Hello.
I took out a loan and due to not being able to pay my loan has gone from $500 to well over $2000. They have also contacted my employer for wage garnishment *which needs to stop*. I am just getting back on my feet after hospitalization and I am willing to pay $80 every 2 weeks until debt is paid, but with no interest charges over $200. Please advise.Business Response

Regarding Ms. ******’ concerns about the balance of the account, at the time the loan was agreed upon, the Company provided a loan agreement which clearly stated the amount of the loan, and the total cost of the loan, should it be paid back in accordance with the loan agreement. At the time of the loan agreement Ms. ****** executed a Voluntary Wage Assignment. When the payments are missed, the Voluntary Wage Assignment process begins.
We have processed a revocation of that voluntary wage assignment. The Company also contacted Ms. ****** and agreed to repayment plan of $80 bi-weekly payments on a settlement due amount of $970.96. The payment agreement already established with Ms. ****** is a $25 good faith payment and then $80 bi-weekly payments until the settlement amount is paid in full.

For the past 6 months I have been receiving constant, daily emails and phone calls regarding a debt that Check Advance USA states I owe. I have many saved emails from them where I have responded requesting the validity of this debt (name, date of service, amount owed, fees charged, etc.) No response as of today 12/6/24. I have also had my Attorney send over our Chapter 13 Bankruptcy paperwork where, when the harassment started, we requested more info, made sure this company was included in the case, and still no response from the company. I then began responding back to the company of this information and stated it is unlawful to collect on a debt that is included in a Bankruptcy, still receiving emails and phone calls. When will this end??? With every email it has a different amount owed and now I am concerned it is a scam?Business Response

Regarding Ms. ***** concerns regarding not owing a debt to the Company, and that she filed a Chapter 13 Bankruptcy, included in our response is the loan agreement establishing the loan. Regarding the Bankruptcy that was filed, we have located the Chapter 13 Bankruptcy, case number 19-03904, filed on 05/29/2019. The account was opened on 10/19/2021, and we have followed up with the trustee and our account is not included in the bankruptcy filing. In fact, the account was opened after the bankruptcy was originally filed. We have also searched for any amendments to the bankruptcy, and found no amendments being filed either.
Per Ms. ***** account history, at one point Ms. ***** was working with debt consolidation company regarding this account, and the arrangements that were given were never completed.
Additionally, any documents regarding her account with our office will be available by logging into her account online, available through our website.

I was injured at work which the injury and the side effect have taken a large toll on my health and has caused me to miss a lot of work. CAUSA contacted me that my first payment did not process. They informed me that they would add that payment onto the end of my loan of originally 400$ as of today 10/18/24 which is less than 1 month from the original date of loan I owe over 652$. I contacted the company after receiving a text and email stating they were going to wage garnish me. They stated if I paid this one today I would not get wages taken but I tried to inform them of my very serious injuries, now I have received another email stating they are going after wages and I have not gotten any court paperwork at all. In March 2024, I took out a $500 loan because I was in desperate financial need and not reading into the high interest rate. In the state of Nebraska, where I reside, the cap for any 'payday/cash advance loans' is 36% APR. Also, any lenders in Nebraska must be physically located there and any online cash advance lenders are considered illegal. This company has sent a wage assignment to my employer which should never have happened. I believe that there needs to be a court order in the county/state where I reside for that to happen. They are now wanting over $2000 from me and the APR is over 800%! I do not believe that I should have to pay this, I want them to dismiss the wage assignment from my employer immediately! I have a loan from the above lender. My bank account was compromised at no fault of theirs. They have been harassing me through email and texts threatening to garnish my wages. I’ve explained the issues and asked for a lower payment biweekly and they are continuing to state that they want more than I can afford. And before this company responds, I did my research as well. I was not aware that this was a tribal lender until I found some information from the federal trade commission . Debt collectors cannot garnish consumers’ wages without a court order, and they cannot sue consumers in a tribal court that doesn’t have jurisdiction over their cases,” said Jessica R***, Director of the FTC’s Bureau of Consumer Protection. “Regardless of tribal affiliation, debt collectors must comply with federal law. our intent to send the Voluntary Wage Assignment to her employer. Upon receipt of this complaint, the Company
has revoked the Voluntary Wage Assignment and will not be sending this to her
employer.
Regarding Ms. ********** not being aware that the Company
was a tribal lender, Ms. ********** acknowledged that she was aware that the

account portal on our website.

7/5/24, 7/19/24 and 8/2/24 and then starting 8/16/24 their will bi-weekly
payments of $80.00 until the balance is paid in full.

I contacted the company because I was not able to afford my payments on an $800 loan I took on 4/18/24. They have constantly harrassed me through emails and phone calls, threatening to garnish my wages if I didn't respond within 15 days. I responded to every email they sent me. Once they finally started to respond to me, the best they could offer me was $130.00 every two weeks until the loan balance is paid in full but is STILL continuing to accrue interest. I asked for a payment schedule and they wouldn't provide it to me. I CAN NOT AFFORD THE $130.00 payment nor have my wages garnished either. In obtaining the verification documents required to complete the loan application it was discovered that ************** resides in the state of GA. *********** does not issue loans to residents in the state of GA, and therefore was decline a loan for that reason. I took out a $500 loan with CheckAdvance *** on February 5, 2024 at a very high rate of interest. I subsequently discovered that this company is not licensed to operate in the ******************* and that they are in violation of **********'s usury law (RCW 19.52.020), which caps interest rates at 12 percent. I took out a very high interest loan with checkadvanceusa. They were taking my payments every two weeks as agreed. As far as I knew they were still taking these payments, but I have been getting calls at my work and wage deduction was faxed to my manager. Regarding telephone calls being placed to her at her place of employment, the Company is ceasing any further contact to her place of employment. The current balance of Ms. ********* account is $1218.38, and the Company is willing to settle this balance for one payment of $183.13.

I applied for a loan online. I was approved for the loan, ready to fund into my account after I called to verify all documents were received. I even received a email telling me they are ready to go I just needed to call them to close the loan. When I called a woman named ***** told me the application has been denied based on someone else with the same address had applied previously and there is another application with the same address used.This makes no sense at all. Arent two people or more allowed to live at the same address and apply at the same company for a loan? Her response was company compliance? She refused to give me to a supervisor above her but gave me a phone number telling me I could call to another supervisor. This number connected me to an LCC company whom took only complaints, the man was not a supervisor for their company at all,he did take my complaint. I have never in my life heard of this We have different social security numbers,Different names, different everything except our address we share as we are roommates. To be crushed like this when you are told you are getting approved for a loan and take hours to gather all the information needed to only be told because someone else at the same address applied for a loan, Now you cant get one.This urges a response and a clear legal reason why this is not allowed. To say that 2 or 3 different people living as roommates cannot get a loan at the same company because they all live at the same address is outrageous! Beware, in this day and age when multiple people need to live together to make it. Dont apply for this company they will deny you if you all live at the same address and fill out an application. Wow! Regarding Ms. ******** concern about being denied a loan from the Company because of the address already existing on an application by a different individual, the application is being denied for ****************** due to the same address and phone number were used on two different applications. There was an application that was submitted prior to Ms. ******** which was evaluated on its own merits and the acceptance or denial of that application cannot be discussed in this response. Furthermore, the email address used for both applications identify ****, as does the phone number that was used for both applications, which is not the name on either of the applications.
As a financial lender, we have a requirement to have a reasonable belief that we know our customers identity. Due to the information listed above we are not able to approve the loan application for ******************* When this was attempted to be explained to ******************, there were statements made about discrimination. The decision is not based on discrimination,but rather based on not being able to have a reasonable belief in our customers identity.
