The foam between the center cap and the tin of the roof, which is there for insulation and keeps debri and rain from blowing in, has been falling out landing on our floor, cars and trucks leaving our 54' x 81' shed exposed to debri coming in.Every phone call listed below was between myself and a lady named ***********Called Cleary 6/12/23 about this issue plus an issue with a door. Told someone would be out.Called 7/5/23 when no one showed up.7/7/23 a crew came out to fix the door but didn't repair ceiling because they came with no material. Told that day they were ordering the parts for ceiling and they would be back. 10/26/23 called Cleary because no one came back out nor called, only to be told they had not even ordered the material yet. 11/6/23 called Cleary to be told they were waiting on a crew to be able to come fix the roof.12/13/23 called Cleary to be told again that no crew was available to come out. Was told they would call me back later that week to schedule the crew and as of 1/10/24 no one has showed up to fix the roof nor contacted me. Shed was built in 2019 and under warranty until 7/2024. This is all warranty work but Cleary is not standing by their warranty.I have tried to no avail to get my shed fixed and Cleary is not responding in any way.We had two buildings built by them at the same time.Business Response

Poor quality / workmanship, communication, and time overrun. This project is in *****, **, pole barn by the ******, ** branch. I caution anyone considering to use this company against doing so as it's been extremely frustrating and costly to work with them so far. Building was supposed to start by beginning of Sept. 2023, they were delayed by other jobs, told would start 9/25. Did not start until 9/27. The building wasn't even ready for a walk through (roof, siding, doors/windows, trim) until Nov 1. Was told it would be a 7-8 working day build, it has been 56 working days now, and there are still quality issues that need addressed. Cleary claims to have responses within a day, I typically waited 2-5 days for any response, usually I had to prod again for an answer.They didn't follow the new plans required for the ***** dig and had to redo 2 corner posts. They didn't put the trusses to the correct height, and had to redo them 2X. The project manager came to the site maybe once before the major problems were repeated and the ******* manager and project manager came up to discuss problems at end of first week of October, when they only had posts and partial trusses up. My project manager was fired, but the ******* manager has been terrible at communication, and the ******* of the project never accepts responsibility, always blaming someone else on his crew, but he is the common denominator of the issues on this build.When they came to fix some of the items, they still didn't have all the needed pieces, messed up an item which they supposedly fixed but had the same issue, and I had to point that out and get it fixed. Their delays and screwups cost me $1300 extra in rental fees between the compaction equipment, dumpster, and port-o-potty, plus another $1500 of increased cost of concrete due to late season cold weather pour mix and additional labor needed to complete the job in the shorter time frame. I would like final payment reduced by the $2800 they have cost me.Business Response

All items have been addressed in regards to the previously mentioned concerns, except in the case of two piece of steel which has been ordered per the customer request. We are scheduling replacement for on or about 12/22. Also in todays labor environment delays of a day or two as also mentioned are not uncommon. In addition to all this we are not responsible for additional construction cost as misconstrued as our responsibility; our contract clearly specifies whos responsibility what cost are. Our intention is to complete this contract as expeditiously as possible as described previously. Thank you.

While a couple days late can be understandable, taking 3X as long to do the job compared to what was communicated is not. Especially when the times for each step were not met if they were even communicated not living up to your guarantee. Once again you provide another prime example of this,saying that on or about 12/22 the siding would be replaced/fixed, and yet the day has come & gone, no one has come to work, no communication has been given providing status updates or anticipated timelines from the ******* manager whom is now my only contact via telephone or text never given and email. He has completely ghosted me since our last communication over 10 days ago, and no response to my last inquiry on the 13th. Your **************** Guarantee sure is feeling like a big sham considering youve failed at nearly every aspect given in its statement. Things like ensure your project runs smoothly fail, multiple failures to follow plans that would have gone through to completion had I not inspected the site; Sales Specialist will be one site during construction when possible to verify and confirm quality and your expectations with the ******* fail, she came once, did not talk with me was fired, but the ******* manager who took over hasnt been any better; Sales Specialist will then updated you every couple of days regarding progress of crew fail, I had to point out crew was not there, or only worked half a day and did not meet the timeline for the build I was told they would by that day. Our mission is to give you a quality product with the highest level of **************** achievable making sure that our commitment to you has not just been met, but exceeded fail, lack of response, repeated failures of the same issues (Sonotube / foundation size issues, truss height, **** braces, missing ventilation strip).
I would like an apology, explanation, and compensation for failing to meet your guarantee.

We contracted with Cleary Builders in February to put up a garage. The salesman met with my wife and told her they would do a survey of the property to ensure there were no issues with rock. This was not done.Then when he met with my wife in June she asked about this and he told her, "We are good to go". They came to the site, and discovered rock beneath the ground, so they pulled off the site and charged us a $300.00 "pulloff charge".Since then we hired a contractor to come in and prepare the site by removing rock or any other obstructions from the the sites of the holes they need to drill to put in footings, as requested by the salesman when he and I met at the site to discuss getting the project done.The salesman promised me construction would start in late September, then scheduled us for the first week of October. I asked him when they would be doing the work and he told me he didn't know when. Then in the next email he told me that the site was not ready, even though he has not come out to the site.We have done due diligence to spend the money to have the site prepared.We have been waiting 8 months for this to get done.We can't get a straight answer from the salesman, and dare I say I strongly question his integrity, as he says one thing, then changes in the next conversation. We have revised our current production schedule and were able to move this job up. The job is now complete and the contract is complete in full. The delays on the building are a result of below grade obstructions with large rock that we were unable to dig through with our standard equipment. When the site was assessed by the sales person and the client, there were no visible sign that digging would be an issue. Per the terms of the contract, if Cleary Building Corp is not able to proceed with normal digging procedures utilizing a skid steer with an auger attachment, the purchaser is responsible for added costs associated with the digging obstruction. This client opted to have the holes dug themselves which forced us to have to pull the crew off the job and send them elsewhere. This was in July. The client then had the holes dug and ready for us to return in mid-September. Unfortunately from a timing perspective,returning to this job immediately following the client having the holes dug was not feasible as we were already in the middle of another project that we could not pull off of or we would put that building in a jeopardized state. The client was presented with our standard pull off charge of $300 but refused to sign that change order so they have not been charged anything additional for all of this. Our crew did spend 7 hours on site attempting to dig the holes without success. We did not present the client with those costs either since they choose to dig the holes themselves. This was a very small building and our crew completed the job in 2 days followed with installation of the *** with all items now being completed. .

The Kleary response is erroneous on several counts. Initially, my wife had questioned the salesman about rock beneath the ground. He informed her they had the ability to scan and would do so before construction. As well, they indicated they spent an entire day trying to dig the holes for footings.
Two of our neighbors observed that they were only present on site for 2 to 3 hours and left. The only mention of a "pull off charge" was in an email from the salesman, although any documentation for this charge was never presented. When he came to look at the worksite my wife asked about the rock and he replied to not worry about it, it was "good to go". In the 20 years my wife and I have been together, she has never used this term, indicating that indeed he had said this. There were several occasions when the salesman was either blatantly dishonest or at least deceptive in his communication. Additionally, we made several calls to their corporate leadership, who demonstrated limited interest in resolving our differences as a business and customer. Although I am pleased that the ********************** was finally completed, ultimately, it still frustrates me that we were not treated honestly by the person who intereacted with us on behalf of this company.

At this point in time we will have to agree to disagree with our client's commentary. The sales person has been interviewed and confirms he did not make a statement that he would be able to "see" what was underground prior to construction. And as stated, the contract is very clear on what is to take place if additional construction efforts are needed due to rocky ***************** And included in this contract the statement was added prior to signing that potentially there could be a limestone issue at this site and additional digging expense may be required.

I contracted Cleary building to build a 36x50 foot shop with concrete floors. They had to move in several truck loads of dirt fill material to get the ground built up about 3 feet. This created a couple issues, one the building was to be 5' from the property line so this left a steep angle dropping 3 feet down in that 5 feet. I asked if they were going to put a retaining wall to keep the dirt from washing into the neighbors yard they told me that it's roadmix, they do this all the time and there will be no issues. I was skeptical, but also I am not an expert. Then when they had to compact the dirt for the concrete they used a small handheld compactor. Way to small for the 3 feet of fill they moved in, this would have only packed the top layer of dirt. Not even a year later my floor is spreading at the cracks, the dirt has settled and there is a gap under the concrete. The *********** replaced. I called in a concrete leveling company to look at it he said in his years of experience fixing concrete he has never seen such bad work. He said there was no way that dirt was going stay in place at that angle, it was like building a sandbox with no frame. Cleary building will not fix their poor workmanship. I have been dealing with them coming to look at it for almost a year now with them giving the run around. This last visit they flat out said they are not fixing it. I went to an attorney he said they are responsible to fix it. Then he noted they built and sold me a building that did not even meet there own warranty as it states in the warranty the ground can not slope more than 1 foot down for every 5 feet horizontally. Also they used sub par building techniques to pack the dirt and that is why the gap under the concrete has formed.Business Response

We have investigated this matter fully previously, and again now also after this information. It has been confirmed that the client does have an issue with the site, and settling issues. Per the terms of the contract, the site and it's ability to bear the weight of the building is the responsibility of the client. We have reviewed this matter with the sub contractor excavator. The analysis has come back to show that the client needs gutters on the building to get the water away from the building itself. We have offered to bid this solution for the client in the past. And we will do so again.

I have read your response and would like to attach a copy of the document the expert you had look at it sent regarding the issues with the floor. Please note in the findings that the 3'-4' of fill dirt that was put in place was done by Cleary Building or one of their subcontractors. The compacting that was done by Cleary buildings or one of their sub contractors. I would like to point out I only made payments to Cleary buildings, not to any subcontractors. I am being told that it was from erosion, that does not explain the issues with settling on the gabled end of the shop, also pointed out in the attached letter. This is clearly an issue of poor workmanship and bad practices.

Cleary Buildings ********* of mine paint on the roof is not holding up to the 25 year warranty. The inspector they sent out confided in me that the paint did have issues. But every since then all I have gotten is the run around by there warranty company. Omnimax. Now they just ghost **! No communication what so ever in months. I will never recommend Cleary Buildings. They should be the ones going to bat for me!!!! I have a commercial painter scheduled for **** at a cost of $7000. That should be their bill NOT mine! I am writing this, not to be malicious towards Cleary, but to inform potential future customers of my experience with this company and my frustrations as a consumer. I consider customer service the backbone of any company, creating a trust between client and company. If you read about Cleary as a company they boast of their highest level of customer service, even going so far as to state this in their **************** Guarantee. In this document it states We offer you our **************** Guarantee to ensure your project runs smoothly, on time and with the quality you deserve. Our mission is to give you a quality product with the highest level of **************** achievable. While this sounds impressive, it could not be further from the truth. My build was 7 months past the expected completion date, with communication being non-existent for weeks at a time. I understand workers come and go, and some things are out of our control when it comes to delays, but Cleary did nothing to make up for their deficiencies, other than offering free swag to make amends. My complaint is that Cleary misrepresented themselves by offering a guarantee of service, while making these claims under false pretenses to gain my business and my trust. Cleary proved their service guarantee is a deliberate misrepresentation of their company values, meant to deceive the consumer into thinking they would receive a higher level of service, but when challenged, offers nothing of substance to back up these claims. A customer service guarantee is not worth the paper its printed on, if a company does nothing to ensure this service is fulfilled.Business Response

It is unfortunate ************ confuses good customer service with what he considers a completed build. We started Mr. ***** building within our agreed upon Tentative Erection Date of August of 2022, and we were substantially complete by the end of December of last year. In our contract it states that use of the building deems acceptance and he had been using the building from that point on.
It was also at that time ************ pointed out items he wanted addressed, his punch list. Since we dont shy away from any service obligations or warranty work that *** have been needed, we ordered in replacement material to alleviate his concerns. The punch list items identified fell under our warranty and from that point forward is what constitutes Mr. ***** 7 months late comment. We did this twice, once after the first punch list made and a second time where ************ identified additional items he would like addressed.
Finally, once we received all the material that ************ requested, we replaced to his approval. There were multiple supply chain issues, which has become prevalent across many industries. Back orders and material shortage are not uncommon, but at any rate we attempted to conclude the job as soon as possible.
In addition to that, personnel staffing is a challenge across many industries as ************ makes mention of. We also acknowledge that in todays labor environment people do come and go. Again, that is a challenge that we face daily.
We do not make any excuses for lack of communication *********** feels hes experienced, and we strive for excellence. But to go as far as his statement in misrepresentation in customer service is false. Mr.Kings ********************** is fully completed to his satisfaction, all serviceable items have been addressed, and his building is under warranty as set by our contract.We do honor his warranty per the terms of the agreement in full and will continue to do so.

It is unfortunate that Cleary continues to sidestep the issues at hand relating to customer service and their "guarantee of service" stated in their **************** Guarantee. As ******************** stated..."We started Mr. ***** building within our agreed upon Tentative "Erection Date" of August of 2022" This building was not erected in August, but rather the process was just beginning. I am also confused about the "punch list" terminology used by Mr. ********, as this is the first I have heard of that. As I am not a builder by trade, I relied on the expertise of my four different project managers to ensure the building was completed correctly according to the design plans, so any "punch list" to speak of was created solely by Cleary. If you could provide my personal "punch list" of additional requirements which may have caused delays please do so. To my recollection, any additional materials ordered were done by the two regional managers to fix previous flaws which were identified during walkthroughs.
Mr. ******** also stated that "use of the building deems acceptance and he had been using the building from that point on" to which I must respond that I was encouraged by Cleary to use the partially completed building since I was in dire need of storage space over the harsh winter we had. Had I known Cleary would use this as leverage I would not have headed their own advice. In addition, had the building been completed by August as promised, I would not have had to deal with storing items in an unfinished building during the winter.
As I initially stated, delays happen which are out of our control, including worker and product shortages, so I can empathize with these setbacks that Cleary experienced, but this does not explain or excuse the lack of customer service or the accountability of a company who boasts of their "highest level of **************** achievable. This is why I stand by my statement that misrepresentation in customer service was exhibited. As stated on Cleary's website..."We commit to upholding our **************** Guarantee to ensure your project runs smoothly, on time and with the quality service and product you deserve". My project did not run smoothly, was not on time, and the quality of service was questionable throughout the process, so once again I ask...how are you committed to upholding your **************** Guarantee if you do not commit or stand by those guarantees? This is clear misrepresentation by definition which states "A misrepresentation is a false statement of a material fact made by one party which affects the other party's decision in agreeing to a contract."
In this day and age, customer service is more important than ever, and should be regarded as such. For a company like Cleary to promote their service guarantee, but offer no substance to back it up, is not only disheartening, but deceiving.

I have attached the **************** Guarantee which describes Cleary's outstanding level of customer service and satisfaction. Unfortunately it is clear that this does not apply in the real world when dealing with real customers with real issues. The delay in my building resulted in personal out of pocket expenses due to a seven month past completion date. Cleary has shown their true colors when it comes to customer service and standing behind their word. Once again, what good is a service guarantee if you do nothing to back it up, and do nothing to make it right? Future customers should look at having Cleary add a clause to the contract which states that if the building is not completed by a set date, then there should be a clear and decisive course of action taken by Cleary to make amends, rather than offering up a fictitious **************** Guarantee which does nothing to protect the consumer. Never have I been more disappointed by the way a company responded to adversity in the market. If a build does not go according to plan, then own it....don't make excuses, just make it right.

Signed a contract with them on 04/20/2022. They were onsite to approve the building pad in June 2022, It was relayed to me by the sales rep that the materials would be showing up in a couple weeks, with the crew to follow. Month goes by, nothing. Call the sales rep and am told that they lost some people and my project is pushed back. No, 8 months later, my building is still not built. My materials have been laying onsite, uncovered, getting rained on for 3 weeks today. I've been told by the sales rep and the regional manager that my project is being expedited. That was back in December. They still aren't onsite starting to build yet. They say that they will be there this week, but I've been told that plenty of times by them already. I called the company headquarters in ******, **, spoke with *****, explained the situation, she sounded sympathetic, but still have not heard a response two days later. We are aware of the clients concerns and we are addressing their complaint fully. At the time of this response, a construction crew has already started the building and is making measurable progress. Our local branch office encountered crew personnel issues which have impacted the schedule and unfortunately caused some delays to this project. In order to move this project forward expeditiously, we have brought in a crew from another location and we expect to have this building completed within the next two weeks approximately. We have also implemented a plan to ensure the client is updated frequently until the project is completed. Thank you.
