      Kingdom Contracting (KC)s installation of my new custom Velux skylights (2) was not performed according to Velux instructions which Velux stated to KC rep **** and myself on 1/4/2023 and then documented on 1/11/2023 that the skylights are currently unwarrantable pending proper installation. *he initial work began 8/29/22 for new flashing with the discovery that the original skylights were reported by ** as irretrievable. *he new skylights were installed 11/21-22/2022. *here have been loud aberrant noises (clicking, popping, tapping, thumping) and operation issues since installation; and errors in flashing, placement and caulking are visible. A punch list was signed 12/28/2022. First I have offered them to complete their contract by ensuring and supervising their installer follows factory instructions--******************* cancelled the reinstallation scheduled for 3/16/2023 claiming they needed clarifications from Velux including install guides and writing even IF we did everything to the * per the manufacturers specifications *hey have not honored their Workmanship Warranty. *hen I asked that they complete their contract by subcontract to a Velux-certified installer, which they declined. On 3/20/23 she sent a lien waiver and certificate of completion of the project, offering to credit the remaining $1,049.82 and provide the two Velux flashing kits and some additional shingles. I informed her that there was an extreme discrepancy, and that I I do not know the condition of the new skylights and my roof at this time. Also the skylights were not installed properly--there is no reason for me to pay for labor. On 3/21/23 I asked for refund of the remainder of contract pertaining to the skylights and installation charges ($4,652.51).

      Thank you for providing the details and supporting documentation from ******* on her skylight concerns of which we are still actively in communication regarding. I also apologize for the delay in my reply as I recently had a baby on 3/26/23 and experienced a very grueling strenuous labor making recovery a bit extra challenging limiting my ability to return more actively to work after only a week or so time after having my son and not having a traditional maternity leave.    
      We were privileged to enter into a Work Agreement with ********************* 2022 for reflashing and replacing ******** and underlayment for her two skylights on her home. When our installer arrived to perform the work only a few short days later, it was discovered that due to preexisting severe improper installation conditions the preexisting skylights were irretrievable.Whomever installed or attempted a leak repair had sealant heavily spread over the edges of the skylights, up and inside the channel that receives the **flashing.It was so heavily sealed that it was not possible to remove the sealant to do the necessary repairs as per the original Work Agreement. A Change Order was executed and signed 9/09/22 by ******* was purely for the cost of new skylights as labor and other necessary materials was covered on the original Work Agreement.A courtesy discount was also given at this time for ******** troubles on having to get new skylights.
      After waiting for the manufacturing of the custom skylight order and to come in to our supplier, the skylight installation took place 11/21-11/22/22. Our installer we had perform the work is one of our lead installers who has worked for us for quite some time. He does quality work and embodies our company principles of serving our clients well and with excellence. This project was also monitored by our production team along with this particular installer who is able to self manage and report live directly back to the production team when the project manager has to temporarily leave to check on other projects that *** be in process at the same time. This installer has successfully installed many many skylights without any issues prior to this installation without any callbacks of any kind which includes issues with noises or leaking.
      At Kingdom, we genuinely care about the experience that our homeowners have whether they choose us to complete their projects from initial contact through project completion and beyond. We believe in good quality workmanship and standing by it. If any issues arise during a project in process or post completion we do not shy away from them but stand by our word to do our best to rectify the concerns present.So much so that we have a lifetime workmanship warranty that is transferrable to the next homeowner that should any issues are discovered post project completion that is found derived from original installation that we will fully cover the labor and materials to resolve the issue. The state of ********* only requires a 1 year workmanship warranty and we have a lifetime. We have never not made good on our workmanship warranty and will continue to hold true to our word in doing so for every completed project in future.   
      ******* approached our production team after the skylights were installed a few weeks after with concerns on sporadic disturbing noises. We requested that ******* provide more information on the noises and circumstance which they occur so we can better understand how the concern *** be addressed. The context and parameters in which ******* has claimed the noises have presented itself are outside of any of the normal parameters that Velux has ever been reported since skylight product inception in 2010 as stated by the Velux technician that inspected ******** skylights on 1/04/23. In essence, we tasked with needing to rectify an issue that the manufacturer Velux itself has never seen or encountered before. At this same time, she did state she was having issues with the solar blinds opening and closing indicating she though the skylights were defective which turned out to be user error that the Velux technician cleared up on his 1/04/23 inspection.
      It is always our practice if a concern arises that if it would be helpful to receive answers or reach a resolution to involve our product manufacturing partners- in this case Velux. ******* had chosen to proactively reach out to Velux apart from us to arrange this meeting,even though this was something we were in process of facilitating. When ******* presented these concerns we did take her request seriously and started to work at trying to address them right away.
      Our production manager attended the inspection of ******** skylights in 1/04/23 with the Velux technician along with *******. As it was discovered and noted by the Velux tech at this time and again confirmed in my subsequent conversation with the Velux tech, the noise concerns were outside of any normal parameters that any noises would normally occur. The Velux tech did state as referenced in the email that BBB was provided as supporting documentation that the overall skylight installations was in fact good. In order to troubleshoot and rule out any potential root causes that the noises were originating from the Velux tech provided some installation revisions that could be done of which my production manager took detailed notes of and we confirmed we had all the exact specifics afterwards by email and in my phone conversation with him. We take responsibility of the need for the installation revisions and desired to get this done as soon as possible in attempts to try to rectify the issue. We truly take it to heart whenever there is an issue for our homeowners and want to do all we can to make it right, to bring peace of mind and restore confidence and trust. It is heartbreaking for us whenever we have an unhappy or stressed client. That said, given the presented concern we cannot guarantee that even with performing all the revisions to the exact Velux specifications that it would eliminate the noise concern. (This was also stated as to be the case by the company that ******* was asking us to subcontract- ** ******************).
      From time to time we do encounter homeowners that are a bit more susceptible or predisposed to worry or anxiety even if their project goes seamlessly. This is the case with ******* and so throughout our interactions and communication with ******* have tried to be empathetic and sensitive to this.
      Despite the Velux tech stating the skylight installations overall was good, it is ******** belief as she has conveyed to us that we performed a completely bad improper install, caused unknown damage physically to the skylights and to her home, expect leaks to happen and that we are incompetent and untrustworthy to complete the installation revisions as specified by the Velux tech. The allegations as indicated were they true would have been substantiated at the Velux inspection of which none of this was. We have been trying to reassure ******* that we are fully capable of completing the revisions and that our production team would be present the entire time taking pictures along the way of every step in the installation revisions to fully document the process. We also fully expected and look forward to the reinspect by the same Velux tech of the revisions once it was done. We also indicated we would cover the cost of Veluxs return visit if any.
      ******* was not satisfied with this and indicated that our installer, our project supervision/personnel,our documentation of the install revisions was not sufficient wanting more assurance that all of these steps taken would resolve her noise issue that has been causing stress for her and her family and more.
      We had scheduled to do the project revisions in March but upon the clear misunderstandings as indicated above I thought it best to circle back to the Velux tech and Velux regional manager to clear up the discrepancies present so we could all get on the same page and that some trust and confidence could be restored before embarking on the installation revisions. I also contacted Velux to request a copy of the inspection report. At that time, given the state of mind that ******* was in regarding our company doing the work I asked them for a list of other contractors that they *** recommend should ******* choose to terminate trying to resolve this with us and start over with a different contractor of her own choosing that she would feel more confident in completing the revisions.
      As suspected, ******* proposed and indicated that she didnt want our company to come back to do the revisions despite our ongoing desire, communications and actions to do so. We do respect and honor our homeowners and understand that we cannot compel a homeowner to do what we would prefer which is to make good on our workmanship warranty and perform the installation revisions. I did explain to ******* that our workmanship warranty is activated/good when we ourselves are performing the work. We are unable to warranty what another contractor does.
      ******* did request that we subcontract another contractor, WI ****************** to do the revisions. I did let her know that its not that simple and legal subcontractor paperwork,insurance etc has to be in place in order for an individual/entity to serve in this capacity, and that most companies will not serve in this capacity. She took this as our indication that we will not honor our workmanship warranty. I did have an in depth conversation with the owner/installer of W.S.S and he confirmed with me that I was correct that they would not serve in the capacity of a subcontractor and he would have to have a contract directly with her.  
      There was an outstanding balance due of $1049.82 for the project. As there didnt seem to be any way ******* was going to allow ** to return to compete the installation revisions we zeroed out the balance due, issued a lien waiver/cert of completion and offered to still provide all the materials needed for the contractor of her choosing to use so that just labor would be on their estimate of which the zeroed balance out we believed would cover it. We have already delivered to ******** home the new flashing kits and shingles that would be needed.     
      Our proposal to address the concerns present is as such. Kingdoms desire is and continues to be to complete the installation revisions ourselves.
      1) We exercise our Right to Cure by ********* law and proceed on doing the installation revisions as originally specified and provided by Velux. Then we will have Velux come out to reinspect post installation revisions and will cover the cost if any for their visit.

      2) ******* can choose to have Wisconsin ****************** do the installation revisions for her peace of mind even though they have same potential outcome as us as they cannot guarantee elimination of the noise concern, removing us from the picture, a contract between her and them would be signed. Kingdom would pay for the difference due from what was zeroed out to cover for the labor balance due based on their estimate. 
      $2106.00 (per the estimate I received from W.S.S.)  - $1049.82 = $1056.18 (Kingdom to pay out of pocket)

      The Velux specified installation revisions-

      Left:
      - Bottom flashing: should be under 1 more course of shingles
      - top head flashing: only nailed top corners and cover with shingles. Head flashing should be lower because its supposed to be under the shingles
      - Make sure the underlayment (non granulated ice and water) comes up the full side of the deck instead of just up to the deck seal
      - Make sure deck seal is nailed down all the way around make sure all the holes are filled with nails or screws
      - Reposition 3/4 inch lower to allow the screen to come off easier
      - Leave 1/4 gap between shingle and flashing up the sides

      Right:
      - same as left except the repositioning part
      - make sure the underlayment on bottom is high enough

I have attempted to work patiently with Kingdom Contracting, but I believe they have failed their responsibilities and time requirements established under the ** Right to Cure law. Thus their offer as presently described falls short of reasonable reparations.

      With respect to KCs second offer to pay for skylight reinstallation, I would consider their offer if in addition to the release of lien, credit of $1,049.82 and two flashing kits, they also pay the reinstallation fee ($2,550) and provide me a copy of the skylights materials invoice.

       

      The skylight portion of my contract with KC is $5,702.33, of which Ive paid $4,652.51. They have provided the release of lien on my property and offered to credit the remaining $1,049.82 which would have been due at project completion. The skylights were documented by Velux and KC as not properly installed and KC cancelled their reinstallation appointment. I have asked for their receipt for the skylights to establish the warranty, which I have not received to-date. They provided two Velux flashing kits to be used for the reinstallation. I am providing a copy of the updated estimate ($2,550) from ****************** to remove the existing skylights and install new skylights provided by Velux.

      Pursuant to our ongoing communications, despite our desire to do the revisions ourselves that would fall under our Lifetime Workmanship Warranty it appears that you would rather have another contractor perform the work for your peace of mind. Ultimately, we desire you to be able to have confidence and peace of mind now and in the years to come. 

      This being the case, I would like to reiterate that once another contractor performs any sort of work on the original scope of work that Kingdom did, our Lifetime Workmanship Warranty no longer would be valid as we can't warranty work that is performed by anyone outside of our company. Hence, any warranty for work completed would then subsequently be covered by that contractor/person and not Kingdom. 

      Pursuant to what we have previously communicated in choosing the route of having another contractor complete the skylight revisions for you, we indicated that we would supply the materials for you as we would already have those on hand and cover the cost of the difference for labor only. We have already supplied two new flashing kits that were delivered to your home at no expense to you along with the bundle of shingles that is currently being stored in your garage. As I do not have documentation in your file of the exact shingle you have on hand I would like to obtain from you the brand, type and color so we can purchase another bundle in case that is needed. Any excess shingles you could then store if needed for future repairs. 

      After speaking with Velux tech *************************, he confirmed with me as a courtesy and accommodation to you and the irregularly odd circumstances in which the noises are occurring that are outside of normal circumstances that such noises would occur as validated by Velux, he was able to have granted replacement of new skylights for you which he already has possession of. **** did let me know he will be sending me an email to this affect as well that the skylight replacements is not due to damage done by Kingdom or improper installation.

      Thank you for seeking clarification, we appreciate it! Our company and team values communication that is clear, concise, productive and beneficial towards the desired mutual goal and purpose. With this in mind, I will recap the findings and offer to what was as previously offered and stated.

      1) It has been confirmed and validated by Velux that Kingdom Contracting performed and completed a good installation. To address the atypical abnormal popping noises that has never been reported to Velux in this manner since product inception, Velux inspected the Kingdom completed installation and provided some revisions to the skylight window installations to troubleshoot and remove from the potential cause and see if that would help eliminate this atypical sporadic noise.  No damage of any kind was found to the home or skylights upon their inspection.


      2) Kingdom verified the revisions in person and verbally with Velux multiple times and has been preparing for and desiring to perform such revisions but are being denied the right to cure by WI law to do so due to homeowner personal preference. Such revisions would fall under Kingdoms Lifetime Workmanship Warranty that any concerns or issues whose origin is related to the original installation by Kingdom would be covered, but only when the necessary inspection and subsequent work is completed by Kingdom itself.


      3)You have decided to hire another contractor to complete the aforementioned revisions, hence rejecting Kingdom to proceed with performing the Velux suggested revisions. As is the case, any subsequent work that is done on the original scope of work (the two skylights in question) by another contractor will make Kingdoms Lifetime Workmanship Warranty null and void. Any subsequent work including labor and materials performed would then be covered according to the warranty arrangements by the contractor of your own choosing to perform the work, not Kingdom.

      4) To continue to go above and beyond to provide exceptional service despite being denied our right to cure Kingdom has
       4A) Zeroed out the remaining balance of $1049.82 that would have covered the skylight installation labor costs for your original installation and issued a lien waiver so that you could use this toward the hiring of the contractor of your choice.

      4B) Provided 2 new skylight flashing kits and a bundle of shingles with an offer to provide other materials we would have on hand to minimize/eliminate material costs working directly for delivery with the other contractor.
      4C) Offer to upon receipt of an outstanding invoice, for the labor costs only pertaining specifically to the skylight revisions, issued by your hired contractor, Kingdom would pay directly to the contractor the difference of the forgiven balance of $1049.82 and what the invoice amount due is.

      5) Kingdom will stand by its offering on what is listed above in #4. Please be aware the contractor chosen is fully on homeowner preference and accord. Please be aware that this estimate provided is on the top end for industry standards. Kingdom has agreed to pay a portion of the labor costs as outlined in #4C not the full proposed costs  to be incurred. Our purpose of such is to go above and beyond to aid in bringing peace of mind and closer to resolution for our homeowner. Please note that if Kingdom would be given right to cure under WI law, the Lifetime Workmanship Warranty would apply as no work has commenced yet to the original scope of work to our knowledge by any outside contractor.  Hence, there would be no additional out of pocket costs to the homeowner.  The proposed costs to be incurred are due to personal preference not necessity.      

      6) Due to a very generous accommodation and courtesy by Velux, you are being provided brand new skylights to rule out product defect for the atypical abnormal popping noise that is being claimed. Per your request, these new skylights are currently being held onto by Velux until your authorization to deliver. Any warranty/registration going forward is based on the installation of the new skylights with the contractor of your choosing, not by Kingdom.

      Response to Kingdom Contractings last offer, organized per your bullets
      1) It has been documented by Velux that Kingdom Contracting (KC) did not install my skylights
      correctly according to factory instructions. By your own written admission, ** did not follow the
      installation instructions. Some aspects of the incorrect installation are so obvious it has been
      further commented upon by my neighbors and my new contractor.
      2) KC did not correct the installation in a timely manner per the requirements established under
      the WI Right to Cure law, and in fact you cancelled the reinstallation appointment.
      3) When I reported the obvious problems experienced with your installation of the skylights,
      your company did not correct the problem thus I had to seek the help of the manufacturer and
      follow their recommendations to get the problem resolved. They recommended complete
      reinstallation.
      4) Going forward I accept KCs remediation offer with the following necessary modifications as
      may apply. Clarifications to your comments are also provided.
      4A) KC has zeroed out the remaining balance of $1049.82 and issued a lien waiver.
      4B) I hear your offer to provide materials. I discovered 2 new skylight flashing kits which
      were left unannounced on my property and the boxes were damp due to the rain that day, so I
      am hoping the contents are usable which I am attempting to confirm. To-date I have not
      received the promised shingles. I was informed they need 2 flashing kits and 2 bundles of
      shingles. Please schedule with me for delivery in May.
      4C) I accept your offer to pay for the labor/installation costs only. Given the situation it
      would be reasonable that your company pay the entire installation cost. It seems inappropriate
      that you are subtracting monies that were not paid to you as a credit to yourself, either in your
      payment of the installation fee costs or in the refund of my money I paid your company for
      installation. Whatever payment you contribute will have to be paid directly to me, as the new
      contractor has informed me they will not accept payment from KC. It is not an option for KC to
      coordinate the resolution of our agreement through my new contractor.
      5) KCs charges $5,702.33 for two skylights and installation, after subtracting the materials (or
      even subtracting one half for materials) substantially exceed the installation fees being charged
      by my new contractor.
      6) Due to my understanding that Veluxs handling of the situation and offer to provide new
      skylights stems to my purchase of those installed by KC, I have asked you to provide me with
      the invoice to establish the warranty period for these materials. I paid for these skylights and
      should be provided a useable receipt for my purchase.

      As previously described in detail, Kingdom Contracting did not correctly install my two new custom Velux skylights and did not correct the issue(s) over a period of four months plus. As a result, the manufacturer has intervened and a different company will install new skylights. KC zeroed out the remaining balance on my contract and issued a lien waiver. They offered to pay part of the installation costs directly to my new installer, which is not an option as the company's contract is with me and they are not involved in resolving my contract with KC (and they decline receipt of payment from KC). KC offered to provide reinstallation materials, of which I have received in part and in questionable condition since their unscheduled delivery occurred during rain so the boxes were damp when discovered. 
      I have asked Kingdom Contracting to refund the money I paid them related to the skylights--or at least pay the installation cost directly to me. I asked that the materials they are offering be scheduled for delivery in May. I also asked for a copy of the receipt for the two windows to accurately establish my warranty period.

      1)  I respect your perspective, we can agree to disagree. What matters is that you will be able to move on and be able to have time freed up to enjoy life and things and those that you love and is important to you

      2) This is not an accurate statement in accordance with the ********* Right to Cure Law. To refresh and clarify why the installation revisions was postponed was to allow space for all to get on the same page (Kingdom, Velux, and you as our client) and to alleviate the present misunderstandings at that time so we all could move forward with the installation revisions for you in a better state of more established trust, confidence and peace of mind. Unfortunately, this time was not allowed even though actions were already taken and in motion to do so and adverse actions were taken instead on the part of the homeowner.

      3) At Kingdom, we genuinely care about every concern presented and do our best to address and find a solution. We thank you for making us aware of the concerns regarding the irregular atypical noise popping sounds of your skylights. Since inception Kingdom was working with you and Velux towards a potential resolution having been in communication numerous times with Velux support, the Velux regional manager, and Velux technician who inspected the skylights on 1/2023. Sole action on your part as the homeowner was not necessary as filing a manufacturer warranty claim is something that is customary for Kingdom to do and facilitate. Patience and understanding that it may take time to resolve is always appreciated and needed in this difficult circumstances.      

      4 and 5) we will honor what we have said by paying the remaining portion of what is outstanding after the credit back to you of $1049.82. We are not looking to be part of the installation resolution as you have chosen to have another contractor resolve, however, for verification and payment purposes for us to honor this we do need to receive a copy of the invoice so we can pay what we have agreed upon

      6) We are able to provide a letter indicating the pertinent information. It would be my pleasure to provide this letter to you if you can please supply to us what it needs to include as you have chosen for us to no longer be part of the resolution of this matter. Does it need to provide the date of original purchase through our supplier? Date of installation? Etc. Upon receipt of this information, this letter will be provided to you by the email address we have on file with original emailed to you.

      To review, I paid you ($4,652.51) for the skylights part of my contract and there was a remaining balance ($1,049.82) which you forgave and now are crediting yourself. For the record, I do not agree that your crediting yourself for these excess charges is fair. 

      However understanding you will then pay directly to me all installation fees charged by WSS (except materials youve supplied and a $1,049.82 credit), I will send you a copy of the final invoice/receipt following their reinstallation of my skylights. At this time I am wondering when you will provide the materials you had promised, e.g.  a bundle of shingles that are the same as what you used on the front peak of my house? This project is scheduled in June, so I need them now. And finally, I ask for a receipt for my two custom skylights, which includes your company, the date of sale 11/21/2022, the item description and Velux reference numbers for the materials, and the cost of the skylights marked paid in full.

      Thank you for stating your thoughts on the credit back to you. As in depth details on this has already been provided I will refer to that for further clarification.        
      The additional bundle of shingles has yet to be provided as we have requested numerous occasions for you to provide to us the manufacturer and color of the shingles you currently have in your garage so we can ensure we obtain the same ones. As we have yet to receive this information from you we have to be able to supply them. If you can please provide this information then we can have them there within 1-2 business days. If needed for documentation purposes, I can pull the dates and correspondence as to the requests made for these.    
      I do have some questions on the letter you are requesting- the Certificate of Completion already provided covers the entire project marked paid in full so this would include your skylights. Please help me understand the date of sale you are referring to as 11/21/22 was not the date of sale. The Change Order that was executed 9/06/22 for the purchase of the new skylights details out the Velux skylights item description would technically be the date of sale. What reference number are you referring to that it needs to include? If you can please confirm and clarify 1) what date it needs to include. Are you in need of the date of project sale, the date of material order sale, date of delivery or date of installation for the skylights 2) what specific reference number you are referring to you are looking for 3) even though you have a COC are you specifically looking for the letter to isolate out just the full skylights costs?
      We will mail a check to you via postal mail upon receipt of the final invoice from you issued by WSS for the difference covering labor only over the $1049.82.

      thank you for the picture of the bundle of shingles you currently have stored in your garage. As the color of the shingle is little hard to read on as it is placed on the corner crease, confirming that it reads "Hickory". I have provided these pictures to our production team who are in process of obtaining another bundle of these in "Hickory". Upon receipt, please confirm how you would like to receive these.  

      As it isn't fully certain what dates are needed for what you are looking for for manufacturer warranty purposes a letter will be provided detailing all of the important dates to note.

      The letter is on Kingdom Contracting letterhead that includes our contact information plus additional information.

      New skylights were reinstalled on Monday June 12, 2023 by **************************** (WSS). Attached is the invoice for reinstallation by the Velux-certified installer. 

      I was informed by WSS that the skylights installed by Kingdom Contracting (KC) were not "custom" as they had represented to me, which had originally contributed to the excessive length of time KC required to obtain and install the materials. WSS discovered and documented with photographs numerous problems related to the prior installation by **. These were described to me to include (but not limited to) improper securing of the flashing with use of nails that were not Velux-issue and not the correct amount (KC placed roughly 1/2 the recommended number needed to secure the skylight), covering of these nails with caulk or adhesive, failure to place the required water guard around the entire window, improper placement of shingles and even the use of a damaged shingle. For the skylight portion of my contract I paid KC $4,652.51.

      At this time I I expect KC to reimburse me for the entire cost of proper installation ($2,462).
