    Regarding the complaint made by ***** ******

    *** ****** contracted with us on April 25, 2024 to perform a survey of her property o* ***** ******* ***** ********.  She paid the required 50% deposit and scheduled her survey with us for May 8, 2024.  Prior to that date, we performed preliminary deed research, and plotted her parcel based on the deed information.  On May 8, we arrived at her property and proceeded to perform the survey.  We looked for survey monumentation on her property and on the surrounding properties in her neighborhood.  The boundary lines were then determined based on the deed and on the found evidence in the field.  Measurements of the topographic features (house, sidewalks, patio, etc) were also taken.  This data was then plotted using a Computer Aided Drafting and Design (CADD) program to generate the survey drawing.  This drawing was signed and sealed by a licensed Professional Land Surveyor, and provided to *** ****** on May 18, 2024.  Provision of the survey drawing satisfied all elements of the contract.

    However, *** ****** did not like the findings of the survey.  She expressed that she wanted more property on the south side of her parcel.  We tried to explain that that was not accurate and was not possible based on the found monumentation and deed description.  She insisted that she wanted  a detailed survey report to support her position.  Such a report is out of scope, and would not support her position anyhow.  Despite numerous calls with her, we were unable to convince her that her survey was accurate and complete. 

    Upon completion of the survey contract, the remaining 50% fee was due.  *** ****** did not pay her final obligation for the survey, and in fact demanded a refund of her deposit.  We are in the process of filing a complaint with the magistrate to collect on this unpaid debt.

    The surveyor Mark H***** *as used by my neighbor as an ‘official’ survey almost 3 years ago to identify property lines. Today On April 2 2024 Mark H***** approached my front door pounding and attempted to get into my backyard without asking for access before I opened the front door during a work meeting saying he needed to mark a line that he did not mark during his original survey my neighbor had done. After we installed a new fence based on those agreed upon marked lines with our neighbor at their expense the company representative Mark H***** said on 4-2-24 he did not put a survey marker inside my fence because someone was not home from my neighbors house who requested it and a fence was present. A fence has been present other than when we had it moved and changed AFTER he put his original markers in the ground identifying the property line. He had no issue pounding on my door and asking for access today and I find his marks not credible based on township suggested distances between homes and feel he needs to be investigated for inaccurate markers as well as poor service towards our neighbors and us as a final result. I do not find this company to be credible and the property markers were labeled on the drawing our neighbor showed me. The marker he planted in my yard today was not approved by me other than the fact he said it was right but based on his changes almost 3 years later I find this to be incorrect and will pursue legal action if our fence is deemed to be needed to be removed as a result of his error and unprofessional conduct today.

    THIS LETTER IS IN REPLY TO A DISPUTE FROM STEPHEN CHADDAH.

    My name is Joan D**** and I am the co-owner and Sr. Partner in Arpenteur Surveying. We are a small family owned business that provides land survey services in Western Pennsylvania.  My husband Mark H***** is our primary surveyor, and he has been licensed as a Professional Land Surveyor since 1991.  Mark has worked for large survey operations, such as ******* ***er, where he supervised 25 survey crews and was responsible for a monthly survey budget of $1M +.   He was the director of the Survey and Land Management Department at Duquesne Light.  He has also held surveyor positions with a variety of large and small companies prior to launching our own land survey business.  Mark is the past Vice President and Treasurer of the Pennsylvania Society of Land Surveyors, two positions that confirmed he has the respect and support of his peers in Survey. As a company, we pride ourselves on We carry full professional and liability insurance and have never had to make a claim on either.

    On April 20, 2022 we performed a survey for our client ***** ****** ** *** ********* ***** ********* ********* ****** *** ****** **********  On that date, the corners of his property were identified and marked with iron rods topped with a yellow plastic cap (standard survey monumentation).  On the southwest corner of the property, it was determined that a wooden fence, owned by their neighbor, ******* ******** *** ********** ***** ********* ****** *** ****** ********** encroached upon the ****** property by 6.5 feet.  As we do with all of our surveys, in the event we have to step into neighboring properties, Mark went to the door of the ******* residence and knocked and rang the bell.  No one answered, so Mark had no choice but to set the iron rod in the southwest corner of the ****** property at a 6.5’ off set, outside of the wooden fence.  The official survey drawing was annotated to show that the southwest corner rod was set at an offset.  The ******** were informed of the fence encroachment. Subsequent to that survey, the ********* replaced their wood fence with a vinyl fence without first securing a survey of their own.  They erroneously used the offset rod to represent the corner of their property.  As a result, their fence was installed incorrectly, and once on the ****** property.  The ******** requested that Arpenteur return to their property on April 2, 2024 to clarify the Southwest corner, and south and west boundary lines.  Mark knocked on the ********* door and explained that the ******** wanted a corner rod set on their actual Southwest corner, which was inside the ********* misplaced fence.  A discussion ensued, and Mark was given permission to set that rod.

    We are now hearing that the *********, who were NEVER OUR CLIENTS, want to pursue legal action against Arpenteur.  We believe that this is just a smoke screen for their failure to properly understand the ****** survey, and their failure to get a survey of their own prior to installing their new fence.  The BBB complaint suggests that the ****** survey be investigated for “inaccurate markers”.  The only way to do that is for the ********* to secure their own land survey, which they should have done from the start.

    The ******** have prepared an independent  statement on our behalf, noting Mark’s professionalism.

    Total charge for survey as per signed contract: $1000.00
    Arpenteur received a $500.00 payment from my bank account on 9/7/23

    Arpenteur received the remaining balance of $500.00 , which was also deducted from my bank account on 11/24/23

    Arpenteur has received a total of $1000.00 as of 11/24/23, which satisfied the total charge.

    On 1/12/23 Arpenteur charged my card for another $500.00. It appears that this business is making fraudulent charges after being paid in full. While I have my contract and all payments are on record with my financial institution people may want to stay away from this business. There seems to be an issue in the billing that is more than suspicious.

    i apologize for the error. Our bank, PNC switched providers for processing credit card payments and there was a glitch in retrieving the payment information. As a result, we processed a third payment of $500 that should have not been charged. I have refunded that payment and issued a credit if $50 to the customer for her inconvenience, along with my apologies.

    I signed a contract and submitted a deposit of $500 for a property survey. I was scheduled for November 2. On November 2, the team came out and walked around my property for two hours and said they “couldn’t find any markers” and “nothing was lining up with their information” so they needed to do more research. They came on a Thursday so I waited until Tuesday but received no follow up. I started calling and leaving voicemails and then emails on November 7. It took two weeks to get a response which was we’ll be in touch in a day or two. Again, no response. Had to reach out several more times to get an answer. I requested refund which was to be sent on 11/17. It’s now 12/2 and I’m still getting the run around. “Oh it’s in the mail” or “oh the post office returned it”. When I asked why I got a “I don’t know”. Apparently this was mailed again and 11/30 but no refund and no response. I’ve offered to come to the office and pick it up. I’ve asked about electronic refund and they just avoid my questions. I’m questioning the legitimacy of this business as recent reviews online point to similar experiences. I just want my $500 so I can hire someone else to do the work they couldn’t do. All emails between myself and the contact at the company are attached.
