    My custom motorcycle my father had given me was towed. Im unemployed do to illness and let this establishment know my situation and told them I was waiting on a large check to come in. It was probably going to be past the 30 days in which they can put motorcycle in public sale to take care of storage fees. I continued to stay in contact and it was 2 weeks after the deadline when my check came in the mail. So I called them to pay all my fees and they still had possession of the motorcycle but the girl working had to call owner ********************* and he told her that he now owns the bike and he doesnt want to get rid of it. He clearly is unethically trying to keep my motorcycle for himself and would not allow me to pay him $2,100 so I could get back something that means the world to me being that my father gave me the motorcycle. The only thing he is suppose to be able to do is sell it to recoup the $2,100 and its worth way more than that and he suppose to pay me anything it sells for over the $2,100. This is bad business and flat wrong.

    Good afternoon,

                    This email is in response to the below complaint with the ** number of ********.

    As ************ has stated, Herreras Towing & Recovery towed a **** Harley ******** motorcycle on 9/10/23 around 9:30 PM. This motorcycle was towed at the direction of ***** ***************** because ************ was operating the vehicle on a public roadway with no insurance and driving while his license was invalid, along with expired registration. My company was contacted by VPD dispatch to tow the vehicle based off of a city rotation list. ***** ********** of ******* and Regulation requires that a Vehicle Storage facility send a 1st and 2nd notification to the current registered owner (which is not ************) The first and second notices were sent according to TDLR state rules. 30 days after the 2nd notice is sent, it is then put through a public auction, which was explained to ************. It is generally 45 days that we have vehicles before they then get a storage lien and we acquire ownership to said vehicle. We actually gave ************ 5 extra days after the date in which we took possession via storage lien, to get the vehicle, making it a total of 50 days to get said vehicle out of impoundment. We followed state rules and obtained the vehicle lawfully. We are regretful that ************ feels as though we are being unethical, but the fact of the matter is, we followed the law, did our job within our state regulated guidelines and regretfully, he did not get the vehicle out in the timeframe that was laid before him by law, and an extra week on top of that. We apologize for any frustration this may have caused him but we simply do not make the rules, we just follow them.
