Both accounts are labeled as “Paid as agreed in settlement,” yet their continued presence is unjustly damaging my credit profile and financial standing.
Although these accounts are marked as settled, I am respectfully requesting the full removal of both accounts from all consumer reporting agencies (Equifax, Experian, and TransUnion). The derogatory nature of a “settled” status—even when marked as paid—still negatively impacts my creditworthiness and misrepresents my current financial integrity.
Under the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681c, consumer reporting agencies are required to ensure the information they maintain is accurate, fair, and not misleading. Even when a debt is settled and paid, the continued reporting of these closed accounts with negative implications fails to reflect the spirit of that statute. These accounts no longer serve a valid purpose on my report and instead serve to unfairly penalize me despite the resolution of the debts.
Additionally, FCRA § 1681i(a)(5) provides that any item disputed by a consumer which can no longer be verified or which no longer serves a fair and accurate purpose must be deleted. Furthermore, the Equal Credit Opportunity Act (ECOA) prohibits creditors from reporting in a manner that could result in unjust discrimination or hindrance in obtaining future credit.
I am requesting that First Premier Bank exercise its discretion as the furnisher of this data and request deletion of both accounts from the credit bureaus immediately. The impact of these accounts is disproportionate and damaging, particularly considering that they are closed and marked as paid. I view this continued reporting as a form of punitive credit suppression, which undermines my ability to grow and improve my financial standing.Business Response

Dear *********
This is in response to your
concerns regarding your First PREMIER Bank credit card accounts ending in **** and ****.
The account ending 1*** was opened December 2021. A settlement was completed in February 2025 after
receiving a payment for $469.21 on February 25, 2025.
The account ending **** was opened March 2023. A settlement was completed in March 2025 after receiving
a payment for $510.19 on February 28, 2025.
Both accounts were closed
at our discretion in August 2024 due to the risk involved with the excessive
number of lost/stolen reports.
Upon completion of the settlement arrangements,
we reported both accounts to the consumer reporting agencies as paid in
full for less than the full balance. We do not remove accurate information in
goodwill. The consumer reporting agencies are responsible for removing accounts
at the correct time.
We understand this is not the
response you were looking for but hope you can understand our commitment to
accurate credit reporting. Please feel free to
contact us at ************ if you have additional questions.

Dear ******
This is in response to your complaint regarding identity theft.
As this was our first notice of identity theft, we referred your
complaint to our Security Department. Following an investigation, we found you
responsible for the account.
This account was opened in November 2023 after receiving an online
application. Please be assured a verification process is followed on each
application we receive. We stopped receiving payments and determined the debt
was unlikely to be collected, so it charged off in October 2024 with a balance
of $562.50, which remains today.
Charged-off accounts stay on the credit report approximately seven
years from the charge-off date, and accurate information is neither changed nor
removed early.

I have a charged off account appearing on all 3 of the credit bureaus from First Premier Bank. I have already disputed the debt as fraud. They never verified it with me personally.
Under the Fair Debt Collection Practices Act (FDCPA), specifically Section 809 (15 U.S.C. § 1692g), if you dispute a debt in writing within 30 days of receiving the initial validation notice, the debt collector must provide you with verification of the debt, not just the credit bureaus. This verification should include evidence like the original contract, account statements, or proof of debt ownership, and it must be sent directly to you. Failure to provide this to you upon request is a violation of the FDCPA.Business Response

I am rejecting this response because:Thank you for responding to my BBB complaint about the credit card account ending in ***** I want to be clear that I did not open this account and strongly believe it’s the result of identity theft. My personal information, including my email, login credentials, and Social Security number, was exposed in a dark web data breach. I also lost access to other accounts, like my TurboTax account I’ve had for 15 years, which further shows my identity was compromised.
I’m concerned that your investigation concluded I’m responsible for the account, without sharing any details about the evidence you relied on. The Fair Credit Reporting Act requires a reasonable investigation into disputed accounts. I’ve taken steps to address the identity theft by filing an Identity Theft Report with the FTC.
I’m asking you to reinvestigate this matter thoroughly and share specific details about what ties me to this account, like the application records or identifying information used.
Condemning me to this derogatory account for 7 years on my credit reports is largely detrimental to my success and outlook on every day living and prosperity.
I want it removed from my credit reports with Equifax, Experian, and TransUnion. I’ve also disputed the account with the credit bureaus and will reach out to the Consumer Financial Protection Bureau if necessary.
Please confirm you’ve received this response and let me know the results of your reinvestigation within 30 days.Thank you for looking into this serious issue.

First Premier Bank is reporting an open line of credit on my credit report but this account has actually been charged off. They are also reporting a late payment that is not accurate. I tried reaching out yesterday 6/2/2025 and asked them to remove this from my report and they are refusing to do so even if I paid them the full balance. I've actually already paid this balance as I had a payment plan setup with January, a debt collection company who purchased the debt. This means that First Premier is reporting false imformation and needs to remove it as soon as possible. Please remove this immediately.Business Response

I am rejecting this response because all payments have been made to January to satisfy this debt. I have attached a screenshot for proof. I understand your policy, but before being made aware of this, I was promised that upon payment received the remarks on my credit would be deleted as a one-time courtesy. If this is not possible, I request to at least have the inaccurate data corrected immediately as it is currently showing that I owe on this account and that no payments have been made which is incorrect information. I was told that this could be deleted/corrected immediately and should not require a full reporting cycle. I feel that I have met my end of the agreement by paying the amount owed and deserve to have my credit report reflect this. This company keeps calling me regarding this credit card, which has been paid, through debt consolidation, and i have a letter at home stating that.
