Santander Consumer USA did not furnish me with a Form ****-C after the alleged debt of $12,571 was charged-off from an auto finance account in my name. It is also to my understanding that once a creditor charges-off an account, that they receive a tax deduction for the charge-off amount when they file their taxes. That I turn converts the amount owed from an alleged debt, into earned income, which has fraudulently been reported to the consumer reporting agencies as charge-offs, which misrepresents the amount charged off as alleged debt owed, instead of earned income, which is being fraudulently reported to the credit reporting agencies.Business Response

On May 16, 2023 a check for $5,655.98 was sent to Santander Consumer USA to fully pay off my car, after multiple calls they told me they never received it and that my account was past due. When I went to my bank where I got purchased the check, they showed me proof of the front and back of the check where Santander Consumer USA received, stamped and cashed out my check on May 22, 2023. However my check was never posted to my account with **********************, my account with ********************** still says its past due. Every time I call Santander Consumer USA, the representatives and supervisors keep giving me and making up excuses saying they never received my check, after Ive already sent them several faxes and proof where it shows it was received, stamped and cashed out by them. The check I sent was never posted my account, they stole and kept my money. Very unprofessional of them! Its going on a month and they still havent resolved my issue. I sent them a letter through the mail as well with proof of the front and back of the check and I havent heard anything back from them. Im pregnant and this has been very very stressful and has been taking a toll on my pregnancy. Account #***************** Please help me bbb.org Ive disputed this account multiple times with no results I was not given the option to buy back my car and they wouldnt give me information when the car would be sold dispite the fact I called the company multiple times for months according to the **** and ******** laws, borrowers have certain rights and protections. This includes the right to redeem their vehicle by paying the full redemption amount, which includes all outstanding debts, repossession costs, and the whole loan balance. Furthermore, borrowers have the right to be informed about the sale of the vehicle as well as the time and place of sale. Unfortunately, I was not given the chance to exercise my right to repurchase the vehicle by fulfilling my payment obligations and paying the outstanding balance. Despite my inquiries, this institution did not provide me with the required information and timeline to take advantage of this options which is a violation of my rights as a citizen and if not corrected legal action will be takenBusiness Response

In November of 2020 I bought my first car and it was refinanced through Santander Consumer USA. Ive always made my payments either ahead of time or early but the year of 2021, my son caught COVID and I was laid off. So I talked to customer service and was told theyd put my late payments on the end of my loan which was a lie, they never did. So I was able to get help that time from my parents to keep my car. Well a few months later after I am caught up, they said I still owe for December.. now I payed them $2000 and I only missed three months so how? Get my taxes made three payments and Im still behind ( let them tell it) so now I asked how much do I need to pay because obviously I need my car they give me an amount and Ill be okay to not get repossessed another lie, came in may to get my vehicle and I was going to try to get it back but I couldnt afford my rent, car insurance and the games they were playing especially from someone who stayed on their payments before my son got sick. They are a scam and everyone should qualify for that 2020 lawsuit as far as getting their loan forgiven and off their credit because theyre misleading and dont take accountability for anything.Business Response

I am rejecting this response because: I understand what you are saying, however, the account, as you can see in the attachment i sent showed closed/charged off, not open, charged off. I need the Credit reporting to show I am current on my payments, because i am. I don't care if you show it open charged off, and it's not, but i need it to reflect on time payments. As it stands, according to my lawyer, the closed/charged off report with no on time payments reflected is seriously in violation of Truth in Lending and is not an accurate representation of the on time more than minimum payments i am making and will prohibit me from obtaining fair interest rates on additional financing, if i can even get that with your untrue reporting. If you cannot accurate report my on time payments, and credit reporting reflect this, i have no motivation to continue to pay on the loan, as a repossion or voluntary surrender wouldn't hurt me any more than what you currently show reporting. I'm not asking for loan forgiveness, just that the reporting reflect open status as you have stated but not showing, and that you report that I am making regular payments, that is all. ing legal counsel.Business Response

This company customer service is rude and disrespectful and they cut you off and over talk you and pull from your bank without notify you and give you an update they call you **** a day and harass you and over charge you this company need to be closed and you cant get a word out without them over talking you they keep pulling from your account and making it keep pushing you in the whole and when you make payments the amount you owe goes up higher then what your contract is its ****** when I got the car and its still ****** after I had this car for 2 years makes no since please I need someone who understand and let you talk and who is good with customers I wish I would have seen the reviews before I even did the deal with this companyBusiness Response
