We paid for ERC Specialists to file our forms in February 2023 and paid the 10% upfront. We learned in July that they had filed our forms wrong and had to redo the forms. Because of this and the time of it the IRS had slowed payments and likely not issuing at all.
We have asked repeatedly to take back our initial 10% fee of $22,116.63 and switch to the 15% fee once we receive the check from the IRS. When we refilled in July 2023 they should have offered this solution to us but never did. We need this money back right away.Initial Complaint

Our business sought out ERC Specialists for our ERC refund after businesses who took the PPP Loan were eligible. The amount of money they said we would get was not true and we had a $64K difference to the less. While trying to figure out what was (and still trying to get everything straightened out) going on between the IRS and ERC, they repeatedly call the business, send text messages saying they are still going to get the money, and request payment for money never received. This company falsely advertises and has taken advantage of the small businesses trying to keep afloat following the pandemic and during the high interest rate and inflation periods.Business Response

******* *******please note: our business HAS NOT benefited from nearly $100,000 in tax relief per our accountant. In addition, your company has bilked many small businesses out of fees for funds they have not received WITHOUT notice to the consumer and should be considered for a Class Action Lawsuit under regulatory advertising practices through the Federal Trade Commission. My company taxes were paid 100%. Forms were filed with the IRS and our lawyer within the last 30 days correcting a federal mistake. To harass and threaten us via text, phone calls, etc is NOT OKAY!
When and if we get the remainder of our credit, we will be in contact.

July 2022 I entered into an agreement with ERC Specialists to obtain my employee retention tax credit. The paperwork they sent to the *** was wrong resulting in a 30K tax lien. I also have not received all my payments from ***. I have repeatedly called and emailed ERC and have been put off. They are also overcharging me based on their new calculations. I want them to stop bothering me and get this tax lien cleared up and get me the rest of the money the *** owed me. However, I did hire another CPA to get the tax lien cleared up since ERC will not do it. I want the contract voided.Business Response

I Started with a co. called Build&Fund for the Employee Retention Credit and was working with Sara U**** who advised me of the terms which were I could pay a 10% upfront fee or a 15% fee once the funds were received, I then worked with a Jonah C******* from the same company on May 18th gathering the info needed. I then was sent an Email by ERC specialists on July 3rd who somehow had all my info I provided with Build&Fund in which I was apprehensive and thought I was being scammed because of the personal info that was given to them from the previous co.. I called the # on the email from ERC and spoke to a Mark who explained that Build&Fund is an affiliate and that ERC is a legitimate Co. and asked about the terms and he clarified the same terms as Build&Fund. I then received an email from a Selah on July 6th who is a support specialist from ERC. I then felt confident to proceed to work with them for the refund. I received an email on From ERC on July 20th that I was approved and to sign the agreement through Docusign. Once read there was no option for the 10% fee only the 15% fee, I then emailed this morning the 21st for someone to call and discuss the agreement. I received a phone call around 1 pm eastern time and it turns to be a follow up call and the rep. basically advising that it was a special the were doing and it began June 8th and I in turn explained what I am writing (once aging I started on May 11) and was told that I can cancel if I don't agree, I asked for supervisor (Van O****) who basically stated the same thing and during the conversation he was going to look into it and the same time of cancelling if I don't agree. I am a small business owner in NJ and still recovering from the pandemic. I can provide emails through this whole process. Thanks for your time.Business Response

Thanks so much for your email. I sincerely apologize for any frustration you may be feeling towards our change in policy.
With the guidance of our Advisory Board, we implemented a policy change to our processing fee. This change took place on June 8, 2023, removing the option to offer a "Pay Now" (10% discounted rate) as opposed to our standard 15% fee (due upon receipt of funds). Once the policy was implemented, it required changes to our billing process.While we understand that change for both our customers and affiliates can be impacting, we strive to improve our processes and aim to follow the guidance of our Advisory Board. I apologize, but unfortunately, we are unable to make an exception on our fee policy.

This company misrepresented themselves in regards to the Cares Act Employee Retention Credit.
We followed the process completely and they disqualified our company based on “Unresponsiveness.”

Thank you for bringing the complaint to our attention. We appreciate the opportunity to respond and address our customer's concerns.
We acknowledge that there may have been issues with our communication. I do have on file multiple emails that we sent to the client requesting the missing documents or an explanation of the lack thereof. However, we would like to clarify that our disqualification of the client's company was not due to "Unresponsiveness," but rather the lack of necessary payroll tax forms required by the IRS.
After reviewing the details of the complaint, we understand the importance of improving our communication and client experience. To this end, we have taken several steps. We have created a client portal where they can make notes on their account, create a support ticket, or upload the required documents for the claiming of the **** Additionally, we have added a phone number for clients to reach out to us directly.
We have reached out to the client via email to discuss how we can move forward in the process and address their concerns. We hope to work together to find an amicable resolution.

Dear Better Business Bureau,
I have personally contacted **** in an attempt to resolve any issues, and I provided our main support line for further assistance. Upon reviewing the uploaded documents, it has come to our attention that the only employees listed are **** himself and his family members. In the questionnaire we provided for them to complete, **** mentioned himself and another family member as well as either being owners or relatives of the majority owner. Those were the only two names provided on the payroll documents.
Based on *** guidelines, this makes his company ineligible for the Employee Retention Credit, as the majority owner (holding 51% or more ownership) and their relatives' wages are not eligible for the credit.
Given this information, filing the credit on his behalf would result in non-compliance with the *** and the US Treasury. As a result, we cannot proceed with filing his request for the credit. We sincerely apologize for any inconvenience this may cause.
I have personally reached out to **** via email, with no response. Our primary focus is to ensure 100% compliance when claiming the Employee Retention Credit for clients, and we hope this resolves any outstanding concerns.
