    Dear BBB I have a complaint.commonwealth finace has been repeatedly hitting my credit accout number " ************ "They state I owe a **** of $56 dollars. I have never done bussiness with them I do not know who they are or what the debt it. I have sent out letters to them asking for all of the information I have never gotten a responce. I pay all my bills as soon as I can. I do not know what this is. I am on ******** due to my disabilities. I have no credit cards. I do not own a car. they just keep reupping this my credit had dropped drastically in the past year an may not recover from this attack. Will you please resolve this issue. I do not know how to get supporting documents all it is is on my credit report.

    Commonwealth Financial Systems Account number: ********* ***** account: ************ I recently found that Commonwealth Financial Systems had filed a collections against me on the behalf ***** are either purchased an account pertaining to me from ***** and preceded with malice without fore thought of the account that is originally over 4 yrs. old do to the failure of ***** to effectively and correctly file the insurance and or to get in contact with me when they found a problem. Further more Commonwealth did not take the time nor have they did the research to fine out what was the problem and why was it now being that this account after 4 yrs. was just now being turned over to them. If they would have taken the time they would have found out if not from ***** then me that the procedure for this account was 100% payment approved and that ***** was at fault for there misfiling and or not getting in contact with me if there was a problem or anymore information needed. I have already filed a complaint against ***** for there short comings in this matter and like for Commonwealth be removed from my credit report effective immediately.

    The basis for my dispute COMMONWEALTH FINANCE, *********************************, Client Relations,COMNWLTH FIN, ************, $399 - was required to notify me prior to 09/07/2022, or no later than 30 days after. COMNWLTH FINfailed to notify me about reporting derogatory info. to ******** ********* *** ********** In section 603(p) 15 U.S.C. ss 168s-2(a)(7)(A)(I); The notice required under subparagraph (A) shall be provided to the customer prior to, or no later than 30 days after 09/07/2022, furnishing the negative derogatory information to a consumer reporting agency described in section 603 (p), 15 U.S.C. ss 1681s-2(a)(7)(B)(I). Plus broke commercial law under UCC ***** that all notices were timely and properly given by dated certified mail receipt. They were not met. I asked for documentation & received no response.     This response is in relation to Complaint ID   ********       submitted on behalf of  ****************************  We at Commonwealth Financial Systems **** (CFSI) take our consumer protection obligations very seriously and have dedicated significant resources to our compliance-related functions. The account at issue was placed in our office for collection on 09/07/2022. In compliance with Regulation F of the CFPBs Debt Collection Rule, prior to credit reporting the account, our office sent consumer written notification of the debt in an electronic communication.  The notification of debt was sent on October 07, 2022. We then waited fourteen (14) days,  the reasonable period of time  as defined by the CFPB,  to allow for notice of a deliverability issue.  No undeliverable notice was received, and after 14 days, the account was sent to be credit reported. 


    Please be advised, there is no record of our office having direct contact with ********************, where a request for documentation was made. On January 27, 2023 our office received notice from the credit bureau(s) that the consumer is disputing the accuracy of the information on the account.  As part of our dispute handling process, we conducted a reasonable investigation of the disputed information. Through that process, we obtained verification of the debt and confirmed the accuracy of the information in our records, as well as that being credit reported. A copy of the supporting document obtained to verify the debt was forwarded to ******************** on February 07, 2023 for her records. 


    The account is currently in a dispute status.  A subsequent dispute has been received on the account and the dispute information has been forwarded to our client for further investigation. Pending our clients findings, and  it has been requested from the three major credit reporting agencies  to remove the account from consumers report.  We have ceased collection efforts and have requested the tradelines be removed from credit reporting pending our clients findings.

    Commonwealth Financial Systems ********************** Dickson City PA ****** Was notified by the credit bureaus that there was a medical collection on my accounts which posted 8/5/2022. I sent a letter to the collection agency for validation and they sent back a bogus letter saying it was a hospital bill from 2017. I have not been to the hospital at all. The credit bureaus sent back letters saying it was validated. How can you validate something in less than one week after the postage date of me sending letters. This situation has caused me nothing but stress and anxiety.

    This company is a third-party biller from an emergency room service that I took my minor child in for emergency services. I was under the impression that because of the Title I of the Consolidated Appropriations Act of 2021 as well as the Texas Senate Bill 1037 that was passed that medical bills were not to be reported on my credit report. Also, I believe in one of those laws that were passed, if I went to an IN network facility and an OUT of network physician provided services that the company is supposed to settle with my private insurance (which was not attempted at all, assuming because the company knew they were out of network). This came out on my credit report TWO weeks before I was closing on a home. It dropped my credit score 100 points. I had already called the hospital which I took my minor child for services to begin to pay off the balances which they were all cleared since she qualified to have the balances cleared. This company has not abided by and honored that. This hurt my credit score drastically and hurt me when I was in the process of making one of the most important purchases of my life. I have tried to dispute several times on my credit report and was finally advised these steps. The laws passed represents a major step in protecting consumers and it has not been followed by this company.

In response to  the issues and concerns *** ******* laid out in the complaint, Commonwealth Financial Systems, Inc. is a National collection company incorporated in the state of Pennsylvania since 2001. We are a third-party collection agency with most of our clients being medical debt buyers. The account in question is the result of emergency physicians' services provided to complainant on 11/06/2016 by ********* ********* ********** medical group. ********* ********* **********, the original creditor, sold/charged off the debt to our client after it became seriously past due. Our client, the current creditor, placed the unresolved debt with our office for collection on 08/09/2022.

    We sent *** ******* notification of the debt in our office on September 02, 2022 and received no notice to indicate there was a deliverability issue. Our office also sent a text-based  communication on September 09, 2022. Our office received  no inquiries, disputes, or contact by consumer regarding the account prior to the complaint received 1/5/2023.  Upon receipt of the complaint, we ceased collection activity and forwarded the dispute information to our client.     Please be advised, Commonwealth Financial Systems, Inc. (CFSI) is a third-party collection agency and as such, we do not have contracts directly with consumers. We service accounts on behalf of our clients with whom we share a contract. The above referenced account is a medical debt the resulted from emergency physicians' services that were  provided to minor child **** on 07/11/2016 at *************************** medical facility. The emergency physician is a member of the ****** ***** ********* ****** *** medical group and bills separately from the hospital.  ****** ***** ********* ****** ***, the original creditor, sold/charged off the original debt to our client, after it became seriously past due. Our client, who acquired all ownership rights upon purchase, including the rights to collect on the account, placed the account with our office for collections. This is what gives our agency the ability to collect for an outstanding debt. 

    Our records indicate the validation of debt letter was sent to ********************** on June 14, 2022. On October 05, 2022, CFSI received a notice from the credit bureaus the consumer was disputing the debt; dispute basis: information on 'account is inaccurate', and on the grounds 'not consumer's debt' in a subsequent notice from the credit bureaus.  Our office conducted a reasonable investigation into the disputed information. The investigation determined  we are attempting to collect the debt from the correct individual, it verified all relevant data associated with the account, and confirmed the accuracy and completeness of the information being reported to the consumer reporting agencies.  Our office obtained verification of the debt in the process of our investigation and forwarded a copy of the supporting document to *** *********. 

    Please note, the statute of limitations applies to the maximum time which legal proceedings may be initiated to collect a debt. Commonwealth Financial Systems, Inc. does not bring legal action against consumers. The HIPAA law permits a creditor to share information with its business associates necessary to collect on medical debt, governed by the provisions of the Privacy Rule. The Privacy Rule requires that covered entities and business associates enter into a Business Associates agreement ensuring  protected health information (PHI) is accessed and disclosed at the minimum amount necessary to accomplish the intended purpose of its use. The Minimum Necessary Standard of the Privacy Rule  limits PHI that can be disclosed but information such as the  individual’s name and  address is permitted.  Commonwealth Financial Systems, Inc. maintains and operates under a Business Associates Agreement with our client, the current creditor of the account, who has placed the account with our office for collection.  We certify we disclose the  minimum amount of PHI needed and taken the steps necessary to keep all records secure. Our company has been fully compliant with HIPAA rules and requirements concerning the privacy of consumer's health information.
    The account at issue is no longer an open account in our office. The account was closed January 11, 2023 and is scheduled to be returned to our client. As standard procedure we submitted a request for credit report deletion upon closing the account. Please note that it may take time for the credit reporting agencies to process our request and update consumer's file.
