I'm submitting this formal complaint regarding an account being reported by Sun Loan, account number *******, opened on 08/01/2023, with a balance of $843.00, currently showing on my Equifax credit report. I have made multiple attempts to have this account properly verified, and to date, I have received no documentation or explanation substantiating its accuracy. This is unacceptable, as it directly violates my rights under the Fair Credit Reporting Act (FCRA).According to 15 U.S.C. 1681i(a)(1)(A), consumers have the right to a reasonable reinvestigation of any disputed item on their credit file. Furthermore, under 15 U.S.C. 1681i(a)(5), any item that cannot be fully verified must be deleted. So far, ******* has failed to meet this obligation in regard to this Sun Loan account. I have not been provided with any original documents, signed agreements, or detailed account records that would legally justify the continued reporting of this charge. Moreover, recent findings by the ************************************ (****) have highlighted systemic failures by ******* to conduct real investigations into consumer disputes, often relying on automated responses and unverifiable third-party data. That has been my experience as well. Ive been left to chase vague explanations without receiving anything concrete that proves this account is legitimate or that I am even responsible for it.This account continues to impair my creditworthiness and has had real-world consequencesfrom loan denials to higher interest rates. Unless Sun Loan and ******* can produce clear, original evidence supporting this accounts validity, I am demanding its immediate removal. If no action is taken, I will escalate this matter to the ***, ****, and other regulatory agencies, and I am prepared to pursue all remedies under 15 U.S.C. 1681n for willful noncompliance with federal law.

On January 31, 2024 Ms. Moreno took out a loan for $640.00 at
the Sun Loan Weslaco, TX office, which called for a total payback of $80.00 per
month for eight months. Although multiple attempts to reach Ms. Moreno were
made by the branch, no payments were received and the loan charged off on
August 4, 2024. We have provided a copy of the original application, signed
contract, and a copy of the payment history along with or response. Included are
copies of Ms. Moreno’s identification card, IRS Form W-2 and a paystub, all
supplied at the time of loan origination.
To date, we have received three disputes from Equifax and
each dispute has been reasonably investigated and responded to in the time
frame allowed by the Fair Credit Reporting Act (FCRA). In each instance, it was
determined that the disputed information was accurate and account information
unrelated to the dispute was updated accordingly.
We have also reviewed the reporting of Ms. Moreno’s loan and
found that TransUnion and Experian are not reporting any credit data and Equifax
is correctly reporting the loan in a charge off status.
If Ms. Moreno has any questions or if she would like to settle
her account, she can contact Sun Loan Corporate office by calling 210-735-9393
and request to speak with Maria Ortiz, Compliance Manager.

I called to file a complaint above my account being double charged and that because of this issue my bank has put me in the negative funds because of their mistake. I called and spoke to a manager at sun loans and explained that I already had made a advance payment but she told me I could not get a refund due to their policy I asked if that was the law and said no its only their policy. Ive been doing business with them for over a year and never missed a payment but because their policy states weather or not you make a payment in advance ! I was lied to any a double charge occurred! I tried to resolve it by telling them I have my invoice showing double payment but with no regards to being on dial ability this coming refusal to return my double payments show that they are inconsiderate for people with mental illness!

Mr. ******* received a Live Check offer dated May 27, ******* Mr. ******** complaint, he explains that he did not request a loan with Sun Loan. The Live Check offer Mr. ******* received was a prescreened offer, as noted at the bottom of the check.

Live Checks are firm offers of credit that are mailed to potential customers whose credit profiles meet specific criteria. Their information is provided to Sun Loan by the **************; in this case the information was provided by **********. Each ************* does provide its customers with the option to Opt-Out from receiving prescreened offers of credit. On the back of the Live Check offer is a PREESCREEN & OPT-OUT NOTICE for customers who wish to opt out of prescreened offers. A toll-free number is also provided on the front of the offer.

Ms. **** states that there is no contract between herself and Sun Loan and that we have failed to provide the original agreement as requested. We have not received any prior requests for validation or documentation. We have provided a copy of the application, signed contract, identification, and audit trail showing she viewed and signed the contract along with our response.
We have reviewed the Sun Loan credit reporting of Ms. ***** loan with Equifax, Experian, and ********** and find that the account is correctly being reported as current, and it would be inaccurate to delete the information as Ms. **** has requested.

I received a notice that I have a collection from Sun Loan on my credit report. It says it was opened on 2/29/2020 for $2,702 with account number starting in 1**** that I am not aware of nor am I responsible for. I never went into business with this company or signed any agreements with them so they should not be reporting anything on my credit. This is a violation of my rights as a consumer according to the **** and *****.

On February 29, 2020 Mr. ****** took out a loan for $1,780.99 at the Sun Loan branch office in *******, **, which called for a total payback of $137.00 per month for 13 months. Over the course of the loan,Sun Loan communicated with Mr. ****** on multiple occasions, but ultimately only two payments were received prior to the loan being charged off on October 31, 2020. We have included copies of the signed contract and identification with our response.
Because the address provided at the time Mr. ******* loan was made matches the address provided in Mr. ******* complaint, we have no reason to believe that any notices mailed to him by the Sun Loan branch were not received.
Between September 15, 2021, and December 19, 2024, Mr.****** has submitted a total of 17 disputes to Experian, Equifax, and **********, claiming fraud in only three of those disputes. Several of ********** disputes directly to the credit bureaus during this time did contain documentation which was reviewed during the investigation of each dispute submitted. Each dispute was responded to accordingly and within the timeframe provided by the Fair Credit Reporting Act (FCRA).
We have reviewed the reporting of Mr. ******* loan to *******, ********, and ********** and find that the loan is being reported correctly as a charge off. We believe that the loan does belong to Mr. ****** and therefore it would be incorrect to delete the information as Mr. ****** has requested.
If Mr. ****** has any questions or if he would like to settle the account, he may contact the Sun Loan corporate office at ************* and ask to speak with ***** *****, Compliance Manager. If Mr. ****** would like to request and submit a copy of our Fraud Affidavit, he may contact us directly by emailing *********************** or by mailing his request to **************************************************.

On April 14, 2025, Mr. ******** applied for a refinance of his loan at a higher amount with the Sun Loan branch in *********, **. This increase called for a total payback of $155.71 for 36 months. With this refinance, Mr. ******** received $66.62 in cash. Upon approval of the increase,Mr. ******** was provided a copy of the contract which he signed. The contract provided the terms of the loan, including the amount financed, all applicable fees, monthly payment and duration of the loan.
According to notes in Mr. ********* account, he did not express concern until later on April 14, 2025 after the branch office had closed. He was advised to return on April 15, 2025 during normal business hours. On April 15, 2025, Mr. ********* spouse contacted the branch and requested that Mr. ********* loan be reversed. Mr. ******** personally came into the branch on April 15, 2025 at which time he was advised that approval to reverse the loan, would have to be given by the Regional Manager, per Sun Loan Company Policy. On April 16, 2025, after review of the account by the Regional Manager, it was decided to reverse the refinance and Mr. ******** returned to the branch to complete the reversal in person.
The District Manager reviewed the Sun Loan Operations procedures with the Branch staff and confirmed the proper procedures were followed at the time of the refinance.

I hope this message finds you well. I recently reviewed my credit report and discovered an error indicating that I am a victim of identity theft. I have attached copies of the relevant reports and supporting documentation for your reference. The following account does not belong to me:Creditor: Sunloan Opened Date: 12/18 High Credit Amount: $300 Balance: $846 While I did use your services for tax preparation purposes, I have never taken out a loan with your company. I believe this account is fraudulent and that my information was used without my consent.I have repeatedly explained that I am a victim of domestic violence, during which my personal credentials were stolen. As a result, I had to obtain a new Social Security card, passport, and drivers license. I have also experienced multiple data breaches through services such as Equifax and TurboTax, which may have contributed to this erroneous charge.Despite my efforts to clarify these circumstances, I have not received adequate assistance from ******. I have repeatedly requested documentation and proof of their claims, but they seem either unwilling or unable to provide the necessary information to resolve the issue. This lack of support is especially frustrating given the trauma I have already experienced.I kindly request that you investigate this matter and remove the fraudulent account from my credit report, as required under the Fair Credit Reporting Act (FCRA). Additionally, I would appreciate it if you could provide me with a confirmation letter stating that this account has been removed from my credit history.Thank you for your prompt attention to this important issue. I look forward to your response and a swift resolution of this matter.

On September 1, 2018, ******* ******** took out a loan with Sun Loan located in ***********, ** in the amount of $201.49. This loan called for a total payback of $45.00 for 5 months with a final payment of $44.98. *********** made a total of three payments of $45.00 each before refinancing the loan on December 12, 2018. The refinance was in the amount of $300.00 and it called for a total payback of $67.00 per month for 6 months. No payments were received on the loan. The loan was charged off May 31, 2019. At the opening of the original loan on September 1, 2018, along with ID, copies of 4 check stubs were provided, along with a copy of a benefits statement, bank statement, signed application and contract. We have included copies along with a copy of the signed application and contract.
Over the duration of the loan, the branch office made contact with Ms. ******** on multiple occasions in which she made promises to pay, but no payments were received. We have received 2 credit disputes, one from ********** dated October 5, 2020, and one from Equifax dated November ******. Investigations were conducted in both instances, and it was determined that the loan does belong to Ms. ******** and although information pertaining to the loan was updated at that time, it was determined that the disputed information was accurate. We have not received any direct disputes from *********** directly to our corporate office.
After reviewing the loan documents, we have determined that the loan is not fraudulent. We have reviewed the credit reporting and determined that the information is reporting accurately, and it would be incorrect for to us to delete the account as Ms. ******** requested in her complaint.

      i reject

I am writing in response to your recent email regarding the loan account for ******* ********. I would like to clarify that this account does NOT belong to me, and I am NOT responsible for this loan. I am requesting that this account be deleted from my credit report immediately due to the inaccurate information that has been reported.

Under the Fair Credit Reporting Act (FCRA), all information reported to credit bureaus must be accurate and verifiable. If an account is reported in error, I have the right to dispute it and request its removal. I have reviewed the details you provided, and I can confirm that I have no connection to this loan and should not be held responsible for it.

Additionally, the Fair Debt Collection Practices Act (FDCPA) requires that creditors ensure they are not inaccurately reporting information that may harm a consumer's credit standing. Since this loan is not mine, continuing to report it as such is a violation of both the **** and the FDCPA.

I respectfully request that you remove this account from my credit report as soon as possible. If this matter is not resolved promptly, I will be forced to take further steps to protect my credit and report this issue to the appropriate authorities.

Please confirm once the account has been deleted.

Thank you for your immediate attention to this matter.

I called on 12/30/24 to inform Sun Loan that my husband's payment (that was due in 12/19/24) would be paid on 1/2/25. The lady on the phone said she would put us down for payment but that it would be reported to the credit bureau. I asked her why that was since the payment would only be 14 days past due. She couldn't provide an answer other than "the payment is late". If it't not 30 days late, why is it being reported as such? How is that legal. I decided to check my report. The same company reported me 30 days late in July. This caused a denial in a consolidation loan I was trying to get to bring my payments and interest lower.
