Hello, we have tried helping Orlando out. Our policy states that we will send the customers parts for their unit if it was damaged or has issues. It states we do not pay for labor. I offered to pay the labor and he didn't want to take the unit to a shop. He said he wanted to return and that is when I informed him of the 2 way shipping and 15% restock fee. I have offered the customer solutions, but they are not the solutions that "He" wants.

Ordered a TM-K125 ATV from motobuys. It arrived with a bent frame as shown in the pictures after Spending almost 2 weeks playing phone tag with ******* at motobuys. They finally said the mechanic agreed it shouldn't have been shipped that way and issued a return authorization number and had it picked up. Going on 2 weeks now no word on refund. Can't get them to pick up the phone or return one of numerous phone calls at least 3 on any given day. At this point we are sure they are screening calls and refusing to communicate. All we want is what is ours which is the full refund amount.

I bought the factory-new ICEBEAR Trike motorcycle on Sept. 20, 2024. Received it in mid November. Covered by 6 month warranty.Since the very start, the machine showed a strong shaking / wobbling of the front part. That makes it very unsafe and uncomfortable to ride. I immediately informed, including a video, the company. Per the attached emails, Motobuys refused to repair the problem. The machine is not usable. Short of a complete repair performed and paid for Motobuys, I expect to return the machine and receive full refund.

    To BETTER BUSINESS BUREAU

    Complaint # ********

Following the BBB involvement, MotoBuys shipped two replacement parts for the front wheel assembly: one rim and one tire.
On February 18, I received and installed them on the Icebear trike.

The result was ZERO improvements.   The strong wobbling is the same.  The trike continues to be
    unusable and definitively dangerous.

The cause of this serious problem must be in other parts of the machine.
The solution must be handled by the manufacturer and its dealer, MotoBuys.

    Regards,
    ****** Pensotti

    Hello ******,

Could you please send us a new video of the wobbly wheel and tire, however, rather than a video of you riding it, can you please raise up the front wheel and spin it by hand?  My technician advised also if you could also zoom in or get a close up of both sides of the rim/wheel, and to make sure that everything is tight and nothing is loose.  Thank you!

Please email the video to ********************************************************************

My parents purchased a ****** from Motobuys on 10/29/2024. The go cart was delivered in November and the starter went out on the go cart in late December. I have called their customer service, sales, tech support, and parts department on 12/30/2024, 01/17/2025, 01/21/2025, 01/30/2025 and on 02/05/2025. On two occasions the sales **** told me they would have someone from tech support call back. I even left a voicemail on a direct line that sales transferred me to without a response. I have emailed multiple times and only recieved one response stating my request had been received (*****). It is disappointing that the starter failed within months of getting the go cart and even more disappointing that we have been unable to contact them to replace the parts under warranty. I recently reviewed reviews for motobuys and faulty parts and lack of response seems to be a common theme. I would like to see the company uphold their warranty agreement and replace the faulty parts.

On 15 November 2024, I ordered and paid for 2 All Terrain Vehicles (ATV) from MOTOBUYS. I spoke directly to the salesperson who identified himself as *** who further stated he was part owner of the company. Payment was accepted by MOTOBUYS. The items were delivered on 19 November 2024 at my residence, as agreed. Upon inspection of the machines, some damages were noted and photographed. In addition, it was noted and photographed that the batteries on these new machines were several years old and non-functional. These photos and damages were transmitted to MOTOBUYS via e-mail as per their policy. There was no immediate response so another e-mail was sent on 25 November 2024 requesting the status. A response was received stating that they needed 3-5 days to process. Again getting no response, I sent another e-mail on 3 December 2024 and I received an update on 4 December ************************************************************* and would be delivered to my address. As of 12 December 2024, nothing had arrived so I re-contacted MOTOBUYS. Their response was that the *** numbers from both ATVs were required. These photos were sent immediately to MOTOBUYS. On 21 and 30 December 2024, separate e-mails were sent to MOTOBUYS requesting a status on the parts which were supposed to be provided. After no response, I sent another e-mail on 5 January 2025, stating that if the parts were not shipped quickly, then I would contact the Better Business Bureau (BBB) and that I may possibly take this matter to court. A response was received shortly thereafter stating that the problem would be submitted to the customer service department and require their high attention. As of today, no response has been received. I do have copies of all correspondence with MOTOBUYS if needed. MOTOBUYS ******************************************* ************ I am requesting that the BBB intervene on my behalf or provide some guidance on how to proceed with this matter.

    Customer Answer

    Date: 01/28/2025

I am rejecting this response because:   the response from MOTOBUYS is a non committal non answer.  It's just another delay tactic that they have been using for the past 2 1/2 months.  Attached please find the original purchase order for the 2 ATVs on 15 November 2024.  The machines were received on or about 19 November and the damages and discrepancies were immediately photographed and sent via e-mail to MOTOBUYS.  After several email exchanges, they sent a message on 4 December 2024 (refer to attachment labeled "Invoice") which included the necessary replacement parts for the machines at no cost to me (buyer).  However, these parts were never sent.  Several more email exchanges resulted in more delay tactics on their part.  I have promptly complied with their stated policy and requests, however there has been no movement on their part to rectify this situation over the past 80 days (to date).  That is more than enough time for them to send the parts.  I am requesting that they either send the parts (as noted on the invoice) or they issue a partial refund of $1200 to cover costs of replacement parts and repairs of the damages noted upon delivery.  Parts include 2 valve stems with cores, 2 boots for Upper and Lower Ball Joints, 1 Ignition switch assembly, and 2 NEW batteries.

Thank you for your assistance and cooperation in this matter.

    Hello *******,

I just reached out to the manufacturer in regard to your Parts Order, they are in the process of shipping it out and will provide you with the Tracking Information once they have it available.  They did advise me that they are out of stock of the 2 Boots for the Ball Joints, so we are currently reaching out to a different manufacturer to see if they have that part available to send out to you.

If you have any questions, please don't hesitate to reach out at ************ or ********************************************************************

    Sincerely,
    Motobuys

    Customer Answer

    Date: 02/04/2025

I am rejecting this response because:   once again MOTOBUYS has provided a response with no action. In their response, they state that they "just reached out to the manufacturer" regarding the parts. It has been 2 1/2 months since the damages were reported, yet they are just now 'reaching out' to the manufacturer.  That is unacceptable.  Previously, MOTOBUYS provided me with an invoice (copy previously submitted with this complaint) that indicated the parts would be shipped from their own parts department, yet never sent the parts.  This was on 4 December 2024.   I will continue to reject MOTOBUYS responses to this complaint until the parts or compensation are actually in my possession.  Based on previous interactions with MOTOBUYS, this response seems to be just another delay tactic.  I have researched other buyers' reviews on line and discovered MANY dis-satisfied customers.  Especially when 'promises' to ship something were made yet the customer never received the replacement parts.  The replacement parts or compensation needs to be received in a timely manner.  Please include the shipping tracking number in any response.

    Customer Answer

    Date: 02/05/2025

The attachment was received today (5 February 2025) via e-mail from MOTOBUYS.  It is a similar or same invoice document received from MOTOBUYS on 4 December 2024 (and still bears that same date) but there are some modifications to this recent document.  It now indicates that some parts as "Damaged" and other parts were. a "Quality" issue, and seems to convey that the parts will be sent at no charge to the customer (me).  However, as in the past, this is just an invoice yet contains no mention that the parts have been or will be actually sent to the customer, and there is no tracking number.  This information is being transmitted for inclusion in the complaint.  I simply want MOTOBUYS to replace the damaged and non-functional parts as per their stated policy.

    Customer Answer

    Date: 03/02/2025

Some replacement parts were recently received from MotoBuys.  The 2 replacement batteries were manufactured in May 2022 and were not functional. According to battery manufacturers, ATV batteries have a shelf life of 6-12 months (see attachment) and a use life of approximately 2-3 years.  The replacement batteries are already expired.   Additionally, the steering ball joints were not included in the delivery.  Motobuys either needs to send currently manufactured batteries (2) that are less than 4 months old, as well as the ball joint parts, or they need to issue a refund for said parts.

    Customer Answer

    Date: 04/30/2025

Motobuys still has not sent the replacement parts for the steering arms.  In early March, they sent 2 EXPIRED Batteries and an ignition switch.  The batteries were already more than 3 years old and would not hold a charge.  In their last response to this complaint via BBB, they indicated that all parts would be sent, however, they have once again failed to follow through and actually send all the parts, and they parts they did send (except for the ignition switch) were non functional.  They have NOT contacted me directly nor will they answer E-mail correspondence.  ** has now been 6 months since the **** were received and the discrepencies noted.  It is very obvious that Motobuys has no intention of taking corrective action as warranted in the purchase agreement.  I propose that a fair and equitable solution would be for Motobuys to pay $600.00 so that I can purchase the damaged parts and perform the repairs myself.

Paid for a go kart. Upon arrival to my home it was not strapped to skid, tons of cosmetic damage which all was recorded and reported. Followed all directions and let it warm up for 30 minutes 2 different time and the transmission would not go into gear in either direction. It would not light up D on shifter but would R, but had to nearly put all the way to floor and it would try to move but just grinded and jerked. Only way could be moved is by pushing it. I followed up and spoke with their mechanic. Remind you I paid extra to have it fully assembled and per their wording they run and drive to make sure its good to go and test everything. They approved the return. Before returning I had a local shop confirm what I experienced to protect myself after reading all the negative reviews online. After them having the go kart back for over a week and having to call them 10 times a day before Id reach someone, because the manager ****** was always in a meeting and never able to come to the phone. He didnt return emails after the return approval. I finally get through and they are only returning $1800 of the $3747 I paid them. Not acceptable. Allegedly the mechanic states there are no issues with the go kart whatsoever after letting it warm up. So they did exactly as I figured they would and play the our word against yours game. Their mechanics diagnose is nothing close to what I experienced. I paid for a product as advertised and paid extra to have it fully assembled and tested. I got a scratched and dented go kart that would not go into gear and had to be pushed or put on a pallet to move it. Im just seeking a full refund. They got their machine back in the condition in which I got it. I need my money back.

We offered the customer multiple chances to work with our Technical Support Team, to prevent any fees in case the issue was minor as stated in the agreed upon policies, but he refused and requested to return the unit.

The fees were applied accordingly and were based off the Inspection Report that was also email to the customer.
