I called open sky on 8/2 to verify when payment will be released and they stated because it was late they payment will be relesed after 5 business days but also option to have released early as a 1 time courtesy. so i made a payment on 8/2 made a payment to Open sky in regards to reduciung balance. on monday 8/7 after i saw it cleared my bank i re-asked it would take to have released they said a statemnet showing my name and address the payment has cleared and also the remaining balance. i advised them i cant send an august staement because it IS august and that statemnet is not available so the regular customer rep said its fine and she gave me the fax number. this was at 8 am EST. I faxed the requested information over at about 12pm EST and then called at about 12:30 pm est and they said it was not acceptable. yet i stated everything was sent to them based on what the rep advised and they transferred me to a supervisor who went over i needed to fax over AGAIN. i asked that supervisor multiple times what i needed to send and what it needed to show. IN DETAIL for about 2 hours . (not once did she state it all has to be on 1 page and on 1 fax). So i sent over the info requested by that supervisor through fax again wasting another $10 so in total spending $20 to fax. i called AGAIN and asked if they received it and if it can be released they stated no because it had to be on 1 fax and on 1 document which is IMPOSSIBLE. as the fax machine messed up but also i dont have august statement. So i asked that supervisor for that policy that shows it has to be on 1 fax on 1 document as they were the only ones saying that and everyone i spoke to before did not state that. All the supervisors kept referencing that they have not had any difficulties with other customers which was feeling very discrimnatory as i am not like everyone else and i should not have been referencened to other customers and also not given false or mis information

The Information contained within the account and the account itself, is being reported inaccurately on my consumer report. Open sky has this account listed as a debt and this account is not a debt, this account has been charged-off and is listed as a charged off. The IRS Clearly defines a charge off, as Gross or Ordinary income, INCOME DOES NOT GET REPORTED ON THE CONSUMER REPORT. Which in fact makes this reporting of this account inaccurate! By Definition The IRS Clearly says a Cancelled debt or Charge off is Income. The reporting of this account as a debt is inaccurate. This information has been filed on my taxes, ask pre the IRS, and It’s publication. The lender must file form 1099-c and to send a copy with the amount of any debt cancelled and more in the lender is a financial institution, credit union, federal government, agency, or other applicable entity, as discussed earlier in chapter 1. The above paragraph is taken directly from the IRS 2021 publication. This report is not equitable to me, in 1681 (e)(b), a consumer report agency must adapt, reasonable procedures, to insure that a consumer report being furnished must maintain Maximum possible accuracy. This account is in fact, not accurate and must be deleted. so the imformation that OpenSky is reporting is fraudulent activity , they have not acknowledge or reply, to any of my requests in my letters I have sent on dates,10/19/2022 = 11/222/2022 and 05/05/2023, willfully non-compliant, and reporting a debt as a charge-off..

I opened a credit card account with these folks and even though I provided all necessary contact information, have received no monthly account statements, reminders, correspondence or phone calls or messages. I received 1 letter today stating my account was seriously past due, told me I could pay on their app, only to find I am not able to and to call customer service who puts you on very long hold times, doesn't answer basic account questions like balance or due date, transferred me to a completely incompetent supervisor who refused to help just told me to call back tomorrow and generally had no interest in helping me as a customer. In addition, refused to give me the name of the CEO there so I could send him/her my complaint and concerns. I find this to be very shady and want to resolve this account as quickly as possible. They are supposed to be in business to help folks but really are not interested in doing that.

      Customer Answer

      Date: 08/30/2023

I’m responding because I’ve been given nothing but a run around with these folks.  I contacted them shortly after I moved to my current home to update my contact information.  Apparently, the representative deleted my phone number and didn’t update my new number, the main reason for my call then.  Also, because I never received any email alerts, text message alerts or even a letter or call from them, I was unaware of the status of my account.  For months!  I did attempt calling them and was put on hold for unreasonable wait times.  I also received the only letter from them dated July 24, 2023, stating I could call them, pay on the app as well with a due date of August 21, 2023.  I tried the app which didn’t allow access. They charged off my account before the due date on the letter and never provided me the opportunity to bring the account current as stated in the attached letter.  I called multiple times was not provided information I requested and was talked over by a supervisor who told me to call back when that department was open.  I did call back and was cold transferred once again to a collection agency!  They couldn’t give me any answers and told me to call OpenSky.  One runaround after another.  I paid this off but am requesting they remove this from my credit file because they did not attempt to contact me in any way.  I have no calls or messages from them, no mail, no emails.  And they had all of my information.  This is the only account I have had this issue with.  I get alerts from every other financial institution I do business with.  These were all set up within the last year due to incredibly poor mail delivery in my new area.  In addition to protecting my personal information from being compromised by my mail being lost or incorrectly delivered since my move, I set  up these electronic alerts to keep me updated and better organized with my dealings with 3 estates from deaths in my immediate family, selling multiple properties, dealing with multiple attorneys, real estate agents, insurance companies, banks and credit card companies, estate matters and my own relocation and tracking multiple missing mailings and packages with the USPS which took months to somewhat clear up.  Repeated calls to the CEO ** ***** have been ignored.  This is by far the worst experience I’ve ever had dealing with a financial services firm.

I am rejecting this response because:

I did not receive any correspondence nor did I receive any emails concerning my accounts.  The only correspondence ***** receive was dated July 24, 2023 and the letter gave me until August 21, 2023 to bring the account current. You charged off my account on July 28, 2023 before I even received the letter and didnt even give me time to respond or bring the accounts current.  Your customer service did not help resolve my issue nor did the supervisors I spoke with after many attempts to reach someone.  Also, they were unprofessional and not helpful.  Your CEO never returned my call and apparently hides behind his voicemails.  Ive submitted proof of your letter to me, the only one I did receive, and it clearly states I had until August 21, 2023 to make the account current.  You did not give me that opportunity and I firmly believe you need to remove this trade from my credit file.  *** also filed a complaint with the ****

       Complaint: 20410298

I am rejecting this response because:

      My issues are as follows:

I contacted customer service to update my address and phone number.  They deleted my phone number altogether.

I signed up for alerts and never got one alert.  I received no letters until the one I received August 3, 2023.  I received no text messages or emails, either.

It was difficult to contact customer service.  Hold times are ridiculous and when I did get through I did not get any service and the supervisor I spoke with was less than helpful and talked over me.  Plus, she just told me to call back the next day.

This is my biggest complaint.  It is not proper procedure.  I never received notification of my account status.  The only letter I got was dated 7/24/23 stating I was past due and could bring account current until 8/21/23.  That is when I called 8/2/23, got nowhere, called again 8/3/23 and found out they charged off my account on 7/28/23! They took away my ability to bring the account current which is in black and white on the attachment by 8/21/23.  I could have paid this off immediately if I was contacted and easily could have avoided charge off blemish on my credit if they would have honored their letter which was supposed to be good until 8/21/23.  This could have been paid in full on 8/2/22 when I called.

They obviously do not even read my complaints and were not even interested in speaking with me to fix their internal problems.  Even the *** dodges phone messages which tells me all I need to know about this company.  They are the worst bank Ive ever dealt with.  They dont read, they dont listen, and they cover up their mistakes.  Im requesting that they remove the charge off status immediately as they are not reporting correctly.  They charged my account off before I could even respond to their one and only letter I reviewed.  That is shady.

      Regards,

OpenSky Subject: Urgent Resolution Needed for Erroneous Items on my Credit Report I am writing to express my deep concern regarding the numerous erroneous items that OpenSky has furnished on my credit report. Despite repeated attempts to resolve these issues through the Consumer Financial Protection Bureau (CFPB) and the credit bureaus complaint system, the inaccurate information persists, and it has significantly harmed my credit profile. The violations I would like to address are as follows: 1. Contradictory Information: OpenSky has furnished conflicting data across all three major credit reporting agencies (*******, ********, and **********), including listing my account as both open and closed, as well as reporting late payments and being paid as agreed. 2. Disregard for Dispute Instructions: Despite providing clear instructions on the correct information that should be reflected, OpenSky has ignored my disputes and continued reporting erroneous data. 3. Violation of the Fair Credit Reporting Act (FCRA): OpenSky's failure to conduct a reasonable investigation into my disputes, as mandated by FCRA § 611(a)(1)(A), constitutes a direct violation of my consumer rights. 4. Potential Violation of the Fair Debt Collection Practices Act (FDCPA): OpenSky's reporting of unverified information may also violate the FDCPA, which protects consumers from unfair debt collection practices. 5. Repeated Harmful Reporting: OpenSky's response to my disputes has been to add irrelevant erroneous information to my credit report, exacerbating the damage to my credit profile. I urgently request that OpenSky takes immediate action to correct the errors and delete all derogatory items on my report within 72 hours including; charge off, late payments, balanced owed.        Complaint: ********

I am rejecting this response because: this is the same generic response they always give... They haven't done any investigating and they fail to provide any proof of how they came to their conclusion... They furnish contradictory items across the bureaus and they constantly update irrelevant information that doesn't speak to the fact that their furnishing erroneous items on my consumer profile and they have done so without any explicit consent from me... I haven't received any disclosures that's clear and conspicuous informing me of my rights and my options to opt out .. they have violated my consumer rights in quite a plethora of ways... Then they listed the account as charged off but they have it being reported as open as well .. if it was charged off in their system that means they filed a 1099c for it and it's considered income ..and per irs publication income can't be reported on a credit profile.... Just as late payments, and other personal details aren't a legal part of a credit profile.. any personal interactions about our agreement are indeed personal and shouldn't be reported to third party companies without explicit consent.... So the fact that they reported this and reported it incorrectly is like a insult to injury ..

       Complaint: ********

I am rejecting this response because:

Subject: Rejection of OpenSky Credit Card's Response to My Dispute

I am writing to formally reject OpenSky Credit Card's response to my dispute. Despite multiple attempts to rectify the situationincluding contacting OpenSky multiple times and utilizing the ************************************ and other agenciesI find that my rights continue to be violated.

OpenSky has consistently furnished erroneous information on my credit report for the past seven months. This includes payment history and balances that I did not consent to be reported. According to applicable laws, such information should not be on my credit report without my express consent. I have explicitly demanded the removal of this false information but OpenSky has failed to comply.

      Notice of Subrogation:-

"In legal terms, subrogation allows one party to assume the rights and responsibilities of another, often related to a debt or claim. In my case, I am the natural person and the implied surety for the account under the name *************************. Through 1099A filings, this debt is considered settled and discharged, altering my original obligations to OpenSky. By invoking subrogation, I assert that my legal standing in this matter has changed, requiring OpenSky to update their records and actions accordingly. So once again to reiterate the matter at hand,..I express that I am the natural person and implied surety for any contract under the name *************************. Through 1099A filings, the debt related to this account is considered settled and discharged. My obligation as the implied surety has therefore changed and been altered.

Given these circumstances, I am demanding rectification of my credit report IMMEDIATELY!! (Ex: 72 hours from receipt of this letter)and compensation in the amount of $1,000. Sent via certified  check to my address on file. Failure to meet these demands will force me to take further action.

Thank you for your attention to this matter. I look forward to a prompt resolution.

I have had numerous problems with this business after my checking account ended up getting compromised and being charged on some days 2 x in 1 day for payment not going through as well as being reported to credit bureaus that I have missed payments when factually j can prove through my bank they were processed. In addition they closed my account wout my knowledge or approval with no explanation but the employee had no validity or go through the correct procedure in doing so. This resulted in taking my 200 secured deposit and continued to charge extra invalid fees. After 15 plus phone calls asking for a manager who was Never available, this started in January and finally in may I thought I finally got a resolution in which they credited back fees that I never should've been charged but they never sent me my remainder of my security deposit. As they continue to report wrong to the credit bureau and have destroyed my credit , no one has returned my call to speak to a manager , they have now started back up with reporting and adding extra fees.. I got this credit card to help me w my credit not ruin it after I had fraud on my checking account.. please help me resolve this issue since there is never anyone available and have taken my security deposit even though I kept making payments in full, they kept adding fees that aren't valid. I don't understand how someone has to deal with a crooked company like this and get away with it when I keep calling to resolve it and they do nothing but charge new fees and tell me no one is available to help me.. worst company ever and to continue reporting to the credit bureau when my account is closed and they have taken my full security deposit in validly .. I only got this card to help my credit and they have ruined it.. Shane on them .. please help. I will provide screenshots of payments from my bank if needed or you can contact capital one if you like to confirm I made payments every month in full.. ..

This basic info is incorrect .. why can't a supervisor be available or to respond to problem calls? They keep reporting my account is delinquent, was closed without my knowledge and they took my security deposit and didn't breakdown where my money went.. after my checking acct was compromised in September I have had nothing but problems trying to resolve and pay my balance off in full as this was my history in making payments, they charged me twice in one day in October or November for return fees after I kept calling to pay off the balance. Then in January some one closed my account wout my knowledge and continued tk charge me late fees? And report that my account is delinquent ..How is this legal? And then after 30 plus calls I tried to make to get help, I thought a supervisor wouldb have called but no one ever called me back .. Please  help me resolve this so I can get my credit score back and be done with this corrupt credit card company ? Thank you ****** ***********

I paid off my Open Sky balance in the amount of $199.00 through ****** ********** LLC and requested a paid in full letter emailed to me. They promised to send the letter within 24 to 48hrs. However, I still have not received the letter. Each time I call them, they either hung up on me or tell me something different like their computer system will send the letter automatically. I need my money reimbursed and their account deleted from my credit.

Called Opensky to pay off and close my account on January 17th 2023. I was told that I had a balance of $202.97 that I needed to pay in order to close the account, so I paid that amount even though it was a secured card with a $250 refundable deposit. So after that had been paid I should've still received $47.03 in return. Instead they apparently started charging me inaccurate late fees and interest which now amount to $86 (roughly) and charged off my account and sent ot to collections. Like I said, this account was paid and closed I'm January and I couldn't even log in to the account after that to check any statements. It showed up on my credit as a charged off account and upon calling they said I had a $5 balance that wasn't paid which is entirely inaccurate because I paid the entire amount THEY told me I owed ($202.97). They also still owe me my difference of the initial deposit. This needs to be completely removed from my credit report, as well as the remaining deposit refunded to me.

       Complaint: ********

I am rejecting this response because:
While this is now reported as "paid" on my account, it is still listed as having late/no payments for multiple months as well as still being listed as a "charge off" account. This needs to be completely removed from my credit reports or listed entirely in good standing and not as a charged off account, since account closing.

So many reviews from people experiencing the same things I am I got the card to work on building my credit but this card is only going to have a negative impact.
