt if it were mine and upon Validation and Proof of Claim but its not mine and theres no way that you can validate it. I have personally reviewed the Complaint and Attachment and believe the following information will address the issues and concerns set forth in the complaint.
The above referenced account is the result of emergency physicians' services provided on 10/22/2018 by the original creditor, who is ********* ********* **********. Services were rendered to minor child ***. Our records indicate the initial validation notice was sent to *** ***** on 05/13/2022. Formatted in accordance with CFPB's MODEL VALIDATION NOTICE, our notice provides information about the debt; amount owed and itemization information, such as interest and fees. Please note, the interest and fees line item in the notice will always reflect a $0.00 value, as Commonwealth Financial Systems does not charge interest or fees.
Following receipt of said Complaint, we conducted an internal investigation. As part of our dispute handling process, we reached out to our client to assist in our investigation. In the investigative process, we obtained validation of the debt. The supporting document was forwarded to consumer on 07/29/2022.
Please be advised, the HIPAA law permits creditors to share information with its Business Associates necessary to collect on medical debt. The HIPAA rules require that covered entities and business associates enter into contracts to ensure protected health information is appropriately safeguarded. Commonwealth Financial Systems, Inc. operates under a Business Associates Agreement with our client which certifies that we agree to not share private health information with anyone other than the consumer, or authorized party, and we further agree to keep records secure. Our company has been fully compliant with HIPAA requirements concerning privacy of medical records.***THIS ACCOUNT WAS CLOSED ON 8/01/2022 AND IS NO LONGER BEING SERVICED BY OUR OFFICE. A deletion request has been submitted to the credit reporting agencies to remove our tradelines from credit reporting.

David has been doing a lot of fraudulent things like switching my name around on documents, giving bad addresses and saying that he served me! Giving jobs fade documents for fake garnishments then file for the garnishment after the money was already taken! Liked about what case he’s after me on don’t return calls! And has taken a hold lot of money from me illegally with out a explanation for him or staff his address and phone number are out of service and he used a post office as his business address as well his staff are rude and they are in willing to fix any of their wrong doing! The only get Judgment by making sure you don’t make the court dates and if you do make it they say they want to work out a deal with you then they never reach out to you then lie to the judge ect! Please note, Commonwealth Financial Systems, Inc. is a third-party collection agency with most of our clients being medical debt buyers. Our clients do not direct us to garnish wages, nor to take legal action against a consumer.
An in-depth search of our database found no record of a current or prior relationship with our company.
If consumer feels she has the correct agency, we ask she provide a date of birth, &/or SSN, or the **** reference number.

(‘CFSI’) take our consumer protection obligations very seriously and have dedicated significant resources to our compliance-related functions. We believe the following information will address the issues and concerns set forth in the complaint.The referenced account originated as the result of medical services provided to consumer on 01/29/2018 by the original creditor, ***** ****** *********. Following adjustments made to the original balance, a balance remained of $193.74, which was later acquired by our client, ******** ******* *******. On 05/04/2022, the account was assigned to our office to assist consumer in resolving this past due balance.
Following receipt of said complaint, our office obtained validation of this debt, which was forwarded to consumer on July 22, 2022.
Please note, HIPAA regulations permit the disclosure of limited information for the purpose of obtaining payment on medical goods and services, including reporting medical information to a Credit Reporting Agency. There is no clause in HIPAA that prohibits credit reporting of a medical debt without consent.

Here at Commonwealth Financial Systems, Inc, we take our consumer protection obligations very seriously and have dedicated significant resources to our compliance-related functions.
The account in question was placed with our office for collection on 10/28/2020. The debt originated from medical services provided on 11/23/2016. The services were rendered to *******************************,DOB: **********, SSN: ***-**-**** (first five digits of SSN redacted security purposes). In regard to medical debt arising from services of this nature, a waiver is signed by the patient, or responsible party, upon acceptance for medical services. A copy of this waiver can be obtained from the facility from which services were sought. ******************* can contact our office at ************** for facility information.
On 08/16/2021, CFSI received a notice from the credit bureaus the consumer was disputing the account, stating: insurance should have covered. After conducting its investigation, and confirming that the information in CFSIs records matched the information being reported to the credit bureaus, CFSI verified the debt to the credit bureaus.On 12/13/2021, CFSI received a notice from the credit bureaus the consumer was disputing the account. Stating: Information on account is inaccurate. CFSI began its investigation of the dispute, reaching out to the current creditor for assistance. Validation of the debt was obtained during this period which was forwarded to consumer. Upon conclusion of the investigation, CFSI confirmed that the information being reported to the credit bureaus was found to be accurate. These findings were forwarded to consumer.
Our records indicate the initial validation notice was sent to consumer on 08/30/2021. Prior to November 30, 2021 and the new Regulation F rule, there was no law that required our agency to notify a consumer prior to credit reporting.
If, after reviewing the above-referenced information, complainant believes this account to be fraudulent,
we ask that he provide a completed police report/affidavit in order for us to investigate this matter further. The report can be mailed to Commonwealth Financial Systems, Inc., 245 Main Street, Dickson City, PA 18519, or emailed to [email protected]. To prevent any delays, the CFSI Acct # should be documented on all correspondence.
Please note, Commonwealth Financial Systems Inc has met all licensing requirements and maintains an active license to collect in the state of Florida. Both the validation notice sent 08/31/2021, and Itemized Billing Statement sent 01/22/2022 to consumer, provided the name of the original creditor and/or current creditor.
As stated in our initial response, on 12/13/2021, we received a notice from the credit bureau the consumer is disputing the account, stating Information on Account is Inaccurate. Our investigation found the information being reported to the credit bureau(s) was accurate. The verification of debt obtained from the current creditor was forwarded to consumer on January 22, 2022.
