    I am submitting this demand letter regarding the request for a refund of closing fees associated with ***************************************************** The account statement you provided indicates a *************** Fee of $850.00 was charged. However, the Management Certificate dated July 20, 2020, specifies that the *************** Fee is $400.00. Furthermore, a new Management Certificate was recorded on May 8, 2024, which does not apply to our closing date of April 29, 2024. Section 6.3 of the governing documents explicitly states that fees become effective only upon the filing of the instrument. This is also supported by Texas Property Code Section *******. I hereby request a refund of $450.00 for the overpayment of the *************** Fee. Additionally, the account statement reflects a charge of $625.00 for a HOA Inspection fee. According to Texas Property Code Chapter ******* (e), unless mandated by a dedicatory instrument, neither a property owners association nor its agent is obligated to conduct an inspection prior to issuing a resale certificate or an updated one. There is no instrument indicating that inspections are required for *********.I hereby request a refund of the $625.00 HOA Inspection fee. Moreover, the statement shows charges of $475.00 for a resale certificate and $475.00 for a transfer fee. Texas Property Code ***** (c) stipulates that a property owners' association may impose a reasonable and necessary fee, not exceeding $375.00, for assembling, copying, and delivering the required information, and may charge a reasonable and necessary fee, not exceeding $75, for preparing and delivering an update of a resale certificate under Subsection (f).I hereby request a refund of $575. 00 Total funds owed $1650.00

    Connect Community Management, a property management company used by my HOA, is in the business of scamming homeowners. A prime example is breaking down architectural changes into smaller projects and charge $150 for each instead of charging a fee for the entire project. For example, homeowners putting in a pool with a fence and a bathroom are being told the pool, pool slab, bathroom and fence are 4 separate projects at $150 each just for review by the HOA.Additionally, **** ********, the manager, has repeatedly rejected requests by the homeowners to show the financials. He also decided to do maintenance work by himself in the common areas, without making a public bid and without any transparency as to how much was being spent in what, not to mention he was neither licensed nor insured to perform such work.

    I am rejecting this response because:

    There is clear, factual evidence that excessive and unfounded fees were charged by *** not just to me, but to other neighbors. In one case, a working capital assessment fee of $850 was charged at closing to another neighbor, more than double what it should've been. The management certificate filed with the state at the time listed a working capital assessment of around $400. This is just one of many examples where CCM acted in bad faith.

    CCM and **** ******** are retaliating due to an ongoing lawsuit against them. Not sure how my immigration status is relevant here, we are all equal in the eyes of the law and I am perfectly aware of all of the governing laws in ***** and in the ***** including those that CCM has been breaking (and blatantly continues to).
