I received an email from ******** that there was a hit on credit report. I looked at it and saw that it came from Commonwealth Financial for an unpaid bill. It made my credit drop from 797 to 676. I have never heard of this company nor have I evere received a phone call or letter from them. I always pay my doctor bills and the rest of my bills before their due date. I don't know why a debt collector would send information to a credit reporting agency when they don't call me or send a letter.Business Response

The above referenced account was reviewed fully in conjunction with the consumer’s complaint, and I believe the following information will address the issues and concerns set forth in the complaint.
Commonwealth Financial Systems, Inc. is a National collection company incorporated in the state of Pennsylvania since 2001. We are a third-party collection agency that collects on behalf of our clients. The account in question was placed with our office for collections on August 8, 2022 by our client, ******** ******* ********.
The debt is the result of physician services provided on July 15, 2016 at ***** ****** **** *****. Our client purchased the account from the original creditor of the account, ***** ****** *********, after it had become delinquent, and assigned it to our office for collection. Our records indicate notification of the debt was sent go consumer notification of the debt on September 02, 2022 in an electronic communication. Before credit reporting, the account was monitored for a minimum of 14 days to allow for notice of deliverability issue with the email address. No notice was received indicating an issue.

On August 26 I paid Common Wealth $84.26 over the phone over a bill that I was not receiving because I had moved. Common wealth got a hold of me via mail and I paid immediately. I have never been late for a payment in my life. Soon after I started to get phone calls from individuals that were very vague and did not clearly state what company they were. I would ask why they were calling and they would not tell me till I provided personal information. I was very hesitant because Im afraid of fraud and identity theft, so I hung up on them. Later on November 14, 2021 I saw on my banks credit alerts that Common Wealth placed a major derogatory **** on my credit. I called them and tried to tell them I had already paid, they told me they had no records and I needed to call my bank to provide a receipt showing I paid common wealth. I called my bank and they told me that they dont provide receipts because it was a payment done over the phone to common wealth, and that my statement should be enough proof. I looked through my statements, and I found the date that I paid Commonwealth financial $84.26 on August 26,2021 to an RMP *** *** **** *********** **. I called common wealth back and told them what my bank told me and they told me to send an email with the statement to an ***@cfsi-arm.com email and to label the email with this ref#********* on January 10,2021 at 10:58pm. They have not responded to the email or removed the mark on my credit. I had amazing credit till they fraudulently marked it. Please be advised, the above referenced account was not begin serviced by Commonwealth Financial Systems Inc in August 2021. The account was not assigned to our office until 10/06/2021. On 3 separate occasions there was telephone contact with a female however, we were unable to verify that we had the right party on the line. On calls, we need to follow a verification process that allows us to ensure we are speaking with an individual connected to the account. ******************** was not willing to provide information we needed to complete that process, so we could not discuss the nature of the call &/or the nature of the account.
In regard to the issue of payment, our records indicate no payments were received on this account while it was open in our office. The statement consumer attached with Complaint ********* shows a payment of $84.26 made to merchant 'RMP' at phone number ************ (please see attachment). Upon calling that number, I was connected to *** ******** *** collection agency in N.Carolina. Please note, Commonwealth Financial Systems Inc is not affiliated with any other collections agencies. However, ******************** disputed the account with our agency on 01/03/2022 as paid prior and on January 11, 2022, she provided the documentation to support her claim. We forwarded the documentation to our client advising them of ************************ position regarding the balance that was placed with our office. The matter was investigated by our client and, on January 27, 2022, our office was advised to close the account. A deletion request was sent to the three (3) major credit reporting agencies - **********, ******** & ******* - and should not be appearing on consumer's credit report. IF the account is still credit reporting, the most efficient method to assure deletion, is for the consumer to dispute directly with the credit reporting agency that continues to carry the tradeline. We will again send a deletion notice for the credit reporting agencies to delete the item from complainant's report.

After reviewing my credit report I found that I had 2 collections both in the amount of $200 from Commonwealth Financials Systems. I am not liable for this debt with Commonwealth Financials Systems and do not have a contract with them. They did not provide me with a copy of the original application validating an agreement to partnership with on another, neither have they provided a breakdown of fees including any collection costs and medical charges. For both these reason this is a violation of the Fair Credit Report Act and this item should be removed from my credit report immediately to avoid litigation.Business Response

We thank you for the opportunity to respond to Complaint ******** submitted on behalf of *************************. The above referenced account was reviewed fully in conjunction with the consumers complaint and I believe the following information will address the issues and concerns set forth.
Please note, the referenced accounts are medical debts that originated with ******* Hospital. In regard to CFSI Account # ********* - original account number ********** - the debt accrued from services provided at ******* Hospital Orlando on 09/24/2018. The total charges were $1,048.00, of which a balance remains of $200.00. In regard to CFSI Account # ********* - original account number ********** - the debt accrued from services provided at ******* Hospital Orlando on 06/07/2018. The total charges were $4,325.60, of which a balance remains of $200.00.Our records indicate notification of the debts were sent to ****************** on August 18, 2022 in an electronic communication. We monitored the accounts for a minimum of 14 days for any deliverability issues. No notice was received on either account.
Prior to said Complaint, there is no record of inquiries, disputes, or contact by consumer. Upon receipt of said Complaint, the account was placed in Dispute status, and in accordance with the Fair Credit Reporting Act, a request to update the tradeline for the accounts to disputed was submitted to the credit bureaus. We have also reached out to our client for validation of the debt, as requested by consumer. We will forward the results of our client's findings to consumer once received.In regard to HIPAA, the HIPAA law permits creditors to share information with its Business Associates necessary to collect on medical debt. The HIPAA rules require that covered entities and business associates enter into contracts to ensure protected health information is appropriately safeguarded. Commonwealth Financial Systems, Inc. operates under a Business Associates Agreement with our client which certifies that we agree to not share private health information with anyone other than the consumer, or authorized party, and we further agree to keep records secure. Our company has been fully compliant with HIPAA requirements concerning privacy of medical records.
Please be advised, Commonwealth Financial Systems, Inc. (CFSI) is a third-party collection agency and as such, we do not have contracts directly with consumers. We service accounts on behalf of our clients with whom we share a contract. The original creditor, ******* Hospital, sold/charged off the original debts to our client, after they had become delinquent. Our client, the current creditor, acquired all ownership rights, including the rights to collect on the account. While the consumer did not create the debt with Commonwealth Financial Systems Inc., the current creditor has placed the accounts with our office for collections. This is what gives our agency the ability to collect for an outstanding debt.

I received a "bill" in the mail stating it was from services rendered at an emergency facility, the "bill" was not paid, and was turned over to a collections agency ( Commonwealth Financial Systems LLC). I just received another letter from this company stating they are offering "50% off" of my total "bill" if I will pay it immediately. I have not received any type of emergency services in over 5-6 years and the charges are not explained. Upon researching this listed company I only find information pointing to this being a scam and MANY others have discovered the same. This company is somehow reporting this to TransUnion and other creditors which is causing negative impacts on people's credit scores. This needs to be addressed immediately.Business Response

We are a third-party collection agency with most of our clients being medical debt buyers. On June 28, 2022, a medical debt in ******************** name was placed with our agency for collections. The debt is the result of emergency physiciansservices provided on 08/10/2019 to minor child, ***. at *************************************. The physician is a member of the ********** ******** ********* PHYSICIANS group. There is a remaining balance of $695.00.
The record indicates our office sent written notification of the debt to ***************** on July 07, 2022, which he acknowledges receipt of in his complaint. The account was monitored for any notice of undeliverability issues associated with the address, and after 14 days, when no notice was received, the account was sent to be credit reported. The above referenced account is a medical debt that was assigned to our office for collection on March 08,2022. Prior to credit reporting, notification of the debt was sent to consumer in an electronic communication. CFSI permitted receipt of, and monitored for, deliverability issues with that email and received no undeliverable notice for 14 consecutive days.
On September 08,2022, our office received notice from the credit bureau(s) the consumer was disputing the debt stating: Information on account is inaccurate, and on September 09, 2022 we received a second notice stating consumer was disputing the debt as Paid Prior. A request was submitted to the credit bureaus to remove the tradelines from credit reporting while we conducted a reasonable investigation with respect to the disputed information. A full review was completed of the case file, as well as all corresponding documents, all information provided by consumer in the ***** our client's findings and confirmed that the information that was being reported to the credit bureaus was complete and accurate. To complete our investigation, we reached out to our client requesting validation of the debt in question. The itemized billing statement on the account was provided, verifying the information on file is accurate and complete. The supporting document was placed in todays USPS First Class outgoing mail, for delivery to consumer.
To substantiate consumer's claim the debt was paid prior, our client requires supporting documentation/proof of payment for original account number - ******************** - ****** ****** ********* **********. This information can be mailed to: Commonwealth Financial Systems, 245 Main Street, Dickson City, PA 18519; -or emailed to [email protected]. The account in question is the result of emergency physicians services that were provided on 12/02/2019. The attending physician is a member of ******************************, who is the original creditor of the account. The original creditor later sold/charged off the original debt to our client, who then assigned it to our office on 03/03/2022 to assist ****************** in resolving the past due balance. We sent consumer notification of the debt on 05/13/2022, after which we monitored the account for at least 14 days for notice of any deliverability issues. No notices were received on the account.
On August 12, 2022, our office received a notice from the credit bureaus the consumer was disputing the debt stating: Not Consumers Debt. The account was immediately marked as "disputed" and, in accordance with the Fair Credit Reporting Act (FCRA), a request to update the tradeline for this account to disputed was submitted to the credit bureaus. We conducted a reasonable investigation and confirmed that the information in our records matched the information being reported to the credit bureaus. In the process of our investigation, we obtained supporting documentation validating the debt. A copy was forwarded to consumer on or about August 23,2022.

This company has been reporting to all three major credit bureaus with inaccurate information. I spoke to a few gentlemen with this company about this and there was no resolve. They told me this was an old hospital emergency room bill, but will not even tell me what hospital this bill is from. This is a fraudulent account and they are reporting it time and time again on my credit report hurting my score. Commonwealth Financial Systems, Inc. is a third-party collection agency and as such, we do not have contracts directly with consumers. We service accounts on behalf of our clients with whom we share a contract and who has purchased the account from the original creditor. The original creditor has a right to sell/charge-off accounts after they become seriously past due. While the consumer did not create the debt with the collection agency, the original creditor has sold/charged off the original debt to our client who then assigned it to our office for collection. This is what gives the collection agency the ability to collect for an outstanding debt.
The account in question is a medical debt that resulted from services provided on 02/24/2017 by the original creditor, who is ******* ****** ********** ***.. There remains a balance of $78.00.
In his response ***************** makes the claim our office failed to provide him the original application that he requested. I conducted a full review of the case file and found no record of inquiries or contact by consumer. The records indicate that our office received notification on 8/08/2022 that Consumer is disputing account basis of the dispute: Identity fraud or account take over. We understand ****************** is seeking the application in relation to the medical debt in our office, in order to conduct his investigation into the matter. I contacted Commonwealth Financial on June 8th, 2022 via phone and I advised them that they had reported an account to the credit bureaus that does not belong to me, it is fraudulent, and that I would like to dispute. They advised that they would place the account into a disputed status and then reach out to their client to get documents to verify the account and to help their investigation. I specifically requested an itemized bill with my signature showing that I agreed to pay the alleged charges. I then followed up with the company on or around July 20th (approximately) because it had been longer than 30 days and I had received no debt validation documents from them. The agent apologized and acknowledged that indeed no documents had been sent and that she would escalate to "management". Since this company has not been able to validate this debt in a timely manner, I am requesting for this tradeline to be DELETED from all 3 credit bureaus.Business Response

We at Commonwealth Financial Systems Inc. (‘CFSI’) strive to deliver professional and friendly service to all consumers. Furthermore, we respect the laws as well as the state and federal agencies that oversee compliance. I appreciate this issue being brought to my attention and believe the following information will address the issues and concerns set forth in the complaint.
Please be advised, a full review was conducted of the case file, as well as all records, databases, and notes, and no record of contact with consumer was found for June 8, 2022. The first record of contact with consumer was a telephonic contact on 07/25/2022. In that call recording, it was confirmed ****************** contacted the credit bureau(s) on 6/08/2022, not our office.
Our record does show an entry on June 8, 2022, that CFSI received a notice from the credit bureaus the consumer was disputing the debt stating: Not aware of Collections". A second entry indicates an additional notice was received from the credit bureaus that same date, stating the consumer is disputing account - "Not Consumer's Debt".
As part of our dispute handling process, we reached out to our client to assist with our investigation. We received their findings on 08/02/2022 in that they obtained validation of the debt, and provided us the itemized billing statement on the account. The itemized billing statement was forwarded to ****************** by our office.
In order to resolve the complaint, we have closed the account in our office and will return it to our client. Closing the account will result in all tradelines associated with the account to be deleted from the credit reporting.
