    The company's representative gave us misleading information about the company's application, their product and services. We requested in several instances for an initial application to be canceled. We NEVER agreed to leasing any equipment or to any agreements where cancellation fees were part of the transaction. If you are being approached by Riverside Payments, **** Check with a business consultant or attorney first. We were not given the truth of what they were trying to sell us.

There may be confusion on your agreement, we are not with CardPointe as you stated on the call on 3.21.24. To address your concerns about there being a term to this agreement - Even though there is a term to the agreement in place,  it is built to save you money against your current provider as well as provide you with exceptional merchant services. We would love the opportunity to walk you through the program so you can understand its benefit. Our management team attempted to reach out to you as recently as yesterday afternoon.     Equipment was deliverd incorrectly at first so no intallation was done, when new was sent we had ****** been being charged for service that hadn't started yet. I then Asked for refund before we continued, no responce, I geve a dead line for responce and it did not happen, so we canceled. We are still getting payments taken even though we canceled on 1/11 in an email. now they tell me there is more to be done to cancel and someone will be calling back. No call yet. Also some of the payments being taken are for leased equipment, which was never authorized.

    Just Spoke with *****, was helpful but did say the agreement had been processed and there may be an early termination fee. We do not agree because the service part of the agrement was never met, despite being given 2 months to find a solution to our situation.

    Spoke with ***, she was insistant that after 2 months delay that they still send us the right equipment and get us up and processing if we want the refund. We told them that trust had been lost in the setup process and that we needed faster responce thatn we were getting, so we had moved on with another company, and a refund of the charges that had been taken prematurly was all we needed.

    I am rejecting this response because:  we were on hold for 11 mins and 26 seconds and left a message reiterating earlier calls with ****, ***************************, and **** that we need to be refunded and to cancel our service because 2 months of waiting on a responce for refund is unacceptable for us to wait on a solution. This all started because we were being charged before they had gotten us an acceptable POS system. We have lost trust in them as a business.

    We need to send back the equipment and be done, because we are not happy with the level of service being provided. Also there is some dishonesty happening here. We asked for POS software to be working before processing began and that did not happen, we were being charged for services before POS software was installed and working. Also the note that was said to have been put on the contact about NO PERSONAL GUARANTEES was either missed or disregarded, we are an Incorporated business which affords its owners protections, so we do not voluntarily sign away those rights. Please provide us an address to send back all equipment to and we can end this and go our separate ways.

    Thank you for reaching out to Evergreen Payment Solutions! The equipment delivered on 11/27/2023 was the equipment your business requested at the time of signing your location with Evergreen. With the current billing system in place, once your merchant account has been activated there is a cost to the service. Since receiving the equipment, our management team has worked with your business diligently to ensure that the system meets your needs. We also completed a demo on an alternate POS system through Korona POS to see if this suited your location better. Evergreen is able to provide you with the savings offered to your business and we have provided you with the equipment necessary to successfully run payments.

    Your request to cancel came before giving us the opportunity to provide the savings as outlined in your quote that you signed (attached) or allowing us to provide alternative solutions that may better suit what your business requires. We are happy to reimburse any charges you have received before installation of the equipment if you decided you would like to move forward. If you wish to terminate your services, you are responsible for the agreement in place. We would like to note that if you proceed with the agreement, we have the option to remove the personal guarantee off the paperwork per your request.

    I am rejecting this response because: The agreement was signed with the stipulation that the Point of sale software was completed before any credit card processing was changed or charged to us. This was discusssed in lenght on the phone and with the on site rep ******* the same was done with the personal guarantee. This agreement was null and void when you began charging us before software was completely set up, however we gave you an opertunity to return the charges and wait until we completed the setup phase, but we got no responce about it after a month of asking, This is where we said enough is enough and requested that the agrement be ended. My proposal is to end the agreement in full and I will return the never used equipment and go our seperate ways.

    Evergreen Payment Solutions would like the opportunity to review this agreement with you over the phone as soon as you have time available to clarify any questions you have! Both the merchant agreement and the equipment package are built within the agreement and have an automatic billing system in place. To enable and/or program any software for your location, there first has to be a merchant account in place for the correct parameters to be built.

    We have reviewed your documents at length and there is no promise to disable billing before your install takes place; the system will not allow it. 
    At Evergreen Payment Solutions, we are more than happy to reimburse you for charges received if you are in agreement to move forward and schedule the install. If you seek to cancel the agreement, you will remain responsible for the penalties in place.

    I am rejecting this response because: This has taken far too long for what we needed done. We had asked for *** Software to be installed before any processing changes and charges had happened and also we needed the *** Software solution to be in place before the end of the year. None of these requests were honored so we are not responsible for our part of the contract and we wish to end the relationship, and we are not responsible for any of the contract since Evergreen/Riverside Payments had ****** breached it before we cancelled. A misrepresentation claim has already been filed with the leasing company and you may also want to check your phone recordings and with the represenative who was at our business to confirm that we were very explicit about the stipulations stated above and in the Misrepresentaion Claim.

    Evergreen Payment Solutions is the company that solicited me to use them for credit card processing. After signing up with them, everything seemed to go through a separate business called ********* Payment Solutions and MX Merchant?Riverside Payment Solutions started handling credit card processing for my business. I was assured multiple times by everyone that I had contact with while signing up, that there are no extra or hidden fees. After only about a month, they started deducting sums of $189 from my account on a weekly basis. When I called to inquire about the charges they were rude and condescending in manner. I was told it was for PCI-non compliance. Becoming PCI compliant was utterly impossible using their system and was eating up hours upon hours of my time trying to figure out. Some of those charges were refunded, but then there were other random deductions that started coming out. When I called about those they attributed them to annual service fees and whatnot. At this point I told them I wanted to cancel their services. They informed me to send the rented equipment back ( a clover card reader). I sent the equipment back immediately. However, the pci non-compliance charges were continually racking up and being deducted from my account. At this point, I was becoming infuriated. How could I become PCI compliant when I didn't even use their equipment and had changed to a different credit card processing company? Their customer service is impossible to get a hold of and when I do get through, they blow off my questions and concerns and continually just tell me that I need to become PCI compliant. After looking further into the matter, it seems that this has happened to hundreds of other small businesses. I want my money refunded and then I would like to never hear from this company again.

    I have been being overcharged for services by riverside. I've tried several times to negotiate with them. They have reimbursed some money, but refuse to let me out of a fraudulent contract. They offered a guarantee of savings when I first signed up, and I have not saved money one month. I have disconnected their equipment and stated a couple ******** codes that will release me from the equipment lease, but they refuse to listen. I was verbally guaranteed by ******** that i would save money very month, and I was also verbally guaranteed by **** that I would be allowed out of the contract if I still did not see savings as of this month. Even with all their reimbursements, I am still being charged over 3% every month when their guarantee of savings states I will be under 1.7%

    I am rejecting this response because: 

    Evergreen payment systems solicited me into signing a contract with riverside payments. I want the recoding on October 12th between myself and ******************* at Riverside stating that if I did not save money on my next statement, she would let me out of my contract with Riverside and my lease agreement with Cascade. I was given a guarantee of savings at 1.7% which includes the $215 lease payment. I have never been charged less than 3%. This is a breach of contract.  

    **** refused to honor her word when I emailed to take her up on what she said. In addition, she had another employee contact me. I asked for a copy of my statements. She proceeded to send me a copy of another company's statement. This alone is grounds for a lawsuit. 

    I just want out of this contract and relationship. Evergreen cannot help me. ************************* at Evergreen is not returning my emails.
