Our roof was replaced by cmr in after ****, they charged ****** for roof replacement. Including a warranty which they claim is void after another named storm in the area. I called my insurance company and they said the damage was not storm related and I took photo before the storm. They refuse to even look at it . Buyer beware , they are so nice til the second you hand over the check and boom, your the enemy. I would recommend any other roofing company,. They even threatened to turn me in for insurance fraud, because they couldnt find a door permit. Which had nothing to do with them. And they didnt pull a permit to install a skylight and had to remove it. So lots of bad karmaCustomer Answer

On 9/24/2020 we hired CMR Construction and Roofing to assist us repairing *************** damages sustained by our home from a Hurricane. They came in evaluated and documented the damages and aided in submitting our claim to the insurance company. Our insurance company ****************** Property and ******************************** originally denied the claim, and, after going back and forth we finally settled in Mediation on September 12, 2022.During the mediation the Mediator stated that the amounts for repairs were not realistic and inflated. Our attorney explained that *** does this to help get to a realistic number when negotiating with the ****************** We have already received three additional estimates just for the roof replacement/repair so we can compare and none are at the amount asked for during mediation. We now have the settlement money for *** to do the repairs for our home. The settlement check must be signed off by both homeowners and ***. We asked *** to give us a current and accurate estimate for the interior and roof so we can start repairing our home. It has been almost four months and we have been unsuccessful in getting anyone to answer where we are on our claim #******. We initially spoke to ********************* from *** weekly to find out our status. He finally let us know that he has been waiting to hear back from *************************** from his corporate office. He is unable to reach.WE made calls to the *** office, ********************* and others and have left many messages and cannot get a call. WE also sent an email on 11/29/2023(we are resending today in a certified letter) to get an answer, but, no one will answer us. We are desperate and need *** to honor their commitment and do business in and honorable and professional way to repair our home.These has turned out to be a customer service nightmare and now are reaching out to the Better Business Bureau to please assist us in resolving this matter in a timely manner.Business Response

CMR and the customer entered into an agreement that stated the scope of work and pricing would be based upon the insurance settlement. The customer has prevented the project from moving forward by attempting to renegotiate the terms of the agreement, after the insurance settlement was awarded. This is beyond CMRs control, and a breach of the terms of the agreement. CMR is not aware of, nor is it CMRs practice to provide inflated or unrealistic estimates, and if this were the case, it is highly unlikely that an insurance company would knowingly overpay a claim. CMRs pricing is based on usual and customary pricing contained in industry standard property loss estimation software systems, commonly used by insurance adjusters and property loss restoration contractors. CMR has informed the customer of the steps to move forward. The customer has declined to follow those steps, and therefore the work has not commenced. The pathway forward is for the customer to execute the relevant forms to enable the permit to be pulled and deposit funds paid to CMR.Customer Answer

I am rejecting this response because:We are getting very fustrated. We hired *** because the *** representative and ** agreed that *** will replace the roof and fix the interior of our home. Recently we were told *** is replacing the roof but no reference to the interior of the house. We do not know what will be the complete scope of work to be done for our home from ***? We have been trying to get the answer to this question. We have asked and left messages with *** but no one has tried to contact us. Our agreement was *** would fix our home - no renegotiating. We need to know ..IS *** replacing the roof and fixing the interior as agreed with the *** representative??
What kind of work is going to be done to the house because the Bank wants to know the scope of repairs that will be completed?

It is not our intention to ignore or avoid this customer, and so if there has been a lack of communication on our part, we apologize. We were able to connect with the customer today to schedule a time to discuss the scope of work tomorrow,February 8, at which time, we are hopeful for a resolution.
Regarding the scope of work, please know that this is not, and was not determined by CMR. This customer was represented by an attorney firm that they retained directly, and so the customer and the attorney made the ultimate decision to settle with the carrier, and then notified us (CMR) of what that settlement included. In this instance, the customers legally and directly retained council contacted us and asked if we could install the roof and gutters for X$? We responded that "even though this offer is significantly lower than our original estimate,we want to help this customer get their roof and so we would agree to complete the roof and gutter for that settlement price, plus the legally owed deductible should they decide to accept this settlement.
Note that this was the only option brought to us, and there was no mention of interior repairs. We lowered our expectations and ultimate profit in order to assist this customer obtain a roof now, instead of fighting the carrier for months more. We should not now be punished for trying to help the situation. If interior repairs were important to this customer, they and their attorney should have continued with their insurance company until such time that all of the requested repairs could have been addressed.
Our hope is that this customer will recognize that we just want to do the job that we agreed to, based on the offer that the customer's attorney brought to us. It is not our fault that the settlement did not allow for more repairs. It is important to understand that CMR has no settlement authority in these situations. Any settlement reached between the insurance company, the customer and the property loss attorney are completely subject to customers approval.Initial Complaint

A CMR representative came to our door on January 2021 to file a claim with our insurance to get our roof replaced. I signed all the contracts over on February 2021. After several inspections, our insurance company denied the claim and CMR had an attorney file the litigation. It's December 2022 and the attorney has advised me that the court date is scheduled for September of 2023. Meanwhile, our insurance company dropped us and will not not renew our policy unless the claim is closed and the roof replaced. I have called several companies for new coverage and no one wants to write a policy with an existing claim/litigation. I am now paying bank assigned insurance and my mortgage is now $1000 extra a month. At this rate, foreclosure is imminent. I want to get out of this contract, repair the roof and close the claim so that I can get insurance. This is destroying my family's well being.Business Response

CMR was engaged to replace my roof in December 2020. I had water getting into my dryer vent and in my living room (both of these areas are under flat roofs). The other areas are all tile roof. They told me about all the great things they were going to do for me. I submitted a claim with my insurance, which included an estimate from CMR for the replacement of everything wrong with my house, inside and out. Of course the insurance company denied the claim. They then engaged a law firm they partner with to file suit. Fast forward to March 2022, everyone agrees to a price to complete the work. I have to pay CMR $36,000 to complete the work ($33,500 from the insurance company). Finally after many delays, extremely poor communication, and poor planning, a crew showed up on 11/7/22 and tore off my tile roof, but did not touch the flat roof areas or the rotten wood around my eves. I told the ******* that was part of the job also and showed him the estimate sent to my insurance company from CMR. He agreed and said a crew would be back as they had to order the material. That never happened.After MANY attempts to reach my rep ***** he finally had my tile delivered over a month later. Now they will not proceed with installing my tile until they receive a 50% payment, and they are telling me that the flat portions of my roof were not included in the approved estimate even though this is where I had all the water intrusion and was submitted to my insurance company. To boot, the payment agreement states that the 50% payment is due once "Dry In" is completed. Since my flat roofs remain untouched with rotten wood hanging under my eves, that certainly is not complete. I just want CMR to complete the work they agreed to do. I have all funds available and ready to disperse, and will not do so until they reach the terms of our payment agreement. Meanwhile, my home remains roofless since 11/7/22 and is at risk.Business Response

The project manager and the homeowner have been in communication. A resolution will be forthcoming after the homeowner gets back with us after the 3rd. The reason we are requiring 50% payment even though the flat roof and rotted wood there are not addressed, is because the flat roof area was not accounted for in our original estimate to the carrier and it was not included in the settlement with the attorney. I have given the client multiple options to fix that area, of which he has not given us direction on that. We are awaiting that decision from him. I am rejecting this response because: The initial estimate sent to the insurance company from CMR as part of my claim, did in fact include the flat roof portions of my home. The flat roof areas are where all of my water intrusion occurred and where the rotten wood is that was referenced in the reply. In previous emails, ************************* inferred that the previous roofing company did not install something correctly and that is why i have all the rotten wood beneath my flat roofing. Well if that is the case, then it should have certainly been included if my roof were inspected correctly.However, the story keeps changing. Initially, *** told me that the flat roof was included in the initial estimate, but was not part of the official settlement. I informed him that I never approved any change in the scope of work and that at no time would that have been an option because that is where all my water intrusion was happening. I asked him for a copy of the approved settlement on the scope of work he referenced, but one has not been sent.
I have included the email back and forth, from myself, ****************, and *****************. The initial estimate (including the flat roof) was attached on my initial complaint. I am hopeful that CMR can agree to fulfill their commitment to me and complete my roof as promised. As for payment, I informed CMR that they could send their runner by for the 10% payment. Which is all that is due because the full dry in of my flat roof has not been completed. So far, no one has come or even tried to schedule.

The roof was started on September 17th 2022. At that time, we installed the first layer of the underlayment. The second layer was installed on September 24th 2022. The Polyglass self adhesive membrane has 180 day exposure rating. This is designed to withstand the elements in the timeframe of the tile getting released from the manufacturer. Our industry is experiencing supply chain issues that can delay tile production and delivery. That is the current situation we are dealing with right now with your project.
In additional getting the decking replaced that has stains. From the notes of the sales **** ************************ he spoke to ***************** on 12/05/22 regarding replacing the stained decking. This was in motion to get addressed. The crew had attempted to fix this area a few times prior to this, but the house keeper wouldn't let them in the gate. To our surprise the sales rep **** received a call from **************** on 12/06/22 telling CMR to stay off the property until further notice. CMR has already agreed to complete the wood replacement of the decking. We are still honoring this and would like to get this completed as soon as possible. Right after the unfortunate hurricane ***, CMR sale representative **** showed up at my house in ********** **. They offered me to check my roof for free so they can give an estimate. I let them and of course the said I would need a new roof. They have signed some documents saying that they can the fight with the insurance company because they lawyer ********. A couple days later i decided to hire a public adjuster and called CMR to cancel them. They forced me to sign an AOB which o had no idea what was it. I should never signed anything because I felt pressured to sign everything. They even wait for almost 2 hours outside my house so my wife can also sign. BAD FEELINGS!. A couple weeks later my insurance company says they need an email from CMR saying they no longer representing us so they can move on with the new adjuster. **** tell me he cant send the email. He has to be his supervisor ***** in *********. I called ***** and he said he cant send the email and give me Arriene contact to send the email. Its a nightmare because now no one pick up their phone. This is very frustrating! I should never hire CMR if I knew they were so disorganized. ALL I NEED FROM CMR IS TO SEND AN EMAIL TO MY INSURANCE SAYING THEY ARE NO LONGER REPRESENTING ME. Its been over 2 months I can even receive a check from my insurance because of CMR. CMR completed my roof replacement 3 months ago. When final payment was requested, I was informed that as soon as the check clears, they would forward me closing documents and the warranty. To date, I have not received either. I've made several attempts to call, text and email to receive these documents and have not even been afforded a return call, text or email to explain why I have not received these items. I've left messages with the local office, with my sales rep, and for any manager to please respond to my inquiry, to no avail. All I want are the documents that were promised to me.Customer Answer

I have had horrible service. I was told I could get a new roof or there would be no cost for trying. unfortunately I believed them. First mistake on my part they referred me to a lawyer ** was supposed to represent me. I got a settlement for $30,000 the lawyer got $10,000. Never let this company refer you to a lawyer its a trap. My roof had a minor leak which I repaired. They put a tarp on my roof without disclosing the cost and charged me $2000. that did not sit well with me at all I found another company that will do my roof with better quality materials for 26k versus 30k for CMR. They need to take off the 2k for tarp that was never disclosed to me. I asked for a copy of the contract that I signed which I never got. Instead they sent people out to remove the temporary cover which my service rep admitted that he requested them to do so they can charge me again. I shut that down. I spent a week trying to get the check endorsed Now they are refusing to endorse the check even though the lawyer they referred me to made me sign a agreement giving them 25 percent of 20k plus 2k for the tarp. This is the worse experience I have ever had I will not ever sign anything I don't have a copy of and a lawyer I choose hasn't looked over. I called my rep no call back. They just keep throwing new terms at me and refuse to give me a copy of the signed contract. Now they are saying I need to a notarized affidavit of cancellation of a contract they have refused to send to me. I have attached the agreement I was pretty much tricked and coerced to sign. They wont even sign the check so they can receive their ill gotten money.Business Response

We are very sorry to hear that this customer does not believe that our efforts and services have been beneficial to him. We will try to address each of the customers' issues/accusations individually.
1. CMR never promises anyone a new roof, we explain the process, and can share other customers success rates, but ultimately the claim is determined between the customer (homeowner), their attorney, and the insurance company, and so we can not promise anything since we are not a part of that decision making *********. Further, by this customer's own admittance he has not lost money in this endeavor, but just not made as much as he and we hoped (but to be clear, he will net a profit from this process and so this did not cost him as he is claiming)
2. The customer's decisions with their attorney determine/determined how much effort and time the two of them wanted to spend in suit, and how much money they ultimately received from your carrier. CMR had no authority in this settlement decision.
3. Regarding referring an attorney, I would remind this customer that we have proof (in writing) of where we explained that they could utilize any attorney in FL, and then we even provided the number to the FL bar association so that they could obtain a registry of FL Attorneys. We can not speak to the fees charged on this file by this attorney, as we are just a roofing company and have never seen the retainer signed between these two parties.
4. The tarp that the customer mentioned was installed onto the roof to stop a leak that he had made us aware of while standing in his bedroom. The bill for the tarp was tied into the claim, but since this
customer has decided not to work with us after the claim was resolved the cost of the tarp reverted back to him.
5. We are happy this customer was able to find another reputable roofing company willing to work with him. However, since we never discussed materials and building practices with him, we are not sure how he would know that they are using better materials than us?
6. We are aware that this customer requested copies of the contracts he signed, and we have email records indicating two separate copies have been sent to him in a timely manner along with the hardcopy that he was given when he initially signed up to work with us.
7. The accusation that CMR sent out crews to work on this home just to increase the invoice is outlandish and false. CMR repair crews work 7 days a week and generally this is a losing proposition for us. They are a necessary portion of every roofing company, but they are not in place to make profit, on the contrary, this division loses money for us and we do not send them out frivolously or to try to pad an invoice.
8. We also have phone records of calls between customer and the sales rep along with our billing department explaining how we will endorse the check and have this matter resolved quickly.
9. Lastly, the claim that someone has tricked or coerced this customer into signing a contract with us is false. We recall this customer being very excited and glad to work with us and was even recommended to work with us by a friend of his. We are sorry that he feels this way now, as we only had/have the best interest and hopes for him.Customer Answer

CMR has had a contract to replace my roof since June 2021, 17 months ago. Because there was litigation with AAA, the settlement did not occur til September 2022. I received a check the week after Hurricane ***. It has a 90 day limit, and is made out to me and CMR. I have called numerous times to try to get a date set for replacing the roof, and first of all, tarping the roof. They do not return my calls, neither from the office, nor from their contact in ******* whom I talked to numerous times over the past 17 months. 5 weeks after ***, they sent a subcontractor to tarp the roof, which I could not wait, so hired another company to do because I did not want further water damage from rain.I have called, written to their contact, to no avail. I contacted the lawyer that did the claim work. That did not work. I am not asking that they do the work immediately, but need to set up some resolution before the check runs out of time. It would seem that since I already have the bulk of the money, they would be more than happy to honor their contract with me. Since they sent a subcontractor to tarp the roof five weeks too late, I should think they would consider subcontracting the roof replacement to someone able to do it within the time factor that will run out in December, or the beginning of January. I have contractors knocking on my door everyday, but cannot subcontract myself unless they assign the work to someone. It is unconscionable that this reputable com[any cannot even call me back to discuss the dates and/or alternate resolutions.Business Response

When hurricane *** hit, we were inundated with emergency repairs. We apologize for the delay. We are currently in contact with the homeowner. She is looking at available ************** and is hoping to pick one by 11/22/2022. As soon as that has taken place we will submit the job into production.
