On 5/16/2025 someone from this company came onto our property where our house had burned down a month ago. They put up a misleading sign AND not only did they go through our belongings, they stole things AND destroyed property. A police report has been filed and we are in the south.Business Response

After returning home from an international trip we received a note on our door that our home was abandoned and Guardian would be changing the locks in the next few days. I own this home and this is my primary home. This is private property and nobody should be trespassing or making claims on a property rightfully owned and paid for through the mortgage company. We ask that Guardian quit this activity immediately and have advised local law enforcement in *********** ******* to arrest any unauthorized persons trespassing on our property. Guardian Asset Management is not taking responsibility of damage caused by a unit they currently own. Their response was to push the costs to the one who suffered damage. A unit in ***************** that is next to mine had a pipe burst internally on 1/24/25. The water affected several units where my damage was isolated to the flooring in the utility room. **** was deployed immediately to run fans to dry it out. Once they removed the fans, there was no more contact. When inquiring about the damaged tile, I was directed by the association to a law firm handling it. The law firm informed me they were no longer representing Guardian. Guardian was extremely difficult to contact. Once I was able to get through to Guardian, I was told they would follow up with the proper contacts. After I called back not hearing anything again, they indicated they have no interest correcting the damage caused by the pipe burst in their unit and recommended I contact my insurance company who is not responsible for the damage they caused.Business Response

Hello, Insurance claims can only be filed on the unit that is named/listed on the insurance declaration page. In cases like this, when a unit is damaged by another unit the homeowner must file a claim with their insurance company. If the insurance company finds that the other unit caused the damage they issue a subrogation request for reimbursement. This is a very common practice with water issues such as this or damages like fire that spread from house to house or a tree that falls on neighboring house. Once the subrogation is requested, the insurance for the unit that is suspected to have caused the damage, would review and if they agree with the findings, they issue a reimbursement. This should not affect the other persons insurance or count against their rates given the reimbursement.Customer Answer

I am rejecting this response because: Guardian Asset Management is aware they caused damage to several units. I provided one video to them after **** completed their drying service only to be told I must go through my insurance for repairing cost, I am requesting their insurance policy to cover the damages created by their unit. My insurance should not be involved since I nor my insurance is at fault.To elaborate using the tree scenario, if another's tree damaged my unit then the tree owner's insurance would be utilized assuming they were not negligent maintaining the tree. Similarly in a vehicular incident, the party at fault applies their insurance, not the innocent party. Please take responsibility and repair the damaged tile.

Near.[19702]Fiduciary Trustee for the property: ************************************** ***** **** *******, TTEE 31 December 2024: found MCS Notice on front door with determination the private home is unoccupied and abandoned. Contacted **** gave employee Notice and Warning that the Home is not unoccupied or abandoned at 14:12 PM EST. Trespass Warning Notice with fee, is posted on the Front Door, Front Window, and back door. Checked the Property on 18 January 2025, all is well.Checked the Property on 03 February 2025. MCS NO TRESPASSING Notice taped to the front door. Found the property vandalized with parts of the door handle and dead bolt in pieces on the sidewalk and in the bedding. Immediately contacted 911. Contacted the *** Sheriff. Contacted the Bankruptcy Court where there is a stay of protection from any action until the appeal is exhausted. Contacted MCS at the Numbers on the Notice. Received no return call until Thursday 13 February 2025 when we are informed, they have a work order to give us the keys and return possession of the home to us. Keys were returned to us by ******* ****** of MCS on 15 February 2025 at approximately 11 AM EST. Upon entering the home we found the pieces of the door hardware destroyed and on the floor in pieces. We found the lock box destroyed and the pieces on the floor. We found Notices from *** with the address ********************************************. #************** in various places within the home. We found the Water Meter missing from the basement. No Plaintiff has come forward with a Certified Claim for damages. Fraudulent Mortgage Contract is Rescissioned for cause of mistake due to legal deception. You guys put a notice on a trailer that a tenant owned on a piece of land that I own. The tenant has since passed away. (A year and a half ago). I have given you a year to do something about the property, and you have not. I have called and left messages with no response. The back acre is now a forest and a fire hazard. Massive trees have fallen down and the whole place is overgrown. I want to clean up the land but I need you to come get your property off of my property. I am ready to bulldoze the property as it is in complete disrepair.
